CIRCULAR
Providing the roadmap of application of import and export border gates for goods temporarily imported for re-export and goods in border-gate transfer and bonded warehouses[1]
Pursuant to the June 12, 2017 Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’ Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 112/2014/ND-CP of November 21, 2014, on management of land border gates;
At the proposal of the Director General of the Agency of Foreign Trade,
The Minister of Industry and Trade promulgates the Circular providing the roadmap of application of import and export border gates for goods temporarily imported for re-export and goods in border-gate transfer and bonded warehouses.
Article 1.Scope of regulation
This Circular provides the roadmap of application of import and export border gates for goods temporarily imported for re-export and goods in border-gate transfer and bonded warehouses.
Article 2.Subjects of application
1. Traders engaged in temporary import for re-export, border-gate transfer and consignment into bonded warehouses of goods.
2. Organizations and agencies managing operations of temporary import for re-export, border-gate transfer and consignment into bonded warehouses of goods.
3. Agencies, organizations and individuals involved in temporary import for re-export, border-gate transfer and consignment into bonded warehouses of goods.
Article 3.Regulations on import and export border gates
1. For goods traded in the form of temporary import for re-export or border-gate transfer, and imported into or re-exported from Vietnam across land borders, their import or re-export may only be made via international or main border gates (bilateral border gates) established under the Government’s Decree No. 112/2014/ND-CP of November 21, 2014, on the management of land border gates.
2. Provisions of Clause 1 of this Article also apply to foreign goods temporarily imported for re-export and consigned into bonded warehouses, provided that such goods are imported into or re-exported from Vietnam across land borders.
3. Provisions of Clauses 1 and 2 of this Article apply from 00:00 of January 1, 2021.
Article 4.Effect
1. This Circular takes effect on June 30, 2020.
2. Any problems arising in the course of implementation of this Circular should be reported in writing to the Ministry of Industry and Trade for solution.-
