DECISION

Prescribing key aquatic animals for aquaculture[1]

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the November 21, 2017 Law on Fisheries;

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister promulgates the Decision prescribing key aquatic animals for aquaculture.

Article 1.Scope of regulation and subjects of application

1. Scope of regulation: This Decision details Clause 4, Article 38 of the Law on Fisheries, prescribing key aquatic animals for aquaculture.

2. Subjects of application: This Decision applies to organizations and individuals engaged in trading in key aquatic animals to be reared in the Vietnamese territory.

Article 2.Criteria for identification ofkey aquatic animals for aquaculture

Key aquatic animals for aquaculture must satisfy the following criteria:

1. Being on the list of aquatic species permitted for trading in Vietnam.

2. Creating jobs and high income for laborers; increasing the use efficiency of the natural resources and conditions of the country and having ability to adapt to climate change.

3. Having high productivity and production efficiency; having ability to attract investment to create large-scale mass production areas with hi-tech application.

4. Creating products of high added value; being capable of competing with aquatic animals of other countries on the domestic and export markets, earning an annual export value of at least USD 100 million.

Article 3.List of key aquatic animals for aquaculture

1. Giant tiger prawn (Penaeus monodon Fabricus, 1798).

2. White-legged shrimp (Litopenaeus vannamei Boone, 1931).

3. Striped catfish (Pangasianodon hypophthalmus Sauvage, 1878).

Article 4.Organization of implementation

1. The Ministry of Agriculture and Rural Development shall:

a/ Perform the state management; formulate, and direct the implementation of, strategies, plans and schemes for development of key aquatic animals to be reared nationwide;

b/ Determine orientations for development of key aquatic animals for aquaculture for integration in the system of national sectoral, regional and provincial master plans;

c/ Manage updated information on the development and production of key aquatic animals for aquaculture on the national database on aquatic animals;

d/ Annually sum up and report to the Prime Minister on results of the development of key aquatic animals for aquaculture;

dd/ Basing itself on the actual situation and development requirements, the Minister of Agriculture and Rural Development shall propose to the Prime Minister for revising the regulation on key aquatic animals for aquaculture.

2. Provincial-level People’s Committees shall:

a/ Perform the state management; formulate, and direct the implementation of, strategies, plans and master plans for development of key aquatic animals to be reared in their localities;

b/ Determine orientations for development of key aquatic animals for aquaculture in district-level land use master plans;

c/ Update information on the development and production of key aquatic animals for aquaculture on the national database on aquatic animals;

d/ Annually report to the Ministry of Agriculture and Rural Development on results of the production of key aquatic animals for aquaculture.

3. Organizations and individuals that trade in key aquatic animals for aquaculture shall:

a/ Carry out registration for aquaculture under current regulations;

b/ Be entitled to the policies provided by law; and be provided by competent agencies with information on environmental monitoring and warning results and the development of key aquatic animals for aquaculture upon requests.

Article 5.Implementation provisions

1. This Decision takes effect on January 30, 2019.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees and related agencies, organizations and individuals shall implement this Decision.-
