DECREE

Amending Clause 2, Article 12 of the Government’s Decree No. 03/2017/ND-CP of January 16, 2017, on casino business^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 17, 2020 Law on Investment;

Pursuant to the June 17, 2020 Law on Enterprises;

Pursuant to the June 22, 2015 Law on Promulgation of Legal Documents; and the June 18, 2022 Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;

Pursuant to the January 11, 2022 Law Amending and Supplementing a Number of Articles of the Law on Public Investment, the Law on Investment in the Form of Public-Private Partnership, the Law on Investment, the Housing Law, the Bidding Law, the Electricity Law, the Law on Enterprises, the Law on Excise Tax and the Law on Execution of Civil Judgments;

At the proposal of the Minister of Finance;

The Government promulgates the Decree amending Clause 2, Article 12 of the Government’s Decree No. 03/2017/ND-CP of January 16, 2017, on casino business.

Article 1. To amend Clause 2, Article 12 of the Government’s Decree No. 03/2017/ND-CP of January 16, 2017, on casino business

“2. Period of pilot permission

a/ For the first casino business that is permitted by a competent authority on a pilot basis to admit Vietnamese gamers, the period of pilot permission will last until December 31, 2024. For other casino businesses that are permitted by competent authorities on a pilot basis to admit Vietnamese gamers (if any), the period of pilot permission is 3 years after they are granted a certificate of eligibility for casino business.

b/ Upon the expiration of the period specified at Point a of this Clause, businesses shall cease the pilot permission for Vietnamese to play in casinos until the Government promulgates a decree on cessation or continuation of permission for Vietnamese to play in casinos under Point d of this Clause.

c/ The Ministry of Finance shall assume the prime responsibility for, and coordinate with the Ministry of Public Security; Ministry of Planning and Investment; Ministry of Culture, Sports and Tourism; State Bank of Vietnam, and provincial-level People’s Committees of localities where businesses are permitted to admit on a pilot basis Vietnamese gamers in, summarizing, evaluating and reporting to the Government for subsequent reporting to competent authorities for consideration and decision on cessation or continuation of permission for Vietnamese to play in casinos:

Before November 30, 2024, for the first casino business that is permitted by a competent authority on a pilot basis to admit Vietnamese gamers; or,

Within 60 days by the date of cessation of the pilot permission, for other casino businesses that are permitted by competent authorities (if any).

d/ Based on the competent authority’s decision, the Government shall promulgate a Decree on cessation or continuation of permission for Vietnamese to play in casinos, for businesses eligible for pilot permission.”

Article 2. Implementation provisions

1. This Decree takes effect on November 4, 2024.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and related organizations and individuals shall implement this Decree.-
