TO PUBLICIZE THE CONDOMINIUM PROJECTS LIST THAT FAIL TO COMPLY WITH THE FIRE PREVENTION
 

To ensure the fire prevention and fighting for condominium is one of the requested of the Prime Minister at the Directive No. 29/CT-TTg dated October 09, 2018 on raising the effectiveness of the State management of the management, operation and use of condominiums.

Accordingly, the Prime Minister requests the Ministry of Public Security to publicize on its portal the list of condominium projects that fail to comply with the fire prevention and fighting regulations or fail to purchase compulsory fire and explosion insurance.

With regards to organization and individuals that committing serious violations in the management, use and operation of condominiums, particularly acts of illegally appropriating

 

and using funds for maintenance of areas under common ownership for improper purposes, the Ministry of Public Security should investigate, prosecute and prosecute.

For the locals, provincial-level People’s Committees should organize fire prevention and fighting training and drills for condominium residents; regularly examine and inspect establishments with high risk of fire in their localities, particularly highly populated high-rise condominiums.

Besides, provincial-level People’s Committees also need to promulgate brackets of condominium operation management service charges under the housing law; step up the grant of certificates of land use rights and ownership of houses and land-attached assets to eligible purchasers…

USED INFORMATION TECHNOLOGY PRODUCTS PROHIBITED FROM IMPORT
 

The Ministry of Information and Communications issues the Circular No. 11/2018/TT-BTTTT on detailing List of used information technology products prohibited from import with their HS codes on October 15, 2018.

Accordingly, the List of used information technology products prohibited from import includes:

- Printing machinery used for printing by means of plates, cylinders and other printing components of heading 84.42; other printers, copying machines and facsimile machines, whether or not combined; parts and accessories thereof: Group 8443;

- Telephone sets, including telephones for cellular networks or for other wireless networks; other apparatus for the

 

transmission or reception of voice, images or other data, including apparatus for communication in a wired or wireless network (such as a local or wide area network), other than transmission or reception apparatus of other headings 84.43, 85.25, 85.27 or 85.28: Group 85.17;

- Insulated (including enamelled or anodized) wire, cable (including co-axial cable) and other insulated electric conductors, whether or not fitted with connectors; optical fibre cables, made up of individually sheathed fibres, whether or not assembled with electric conductors or fitted with connectors: Group 85.44…

This Circular takes effect on November 30, 2018.


TO SHORTEN THE TIME OF GRANTING DIGITAL SIGNATURE CERTIFICATION

 

This is the highlight content of the Decree No. 130/2018/ND-CP dated September 27, 2018 of the Government on detailing the Law on E-Transactions regarding digital signatures and digital signature certification services.

In accordance to this new Decree, the time of granting digital signature certification shall be shortened to 50 days after receiving a valid dossier of application for a license, instead of 60 days as before.

A public digital signature certification authority may provide digital signature certification services when meeting the following conditions:
 

- Possessing a license for provision of public digital signature certification services granted by the Ministry of Information and Communications.

- Possessing a digital certificate issued by the National Digital Signature Certification Authority.

Concurrently, the Government has unanimously upheld the license granted to a public digital signature certification authority is valid for 10 years. A digital certificate issued to public digital signature certification authorities is valid for 05 years.

This Decree takes effect on November 15, 2018.

STRIKE TO 2019, THE PERCENTAGE OF POPULATION COVERED BY HEALTH INSURANCE UP TO 88.1%
 

The Resolution No. 69/2018/QH14 on the 2019 socio-economic development plan has been approved on November 08, 2018 by the National Assembly.

The main criteria have been pointed out by the National Assembly are: Gross domestic product growth rate up to 6.6-6.8%; Consumer price index up to around 4%; Total export turnover growth rate up to 7-8%; Unemployment rate in urban areas under 4%; Number of patient beds per 10,000 people (excluding beds in commune health stations) up to 27; Percentage of population covered by health insurance up to 88.1%

Specific tasks and solutions to archive those objectives are:

 

- Synchronously developing the system of infrastructure facilities, particularly traffic and information technology infrastructure; accelerating the implementation of the eastern North-South expressway project, Long Thanh international airport and other strategic transport and industrial infrastructure projects;

- Quickly increasing the coverage of social insurance, health insurance and unemployment insurance; resolutely handling violations of the regulations on social insurance, health insurance and unemployment insurance


THE GOVERNMENT: TO AVOID MONOPOLY STATUS OF TEXTBOOKS
 

This is the content prescribed at the Resolution No. 124/NQ-CP of the Government on the Governments regular meeting - September 2018.

Due to many opinions of the public about the status of textbooks, the Government assigns the Ministry of Education and Training to intensify the inspection and examination of the publication of textbooks and avoid monopoly status; urgently expose and finalize the revised Law on Education and submit it to the National Assembly at the 6th session.

Teacher staffing is also an issue mentioned by the Government in this meeting. Specifically, the Government requires localities to re-arrange teacher payrolls to transfer teachers from units with staff surplus to unit shortage of

 

staff with a view to streamline staff and reduce the number of public non-business units to ensure the sufficient number of teachers, prevent shortage of teachers, which could affect the study of students.

Also in accordance with this Resolution, the Government identifies the socio-economic situation in the first nine months of the year has many positive signals. Within that, gross domestic products was estimated to reach 6.98%, the highest rate compared to the same period in the previous seven years; exports increased by 15.4% compared to the same period last year; State budget revenues increased by 13.7%; the ratio of public debt to GDP decreased…

This Resolution is issued on October 06, 2018.


WITHDRAWAL OF IMPROPER RECEIVED SUBSIDIES FOR PEOPLE WITH MERITORIOUS SERVICES
 

On September 09, 2018, the Government issues the Resolution No. 119/NQ-CP on the Government’s regular meeting - August 2018 in which states the handling of subsidy allowances for people with meritorious services, who received their allowances in contravention of regulations.

To be specific, The Government assigns the provincial-level People's Committee Chairmen to recover the subsidy allowances in contravention of regulations and remit them into the State budget; however, the subsidy allowances for dead people with meritorious services to the Revolution, who received their allowance in contravention of regulations shall not be recovered. It was requested to review the responsibilities of organizations, units and individuals for their mistakes and strictly handle them according to the provisions of law.

 

The promulgation progress of documents to streamline business conditions and specialized examination procedures also be emphasized in this Resolution. Accordingly, the Government requires the specialized ministries to promptly finalize related documents, not to generate any additional administrative procedures. The Ministry of Justice shall strictly control the formulation and promulgation of those ministries.

Regarding the draft Decree prescribing the use of public assets for payment to investors when implementing Build- Transfer (BT) investment projects or construction of works, the Government requests that the Ministry of Finance shall promptly handling legal gaps so as not to affect ongoing projects in the time that Decree has not yet been promulgated and has not yet takes effect.

ORGANIZATIONAL STRUCTURE OF THE GENERAL DEPARTMENT OF TAXATION
 

The Prime Minister issues the Decision No. 41/2018/QD-TTg on defining the functions, tasks, powers and organizational structure of the General Department of Taxation under the Ministry of Finance on September 25, 2018.

The General Department of Taxation is an organization under the Ministry of Finance; has the legal entity status, a seal bearing the national emblem, State Treasury accounts. Accordingly, the General Department of Taxation is organized into a hierarchical system from the central to local level:

1. The General Department of Taxation at the central level:

- The Policy Department;

- The Legal Affairs Department;

- The Department for Tax Revenue Estimation;

- The Department for Propagation and Taxpayer Assistance…

 

2. Local Tax Departments include: Tax Departments in provinces and centrally run cities; Tax Departments of rural districts, urban districts, towns and provincial cities; regional Tax Departments are directly attached to provincial-level Tax Departments.

Within that, Hanoi Tax Department and Ho Chi Minh City Tax Department each may have at most 11 divisions performing the advisory function and tax administration function and at most 10 examination-inspection divisions.

A provincial-level Tax Department having an amount of tax collections of VND 2,500 billion or more per year (excluding collections from land and crude oil) may have at most 09 divisions performing the advisory function and tax administration function and at most 05 examination-inspection divisions…

This Decision takes effect on November 15, 2018.
