Circular 25/2025/TT-BTC amend Circular 89/2015/TT-BTC guiding the warehousing, delivery, purchasing and selling of national reserve commodities

Amending and supplementing a number of articles of the Minister of Finance’s Circular No. 89/2015/TT-BTC dated June 11, 2015, guiding the warehousing, delivery, purchasing and selling of national reserve commodities

Pursuant to the Law on the National Reserves dated November 20, 2012;

Pursuant to the Law on Prices dated June 19, 2023;

Pursuant to the Government’s Decree No. 94/2013/ND-CP dated August 21, 2013, detailing the implementation of the Law on the National Reserves;

Pursuant to the Government’s Decree No. 29/2025/ND-CP dated February 24, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director General of the General Department of State Reserves;

The Minister of Finance hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Finance’s Circular No. 89/2015/TT-BTC dated June 11, 2015, guiding the warehousing, delivery, purchasing and selling of national reserve commodities.

Article 1. To add Clause 3 Article 15 of Circular No. 89/2015/TT-BTC dated June 11, 2015, of the Minister of Finance, as follows:

“3. The starting price of each unit of auctioned assets in respect of national reserve foodstuffs under the management of the Ministry of Finance shall be determined as follows:

The Director of the Regional Branch of State Reserves shall hire a price appraisal enterprise or apply the comparative method specified in Section 3 Chapter II of Circular No. 45/2024/TT-BTC dated July 01, 2024, of the Minister of Finance, promulgating the general pricing method applicable to goods and services subject to state-determined prices as a basis for determining the starting price of each unit of auctioned assets. The Director of the Regional Branch of State Reserves shall be held legally accountable to the Director General of the General Department of State Reserves for the starting price of each unit of auctioned assets, ensuring openness, transparency, and conformity with the market price at the time of sale”.

Article 2. Effect

This Circular takes effect from the date of its signing.

The Director General of the General Department of State Reserves and relevant units and organizations shall be responsible for the implementation of this Circular.

Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Finance for study and resolution.
