CIRCULAR

Prescribing the application of import tariff quotas for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union in 2017, 2018 and 2019^[1]

Pursuant to the Government’s Decree No. 95/2012/ND-CP of November 12, 2012, defining the functions, duties, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 187/2013/ND-CP of November 20, 2013, detailing the implementation of the Commercial Law regarding international goods sale and purchase and goods sale, purchase, processing, agency and transit activities with foreign countries;

In implementation of the Vietnam - Eurasian Economic Union Free Trade Agreement, which was concluded in the Republic of Kazakhstan on May 29, 2015, and ratified by the President of the Socialist Republic of Vietnam under Decision No. 1805/QD-CTN of August 19, 2015;

At the proposal of the director of the Import-Export Department,

The Minister of Industry and Trade promulgates the Circular prescribing the application of import tariff quotas for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union in 2017, 2018 and 2019.

Article 1.Scope of regulation

To apply import tariff quotas for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union in accordance with the Vietnam - Eurasian Economic Union Free Trade Agreement.

Article 2.Subjects of application

This Circular applies to traders importing under the tariff quotas for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union and other related organizations and individuals.

Article 3.Commodities and import tariff quotas

The commodity codes and total tariff quotas in 2017, 2018 and 2019 of commodity groups entitled to the tariff quota under Article 1 of this Circular must comply with the Appendix to this Circular(not translated).

Article 4.Principles for application of in-quota import duty rate

Imports must have certificates of origin (C/O form EAV) provided by competent agencies of state members of the Eurasian Economic Union.

A Vietnamese trader may only import (direct import or entrusted import) unmanufactured tobacco if holding a license for import of unmanufactured tobacco under tariff quota granted by the Ministry of Industry and Trade in accordance with the Ministry’s Circular No. 04/2014/TT-BCT of January 27, 2014, detailing the implementation of a number of articles of the Government’s Decree No. 187/2013/ND-CP of November 20, 2013, detailing the implementation of the Commercial Law regarding international goods sale and purchase and goods sale, purchase, processing and transit agency activities with foreign countries. The quantity of imports shall be deducted from the import tariff quotas under the license issued by the Ministry of Industry and Trade.

Article 5.Import procedures

The procedures for import of unmanufactured tobacco and poultry eggs shall be cleared at border-gate customs offices which carry out import procedures on the principle of automatic reconciliation until the tariff quota for each commodity item specified in the Appendix to this Circular runs out.

Article 6.Import duty rates

The in-quota and out-of-quota import duty rates for unmanufactured tobacco and poultry eggs imported from member states of the Eurasian Economic Union must comply with regulations of the Government.

Article 7.Effect

This Circular takes effect from March 14, 2017, through December 31, 2019.-
