SUMMARY

Cases where enrollment quotas of the educational institution shall not be increased

On January 18, 2022, the Ministry of Education and Training issues the Circular No. 03/2022/TT-BGDDT prescribing the calculation of enrollment quotas for bachelor’s, master’s, doctoral degree students and Early Childhood Education associate degree students.

Accordingly, enrollment quotas shall be calculated according to the educational institution’s training capacity, the demand for workers, and the percentage of students who have jobs within 12 months after graduation (as for full-time associate or bachelor’s degree students), the admissions of the year preceding the enrollment year the quotas are calculated, and the enrollment organization of the educational institution.

The overall enrollment quotas of the educational institution for each education level and each field of study (as for bachelor’s degree students) or for each discipline (as for master’s and doctoral degree students) shall not be increased compared to the enrollment year preceding the year of quota calculation and enrollment of the educational institution, if such educational institution meets the conditions in terms of time to conduct the educational institution accreditation but has not yet been recognized as meeting the quality accreditation standards.

Besides, the enrollment quotas of a field of study shall not be increased compared to that of such field in the enrollment year preceding the year of quota calculation and enrollment, if the percentage of bachelor’s degree students in such field who have jobs within 12 months after the graduation is less than 80% or the enrollment rate of such field in the preceding enrollment year is less than 80% (applicable to the calculation of enrollment quotas for bachelor’s degree students, except for some cases).

CIRCULAR

Prescribing the calculation of enrollment quotas for bachelor’s, master’s, doctoral degree students and Early Childhood Education associate degree students

Pursuant to the Law on Education dated June 14, 2019;

Pursuant to the Law on Higher Education dated June 18, 2012 and the Law dated November 19, 2018 amending and supplementing a number of articles of the Law on Higher Education;

Pursuant to Decree No. 69/2017/ND-CP dated May 25, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 99/2019/ND-CP dated December 30, 2019 of the Government detailing and guiding the implementation of a number of articles of the Law Amending and Supplementing a Number of Articles of the Law on Higher Education;

At the proposal of the Director of the Higher Education Department;

The Minister of Education and Training hereby promulgates the Circular prescribing the calculation of enrollment quotas for bachelor’s, master’s, doctoral degree students and Early Childhood Education associate degree students.

Article 1. Scope of regulation and subjects of application

1. This Circular prescribes the calculation of enrollment quotas for bachelor’s, master’s, doctoral degree students and Early Childhood Education associate degree students.

2. This Circular applies to higher education institutions; other educational institutions that are permitted to offer bachelor’s, master’s and doctoral degree courses; academies and institutes established by the Prime Minister under the provisions of the Law on Science and Technology and permitted to offer doctoral degree courses; junior colleges that are permitted to offer Early Childhood Education associate degree course (hereinafter referred to as educational institutions); relevant organizations and individuals.

Article 2. Objectives

1. Educational institutions shall calculate and fulfill their enrollment quotas depending on the requirements for education quality assurance and socio-economic development while exercising the autonomy and taking the accountability for the calculation and fulfillment of the enrollment quotas.

2. Publicly and transparently satisfying the education quality assurance requirements as well as the grounds for calculating enrollment quotas and the percentage of students who have jobs after graduation from the educational institutions for the State management agencies to conduct inspections and examinations, for the society to supervise, and for the learners to choose suitable educational institutions to enroll in.

Article 3. Interpretation of terms

The terms used in this Circular are construed as follows:

1. List of disciplines means the level-4 classification of education at higher education levels promulgated by the Ministry of Education and Training.

2. Discipline means a combination of professional knowledge and skills within the scope of vocational or science and technology activities; which are listed and categorized in the list of disciplines.

3. Group of disciplines means a collection of some disciplines sharing common professional characteristics within the scope of vocational or science and technology activities, which are listed and categorized in the level-3 classification of education in the List of education classifications of the national education system prescribed by the Prime Minister.

4. Field of study means a collection of discipline groups sharing common characteristics in terms of professional knowledge and skills within the scope of vocational or science and technology activities, which are listed and categorized in the level-2 classification of education in the List of education classifications of the national education system.

5. Full-time lecturers in calculating enrollment quotas are permanent lecturers and lecturers who sign labor contracts with a definite term of full 12 months or more working full-time at an educational institution (hereinafter referred to as full-time lecturers) as follows:

a) Full-time lecturers identified in accordance with the provisions of Point e, Clause 1, Article 10 of the Government’s Decree No. 99/2019/ND-CP dated December 30, 2019 detailing and guiding the implementation of a number of articles of the Law Amending and Supplementing a Number of Articles of the Law on Higher Education;

b) Lecturers who sign labor contracts with a definite term of full 12 months or more working full-time at an educational institution in accordance with the current regulations of the Ministry of Education and Training on working regimes of university lecturers in the year the enrollment quotas are calculated (including instructors for practice and experiments), and at the same time do not sign labor contracts with a definite term of 3 months or more with another employer.

6. Visiting lecturer in calculating enrollment quotas means a person who is not specified in Clause 5 of this Article and directly participates in teaching and guiding learners of an educational institution under a visiting contract with such educational institution in accordance with the law provisions in the year the enrollment quotas are calculated.

7. Students, trainees, doctoral students expected to graduate in calculating enrollment quotas are those expected to graduate in the year the enrollment quotas are calculated, the number of whom is calculated by dividing the training scale of each discipline/field of study/form of training by the number of academic years for such discipline/field of study/form of training.

Article 4. Principles for calculating enrollment quotas

1. An educational institution shall calculate the enrollment quotas for Early Childhood Education associate degree students and the enrollment quotas for bachelor’s, master’s and doctoral degree students in accordance with the provisions of this Circular and current law provisions; publicly announce, take accountability to the laws and be accountable for the calculation of the enrollment quotas, the education quality assurance requirements and the educational institution’s commitments to output standards meeting the social demand, and at the same time be subject to the supervision of management agencies and the society.

2. Enrollment quotas shall be calculated annually and independently for each education level. Based on the quotas calculated for each level, an educational institution shall publicly announce the enrollment quotas calculated for each discipline/group of disciplines in the enrollment scheme and plan and be accountable to the society and the agency directly managing it.

3. Enrollment quotas for bachelor’s degree students shall be calculated for each discipline or group of disciplines and ensure that the training scale does not exceed the training capacity of the respective field of study. Enrollment quotas for master’s, doctoral degree students and Early Childhood Education associate degree students as well as enrollment quotas for bachelor’s degree students in teaching disciplines shall be calculated for each discipline, given that the training scale does not exceed the training capacity of such discipline.

4. Enrollment quotas shall be calculated according to the educational institution’s training capacity, the demand for workers, and the percentage of students who have jobs within 12 months after graduation (as for full-time associate or bachelor’s degree students), the admissions of the year preceding the enrollment year the quotas are calculated, and the enrollment organization of the educational institution, specifically as follows:

a) The enrollment quotas of the educational institution shall be calculated in line with the training capacity of the educational institution as prescribed in Articles 7 to 12 of this Circular;

b) The enrollment quotas of the educational institution shall not be increased in the following cases:

- The overall enrollment quotas of the educational institution for each education level and each field of study (as for bachelor’s degree students) or for each discipline (as for master’s and doctoral degree students) shall not be increased compared to the enrollment year preceding the year of quota calculation and enrollment of the educational institution, if such educational institution meets the conditions in terms of time to conduct the educational institution accreditation but has not yet been recognized as meeting the quality accreditation standards prescribed by the current law provisions;

- The enrollment quotas of a field of study shall not be increased compared to that of such field in the enrollment year preceding the year of quota calculation and enrollment, if the percentage of bachelor’s degree students in such field who have jobs within 12 months after the graduation is less than 80% or the enrollment rate of such field in the preceding enrollment year is less than 80% (applicable to the calculation of enrollment quotas for bachelor’s degree students, unless the training program of such bachelor’s degree discipline is recognized as meeting the quality accreditation standards prescribed by the law provisions).

5. An educational institution that violates the regulations on enrollment subjects, requirements and quotas as prescribed at Point c, Clause 1, Article 34 of the Law on Higher Education (amended and supplemented in 2018) shall not be permitted to self-calculate the enrollment quotas within 05 years from the date the competent state agencies make conclusions on the violations committed by such educational institution. In this case, the Ministry of Education and Training shall calculate and notify the enrollment quotas to the educational institution as follows:

a) The educational institution shall register its enrollment quotas which must fully comply with the principles of calculating enrollment quotas as prescribed in Clauses 1, 2, 3 and 4 of this Article, then deduct the number of enrollment quotas related to the violations against regulations on enrollment subjects, requirements and quotas it has committed;

b) The Ministry of Education and Training shall calculate and announce enrollment quotas for such educational institution in accordance with Clauses 1, 2, 3, 4 and Point a, Clause 5 of this Article.

6. For Early Childhood Education associate degree disciplines or bachelor’s degree disciplines which are newly opened in the respective enrollment year, the enrollment quotas shall be calculated in line with the training capacity of the respective field of study and not exceed 30% of the training capacity of the disciplines as prescribed.

7. For the disciplines in the group of teacher training disciplines, the Ministry of Education and Training shall calculate and announce the enrollment quotas for each full-time associate degree or bachelor’s degree discipline depending on the training capacity of the educational institution as well as the demand of the locality and the whole country. The educational institution shall autonomously calculate the enrollment quotas for part-time associate and bachelor’s degree students and the enrollment quotas for master’s and doctoral degree students in accordance with this Circular and relevant law provisions.

8. For disciplines in the field of security and national defense, the agencies directly managing the educational institutions shall calculate the enrollment quotas at all levels and of all forms of training on the basis of the educational institutions’ training capacity and the demand for employees in accordance with the provisions of this Circular, the regulations of the agencies directly managing the educational institutions and other relevant law provisions, then notify the quotas to such educational institutions.

9. The percentage of students who have jobs after graduation with associate or bachelor’s degrees as prescribed in Clause 4 of this Article shall be, as for each discipline, surveyed in the year preceding the enrollment year, the surveying subjects of which are students graduated in two year before the respective enrollment year, and equal to the ratio of full-time students who have jobs within 12 months after their graduation, recognized under a decision of the educational institution, to the total full-time students of the respective discipline and education level who graduate in that year.

Article 5. Regulations on lecturers in calculating enrollment quotas

1. Each lecturer of the educational institution shall be categorized into a bachelor’s degree field of study that he/she is mainly teaching (other than lecturers teaching disciplines in the group of teacher training disciplines and lecturers teaching Early Childhood Education associate degree students, each of whom shall be categorized to the discipline he/she is mainly teaching); be categorized into a master’s or doctoral degree discipline that he/she is mainly teaching in order to calculate enrollment quotas. The categorization of lecturers into a field of study/discipline shall be in line with their expertise and in proportion to the training scale of such field of study/discipline.

2. Regulations on lecturers in calculating enrollment quotas for bachelor’s and associate degree students:

a) The total number of converted lecturers for each field of study (other than lecturers teaching bachelor’s degree disciplines in the group of teacher training disciplines and lecturers teaching Early Childhood Education associate degree students, who shall be converted for each discipline they are categorized into), used to calculate the enrollment quotas of an educational institution, covers the number of converted full-time lecturers and the number of respectively converted visiting lecturers of such field of study/discipline;

b) The number of converted visiting lecturers used to calculate the enrollment quotas shall be at most equal to 10% of the total number of converted full-time lecturers of the educational institution, as for each field of study. Particularly, for specialized disciplines in the field of Arts and specialized disciplines to meet the high demand for workers with bachelor’s degrees (specified in Appendix 2 to this Circular), the number of converted visiting lecturers used to calculate the enrollment quotas shall be at most equal to 40% of the total number of converted full-time lecturers of such educational institution, as for each field of study; visiting lecturers teaching disciplines in the group of teacher training disciplines shall not be counted to calculate enrollment quotas;

c) The coefficient used to convert the number of full-time lecturers and visiting lecturers, who have different titles and qualifications, teaching Early Childhood Education associate degree students and bachelor’s degree students at an educational institution is specified in Table 1 of Appendix 1 to this Circular; in which each lecturer shall only be converted once with the highest possible conversion coefficient;

d) As for specialized disciplines to meet the high demand for workers with bachelor’s degrees serving the country’s socio-economic development, including disciplines in the fields of computing and information technology; information, tourism, hospitality, sports and personal services (specified in Appendix 2 to this Circular), and disciplines included in the schemes approved by the Prime Minister (which shall be announced by the Ministry of Education and Training in each period as well as adjusted and supplemented on the basis of the demand for workers serving the country’s socio-economic development under the guidelines and orientations of the State), visiting lecturers also mean experts, technicians, and managers who are workers with bachelor’s degrees in the same discipline or group of disciplines as the one they are teaching and have at least 5 years of professional experience at enterprises or professional associations related to the discipline and field of study in which they are assistant lecturers, and the number of them shall be converted with the coefficient as specified at Point c of this Clause to calculate the enrollment quotas.

3. Regulations on lecturers in calculating enrollment quotas for master’s and doctoral degree students:

a) The total number of lecturers of each discipline, used to calculate the enrollment quotas of an educational institution, covers full-time lecturers and visiting lecturers of such educational institution with the qualifications/titles satisfying the requirements for lecturers who teach master’s and doctoral degree students and the expertise suitable to the respective discipline;

b) The number of visiting lecturers used to calculate the enrollment quotas shall be at most equal to 10% of the total full-time lecturers of the educational institution, as for each discipline. As for specialized disciplines in the field of Arts, the number of visiting lecturers used to calculate the enrollment quotas shall be at most equal to 40% of the total full-time lecturers of the educational institution, as for each discipline; visiting lecturers teaching disciplines in the group of teacher training disciplines shall not be counted to calculate the enrollment quotas.

4. For disciplines training teachers to teach languages of Vietnam’s ethnic minority groups as well as Vietnamese language, literature and culture disciplines, foreign language, literature and culture disciplines, physical training and sports disciplines (specified in the list of disciplines), and specialized disciplines in the field of Arts, the number of lecturers used to calculate enrollment quotas shall comply with Clauses 2 and 3 of this Article and the following regulations:

a) Assistant lecturers who are recognized and granted the title of Meritorious Artist, People’s Artist, Elite Artisan, People’s Artisan, Meritorious Teacher, People’s Teacher by the Government, and concurrently hold bachelor’s degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers holding master’s degrees (as for assistant lecturers in calculating enrollment quotas for bachelor’s degree students);

b) Lecturers who are recognized and granted the title of People’s Artist, People’s Artisan, and People’s Teacher by the Government, concurrently holding master’s degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers holding doctoral degrees (in calculating enrollment quotas for bachelor’s degree students), and counted as lecturers holding doctoral degrees to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

c) Lecturers who are recognized and granted the title of People’s Artist, People’s Artisan, and People’s Teacher by the Government, concurrently holding doctoral degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are associate professors (in calculating enrollment quotas for bachelor’s degree students), and counted as associate professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

d) Lecturers who are recognized and granted the title of People’s Artist, People’s Artisan, and People’s Teacher by the Government, concurrently holding doctoral degrees and being associate professors in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are professors (in calculating enrollment quotas for bachelor’s degree students), and counted as professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

5. Particularly, for Vietnam’s ethnic minority language disciplines in the group of Vietnam’s language, literature and culture disciplines, lecturers who are of ethnic minority groups or have knowledge about languages and cultures of ethnic minority groups related to the discipline they are teaching; if concurrently holding bachelor’s degree in the same discipline or group of disciplines as the one they are teaching, shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers holding master’s degrees (as for assistant lecturers in calculating enrollment quotas for bachelor’s degree students); if concurrently holding master’s degrees in the same discipline or group of disciplines as the one they are teaching, shall be converted to calculate the enrollment quotas with the same coefficient as lecturers holding doctoral degrees (in calculating enrollment quotas for bachelor’s degree students), and counted as lecturers holding doctoral degrees to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students); if concurrently holding doctoral degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are associate professors (in calculating enrollment quotas for bachelor’s degree students), and counted as associate professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students); if concurrently holding doctoral degrees and being associate professors in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are professors (in calculating enrollment quotas for bachelor’s degree students), and counted as professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

6. Disciplines in the field of Health (as specified in the List of disciplines), the number of lecturers used to calculate the quotas shall comply with Clauses 2 and 3 of this Article and the following regulations:

a) An educational institution that organizes practice training in the field of Health shall define the instructors of public practice facilities, specified in Clause 2, Article 10 of Decree No. 111/2017/ND-CP dated January 5, 2017 on the organization of practical training in the field of health, as full-time lecturers of such educational institution if they are appointed to concurrently hold leading or managerial positions of faculties or higher-level departments at such educational institution;

b) Lecturers who are resident doctors or specialist level-1 doctors in the disciplines they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as lecturers with master’s degree students (in calculating enrollment quotas for bachelor’s degree students); lecturers who are specialist level-2 doctors in the disciplines they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as lecturers holding doctoral degrees (in calculating enrollment quotas for bachelor’s degree students), and counted as lecturers holding doctoral degrees to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students).

Article 6. Criteria for calculating enrollment quotas for full-time associate and bachelor’s degree students, and methods of calculation according to such criteria

1. The criteria of the number of full-time students per a converted lecturer of the educational institution in each field of study:

a) Full-time students in calculating enrollment quotas cover full-time bachelor’s degree students, full-time Early Childhood Education associate degree students, and full-time transfer students (including students transferred from professional secondary degrees or associate degrees students to full-time bachelor’s degrees; transferred from teacher training professional secondary degrees to Early Childhood Education associate degrees; graduates holding other teacher training associate degrees studying an Early Childhood Education associate degree; graduates holding bachelor’s or higher-level degrees studying another bachelor’s degree); excluding students enrolled under selection-based enrolmentt policies at such educational institution;

b) The number of full-time bachelor’s degree students per converted lecturer in each field of study shall be at most equal to the quotas in Table 2 of Appendix 1 to this Circular;

c) The number of full-time Early Childhood Education associate degree students per converted lecturer shall not exceed 25;

d) Method of calculation:

Divide the total number of full-time students in a field of study by the total number of converted lecturers of such field of study.

2. The criteria of the construction floor area directly used for educational purposes of the educational institution per full-time student, as for the work items, and requirements on the type and minimum quantity of learning materials and equipment required for training programs and scientific research:

a) The construction floor area directly used for educational purposes per full-time student shall not be less than 2.8 m2;

b) Work items of which the construction floor area directly used for educational purposes shall be calculated, and the requirements on the type and minimum quantity of learning materials/equipment of each item are specified as follows:

- Halls, lecture halls, classrooms of all kinds, multi-purpose rooms, working rooms of professors, associate professors and lecturers of the educational institution;

- Libraries, learning resource centers;

- Research centers, laboratories, practice and training facilities;

c) Method of calculation:

Divide the total construction floor area of all work items defined at Point b of this Clause by the total full-time students of the educational institution.

3. For disciplines taught mainly online on a trial basis and applied modern scientific and technological achievements under the scheme of the educational institution in order to meet the demand for workers with bachelor’s degrees serving the socio-economic development of the locality/sector/country approved by the Ministry of Education and Training in each period, the criteria for calculating the enrollment quotas for full-time bachelor’s degree students shall comply with Clauses 1 and 2 of this Article and be considered and decided by the Minister of Education and Training.

4. The criteria of the labor demand of the market and the requirements for socio-economic development: The educational institution shall calculate the enrollment quotas depending on the labor demand of the market and the requirements of socio-economic development of the country, respective locality and sector.

Article 7. Calculation of enrollment quotas for full-time associate and bachelor’s degree students

1. The annual enrollment quotas for Early Childhood Education associate degree students and full-time bachelor’s degree students shall be at most equal to the total scale of full-time training calculated according to the training capacity of each field of study (of each discipline, for those in the group of teacher training disciplines), which shall satisfy all the criteria specified in Article 6 of this Circular, minus the total number of full-time students who are currently learning at such educational institution and plus the number of students expected to graduate in the enrollment year, following the general principles prescribed in Article 4 of this Circular.

2. The enrollment quotas for full-time students transferred from other degrees to bachelor’s degrees shall be included in the overall enrollment quotas for all full-time students, of which the percentage of students transferred from professional secondary or associate degrees to bachelor’s degrees shall be calculated according to the current regulations of the Government and the Prime Minister. The enrollment quotas for full-time Early Childhood Education associate degree students shall be included in the overall enrollment quotas for all full-time associate degree students of the educational institution.

3. For the enrollment quotas of full-time transfer students in accordance with the Decree No. 71/2020/ND-CP dated March 30, 2020 of the Government prescribing the roadmap for raising the education attainments of preschool, primary school and lower secondary school teachers, the Minister of Education and Training shall consider, decide and inform the educational institutions depending on the demand of the respective localities and the training capacity of the educational institutions.

Article 8. Calculation of enrollment quotas for full-time associate and bachelor’s degree students in teacher training disciplines

1. An educational institution that is permitted to teach teacher training disciplines shall calculate the enrollment quotas for Early Childhood Education associate degree students and full-time bachelor’s degree students in teacher training disciplines in accordance with this Circular and the current law provisions, then report to the Ministry of Education and Training in order to register the enrollment quotas for teacher training disciplines of such educational institution.

2. The Ministry of Education and Training shall calculate and announce the enrollment quotas for Early Childhood Education associate degree students and the enrollment quotas for full-time bachelor’s degree students in each teacher training discipline for every educational institution depending on the training capacity of such educational institution, the demand of the respective locality and the country as well as in accordance with the provisions of this Circular and relevant current law provisions.

Article 9. Calculation of enrollment quotas for part-time associate and bachelor’s degree students

1. The enrollment quotas for part-time Early Childhood Education associate degree students (including students who have graduated from upper secondary schools or those who have obtained associate degrees, and students transferred to associate degrees after graduating from professional secondary schools) shall not exceed 50% of the overall enrollment quotas for full-time associate degree students.

2. The enrollment quotas for part-time bachelor’s degree students (including students who have graduated from upper secondary schools or those who have obtained bachelor’s degrees, and students transferred from professional secondary or associate degrees to bachelor’s degrees) shall not exceed 30% of the enrollment quotas for full-time bachelor’s degree students in each field of study of the educational institution. For the field of Arts and the group of teacher training disciplines, the educational institution’s enrollment quotas for part-time bachelor’s degree students shall not exceed 50% of the enrollment quotas for full-time bachelor’s degree students in each field of study (in each discipline, as for the group of teacher training disciplines) of the educational institution.

3. The enrollment quotas for part-time transfer bachelor’s degree students shall be included in the overall enrollment quotas for part-time bachelor’s degree students of the educational institution, in which the percentage of the enrollment quotas for part-time students transferred from professional secondary or associate degrees to bachelor’s degrees shall be calculated according to the current regulations of the Government and the Prime Minister. The enrollment quotas for part-time Early Childhood Education associate degree students transferred from other lower degrees shall be included in the overall enrollment quotas for part-time associate degree students of the educational institution.

4. For the enrollment quotas of part-time transfer students in accordance with the Decree No. 71/2020/ND-CP dated March 30, 2020 of the Government prescribing the roadmap for raising the education attainments of preschool, primary school and lower secondary school teachers, the Minister of Education and Training shall consider, decide and inform the educational institutions depending on the demand of the respective localities and the training capacity of the educational institutions.

Article 10. Calculation of the enrollment quotas for bachelor’s degree distance learners

1. An educational institution that fully meets the minimum requirements for conducting a distance learning program, and at the same time fully meets the requirements for information technology application in management and organization of teaching via computer networks, including a system of electronic learning materials combined with traditional learning materials, online lectures and a learning management system (LMS) to support learners, and complies with other relevant regulations of the Ministry of Education and Training, shall calculate the enrollment quotas for distance learners in full-time bachelor’s degree disciplines they are allowed to teach as prescribed in Clauses 2, 3, and 4 of this Article and the current relevant law provisions, and at the same time be responsible for the decision on conducting distance learning of each discipline.

2. The annual enrollment quotas for bachelor’s degree distance learners shall be calculated for each distance learning field of study and be at most equal to the total scale of distance learning calculated according to the training capacity of each field of study, which shall satisfy all the criteria specified in Clauses 3 and 4 of this Article, minus the total number of bachelor’s degree distance learners who are actually learning the respective field of study at the educational institution and its distance learning stations, plus the number of bachelor’s degree distance learners of such field of study expected to graduate in the enrollment year.

3. The criteria of the number of bachelor’s degree distance learners per lecturer for each field of study:

a) Lecturers in calculating distance learning enrollment quotas are full-time lecturers and visiting lecturers who are teaching and instructing distance learners of the educational institution in an average time of at least 08 working hours per week; lecturers who have the average teaching time of less than 08 working hours per week shall be counted in proportion to their actual teaching time;

b) The coefficient used to convert lecturers teaching distance learners, including visiting lecturers, based on their qualifications and titles in order to calculate the enrollment quotas shall be applied similarly to the coefficient used to convert full-time lecturers as prescribed in Article 5 of this Circular;

c) The number of distance learners per converted distance learning lecturer of each field of study shall be at most equal to that of full-time students as prescribed at Point b, Clause 1, Article 6 of this Circular.

4. The criteria of the number of bachelor’s degree distance learners per full-time distance learning manager or support staff (of the entire educational institution):

a) Full-time distance learning managers and support staff are cadres or employees who sign labor contracts with a definite term of 12 months or more in the enrollment year and work full-time (in accordance with the provisions of the current Labor Code on working time and rest time for workers) responsible for the management and support of distance learning of the educational institution and distance learning stations; those who work part-time responsible for distance learning shall be counted in proportion to the actual time they concurrently manage and support distance learning;

b) The coefficient used to convert managers and support staff specialized in distance learning based on their qualifications and titles in order to calculate the enrollment quotas shall be applied similarly to the coefficient used to convert full-time lecturers as prescribed in Article 5 of this Circular;

c) The number of distance learners per one converted full-time distance learning manager or support staff shall not exceed 200.

Article 11. Calculation of enrollment quotas for master’s and doctoral degree students

1. The maximum enrollment quotas for master’s degree students of an educational institution shall be calculated for each discipline, equal to the maximum scale of master’s degree training calculated according to the training capacity of such discipline, satisfy all the criteria specified in Clause 03 of this Article, and ensure the number of students per one thesis supervisor who fully meets the requirements for a thesis supervisor prescribed in the current regulations on enrollment and training of master’s degree students issued by the Ministry of Education and Training.

2. The maximum enrollment quotas for doctoral degree students of an educational institution shall be calculated for each discipline, equal to the maximum scale of doctoral degree training calculated according to the training capacity of such discipline, which shall satisfy all the criteria specified in Clause 03 of this Article, minus the current doctoral degree training scale, plus the number of doctoral degree students of such discipline expected to graduate in the respective enrollment year.

3. The criteria for calculating enrollment quotas for master’s and doctoral degree students

a) The maximum number of graduate or doctoral students per one full-time lecturer or visiting lecturer based on his/her qualifications, titles and professional relevance, used to calculate the enrollment quotas of the educational institution, shall be at most equal to the limit specified in Table 3 (for full-time lecturers) or Table 4 (for visiting lecturers) or Appendix 1 to this Circular;

b) The criteria of facilities and equipment: The educational institution shall have adequate facilities, laboratories, practice equipment, libraries, lecture halls, and working rooms of lecturers and supervisors, graduate and doctoral students meeting the requirements of the discipline, major and type of the training program;

c) The criteria of the labor demand of the market and requirements for socio-economic development: The educational institution shall calculate the enrollment quotas depending on the labor demand of the market and the requirements of socio-economic development of the country, respective locality and sector.

Article 12. Calculation and announcement of enrollment quotas of educational institutions

1. An educational institution shall calculate and announce its enrollment quotas in accordance with the provisions of this Circular and the current relevant law provisions, in which the school council is accountable for the orientation of enrollment methods and the increase or decrease of the training scale of each group of disciplines and field of study in line with the development orientation of such educational institution, meeting the demand for workers of the society as well as ministries, sectors, localities and the whole country, ensuring the international integration. The director or rector of the educational institution shall decide on the calculation of its enrollment quotas and take the accountability for the specific enrollment quota of each discipline, group of disciplines and field of study, given that it is suitable to the training capacity of the educational institution as prescribed in this Circular and other relevant provisions of law.

2. The educational institutions shall fully update information and detailed data on the criteria for calculating enrollment quotas, the enrollment quotas that have been calculated, and the results of fulfilling enrollment quotas into the management software of the Ministry of Education and Training.

3. The educational institutions shall publicly and transparently announce the education quality assurance requirements, disclose the database and the criteria for calculating enrollment quotas, the enrollment quotas that have been calculated, the enrollment schemes and plans, the percentage of students who have jobs within 12 months after graduation, and other necessary information of the educational institution on their websites, and update the data into the management software of the Ministry of Education and Training. For disciplines in the field of security and national defense, the educational institutions shall publicly and transparently announce the education quality assurance requirements and other necessary information as prescribed by the agencies directly managing them and update the data into the management software of the Ministry of Education and Training.

4. The educational institutions shall prepare annual reports on the calculation of enrollment quotas using the report sample (specified in Appendix 4 to this Circular) and submit the reports in accordance with the guiding dispatches of the Ministry of Education and Training.

Article 13. The educational institutions shall:

1. Strictly follow the procedures of calculating and announcing enrollment quotas.

2. Ensure the truthfulness and accuracy of the reported data and the grounds for calculating the enrollment quotas, the results of fulfilling the annual enrollment quotas and take accountability to the State management agencies and the society.

3. Fulfill the enrollment quotas for bachelor’s degree students in each field of study (other than enrollment quotas for bachelor’s degree students in the group of teacher training disciplines and Early Childhood Education associate degree students, which shall be fulfilled in each discipline) and the enrollment quotas for the master’s and doctoral degree students in each discipline, which shall satisfy the criteria determined and publicly announced by the educational institution, and in line with the training capacity as prescribed in this Circular.

4. Provide sufficient information on the calculation and fulfillment of enrollment quotas upon requests for verification, inspection and examination by the Ministry of Education and Training and competent agencies.

5. Educational institutions, which are permitted to teach specialized disciplines to meet the high demand for workers with bachelor’s degrees serving the country’s socio-economic development, shall formulate and publicize information of their enrollment schemes and the quality assurance proofs on their websites in accordance with the current enrollment regulations.

6. Directors and rectors of the educational institutions shall be accountable to the Ministry of Education, Training and Social Affairs for the calculation and fulfillment of the enrollment quotas of such educational institutions in accordance with the current regulations.

Article 14. Inspection, examination and handling of violations

1. The Ministry of Education and Training shall inspect and examine the calculation of enrollment quotas of educational institutions in accordance with the law provisions.

2. Education institutions that violate regulations on the calculation of enrollment quotas shall be handled in accordance with law. The director or rector of any educational institution where wrongdoing(s) related to the calculation of enrollment quotas is committed and the person(s) who commits the violations against regulations on the calculation of enrollment quotas shall be handled in accordance with the law provisions.

Article 15. Effect

1. This Circular takes effect from March 4, 2022 and applies to Early Childhood Education associate degree courses; bachelor’s, master’s, and doctoral degree courses that enroll students from 2022 onwards.

2. This Circular replaces the Circular No. 06/2018/TT-BGDDT dated February 28, 2018 of the Minister of Education and Training providing regulations on the calculation of enrollment quotas for secondary and associate degree students in teacher training disciplines; bachelor’s, master’s, and doctoral degree students, as amended and supplemented in Circular No. 01/2019/TT-BGDDT dated February 25, 2019 and Circular No. 07/2020/TT-BGDDT dated March 20, 2020.

3. The Chief of Ministry Office, the Director of Higher Education Department, heads of relevant units under the Ministry of Education and Training; relevant ministries and sectors; directors of universities and academies; rectors of universities; rectors of junior colleges permitted to offer Early Childhood Education associate degree courses; directors of institutes permitted to offer doctoral degree courses; heads of schools run by State agencies, political organizations, socio-political organizations and people’s armed forces permitted to offer training courses at higher education levels shall be responsible for implementing this Circular.
