CIRCULAR
Prescribing the financial management of the implementation of the Scheme on provision of support for the national innovative startup ecosystem through 2025[1]
Pursuant to the June 18, 2013 Law on Science and Technology;
Pursuant to the June 25, 2015 Law on the State Budget;
Pursuant to the Government’s Decree No. 163/2016/ND-CP of December 21, 2016, detailing a number of articles of the Law on the State Budget;
Pursuant to the Government’s Decree No. 87/2017/ND-CP of July 26, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
In furtherance of the Prime Minister’s Decision No. 844/QD-TTg of May 18, 2016, approving the Scheme on provision of support for the national innovative startup ecosystem through 2015;
At the proposal of the Director of the Department of Administration and Non-Business Finance;
The Minister of Finance promulgates the Circular prescribing the financial management of the implementation of the Scheme on provision of support for the national innovative startup ecosystem through 2025.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation and subjects and application
1. This Circular prescribes the financial management of the implementation of the Scheme on provision of support for the national innovative startup ecosystem through 2025 mentioned in the Prime Minister’s Decision No. 844/QD-TTg of May 18, 2016, approving the Scheme on provision of support for the national innovative startup ecosystem through 2025 (below referred to as Scheme 844).
2. This Circular applies to organizations and individuals engaged in the management and implementation of Scheme 844 and organizations and individuals entitled to support provided in Section II, Article 1 of the Prime Minister’s Decision No. 844/QD-TTg of May 18, 2016, approving Scheme 844 (below referred to as Decision 844).
Article 2. Funds for implementation
Funds for implementation of Scheme 844 come from the following sources:
1. State budget funds for investment in development of science and technology which are allocated in annual state budget estimates of ministries, central agencies and localities: To be used for construction investment activities specified at Points 1 and 2, Section III, Article 1 of Decision 844. The allocation, management and use of funds from this source must comply with the Law on Public Investment and Law on the State Budget and guiding documents.
2. State budget funds for non-business science and technology activities, which are allocated in annual state budget estimates of ministries, central agencies and localities according to the delegation of management authority under the Law on the State Budget, shall be used for:
a/ The tasks prescribed at Points 3, 4, 5, 6, 7, 8, 9 and 11, Section III, Article 1 of Decision 844; general activities and regular tasks of Scheme 844. The items and levels of expenditures for these activities must comply with the provisions of Chapter II of this Circular.
b/ Provision of partial support for projects on first-time repair (covering repair, renovation, procurement and installment of equipment) and installment of information technology infrastructure facilities of centralized startup support service centers prescribed at Point 2, Section III, Article 1 of Decision 844 in case project-implementing units have already had grounds and infrastructure facilities for these centers.
Based on annual budget-balancing capacity, ministers, heads of central agencies and chairpersons of provincial-level People’s Committees (for projects managed by localities as delegated) shall decide and approve specific projects on first-time repair and installment of information technology infrastructure facilities of centralized startup support service centers under their management as appropriate. The maximum support level is VND 1,000,000,000 (one billion Vietnam dong) per approved project.
