CIRCULAR
Amending and supplementing a number of articles of the Minister of Public Security’s Circular No. 15/2014/TT-BCA of April 4, 2014, on vehicle registration
Pursuant to the 2008 Law on Road Traffic;
Pursuant to the Government’s Decree No. 106/2014/ND-CP of November 17, 2014, defining the functions, tasks, powers and organizational structure of the Ministry of Public Security;
At the proposal of the Director of the Traffic Police Department;
The Minister of Public Security promulgates the Circular amending and supplementing a number of articles of the Minister of Public Security’s Circular No. 15/2014/TT-BCA of April 4, 2014, on vehicle registration.
Article 1.To amend and supplement a number of articles of the Minister of Public Security’s Circular No. 15/2014/TT-BCA of April 4, 2014, on vehicle registration (below referred to as Circular No. 15/2014/TT-BCA)
1. To amend and supplement Clause 1, Article 3 as follows:
“2. The Traffic Police Department shall register and grant vehicle registration plates for automobiles of the Ministry of Public Security and automobiles of diplomatic missions and representative offices of international organizations and their foreign staff members; and for automobiles purchased with state budget funds of agencies and organizations specified in Appendix 1 to this Circular.”
2. To amend and supplement Clause 2, Article 6 as follows:
“2. In case vehicles having registration number plates with white letters and digits on a blue background and vehicles having registration number plates with the code “80”, black letters and digits on a white background are transferred, sold or donated, vehicle owners shall revoke and return vehicle registration certificates and registration number plates to the registry offices, before handing over such vehicles to the organizations or individuals that buy or are transferred or donated such vehicles.”
3. To amend and supplement Clause 4, Article 10 as follows:
“4. In case forms, documents and papers used in vehicle registration are amended and supplemented, the Traffic Police Department shall notify such amendments or supplementations to the vehicle registry offices defined in Article 3 of this Circular for compliance.”
4. To add the following Clause 8 to Article 19:
“8. Vehicles having been registered and granted registration number plates with white letters and digits on a blue background and vehicles having registration number plates with the code “80” and black letters and digits on a white background, upon issuance of a decision on vehicle transfer, sale or donation”.
5. To amend and supplement Point a, Clause 6, Article 31 as follows:
“a/ Registration number plates will have white letters and digits on a blue background; the letter signifying the serial code of registration number plates will be successively one of the following letters: A, B, C, D, E, F, G, H, K, L, and M, for vehicles of Party agencies; the Presidential Office; the Office and agencies of the National Assembly; offices of National Assembly deputies’ delegations and People’s Councils of all levels; central steering committees; people’s public security units, people’s courts and people’s procuracies; ministries, ministerial-level agencies and government-attached agencies; the National Traffic Safety Committee; People’s Committees of all levels and specialized agencies of provincial- and district-level People’s Committees; socio-political organizations (the Vietnam Fatherland Front, the Trade Union of Vietnam, the Ho Chi Minh Communist Youth Union, the Vietnam Women’s Union, the Vietnam War Veterans’ Association, and the Vietnam Farmers’ Association); public non-business units, excluding public driver training and testing centers; and project management units with the state management function”.
6. To amend a number of phrases of Circular No. 15/2014/TT-BCA as follows:
a/ To amend the phrase “the Railway and Road Traffic Police Department” into the phrase “the Traffic Police Department” in Clause 1, Article 3; Clause 11, Article 23; Articles 28 and 30; Clause 9, Article 31; Clause 1, Article 33; Clause 2, Article 35; and Forms No. 03, 04, 05, 06, 09, 10, 11, 12, and 13 promulgated together with Circular No. 15/2014/TT-BCA;
b/ To amend the phrase “the General Department of Police for Administrative Management of Social Order and Safety” into the phrase “the Traffic Police Department” in Clause 8, Article 31; and Clause 2, Article 35;
c/ To amend the phrase “the General Director of Police for Administrative Management of Social Order and Safety” into the phrase “the Director of the Traffic Police Department” in Clause 4, Article 3; and Clause 1, Article 35;
d/ To amend the phrase “the Railway and Road Traffic Police Department” into the phrase “Traffic Police Department” in Forms No. 9 thru 13 promulgated together with Circular No. 15/2014/TT-BCA.
7. To replace Appendices No. 1, 3 and 4 to Circular No. 15/2014/TT-BCA with Appendices 1, 3 and 4 to this Circular, respectively.
Article 2.Effect and transitional provision
1. This Circular takes effect on February 12, 2018.
2. Agencies and organizations whose automobiles have been registered with the Traffic Police Department and are not subject to registration under Appendix 1 to this Circular shall come to the Traffic Police Department to carry out procedures for change of the place of registration from the Traffic Police Department to Traffic Police Divisions of Public Security Departments of the provinces and centrally run cities where they are headquartered.
Article 3.Implementation responsibility
1. The Director of the Traffic Police Department shall direct, examine and guide the implementation of this Circular by public security units and local public security offices.
2. Heads of public security units and local public security offices shall, within the ambit of their tasks and powers, implement this Circular.
Any problems arising in the course of implementation of this Circular should be reported by public security units and local public security offices to the Ministry of Public Security (through the Traffic Police Department) for timely guidance.-
