Ü LABOR - SALARY


TO INCREASE THE SUBSIDIES FOR PEOPLE WITH MERITORIOUS SERVICE
TO THE REVOLUTION FROM JULY 01
 

On July 12, 2018, the Government issues the Decree No. 99/2018/ND-CP on prescribing levels of subsidies and preferential allowances for people with meritorious service to the revolution.

Accordingly, from July 01, 2018, the standard level for determination of subsidies and preferential allowances for people with meritorious service to the revolution specified in this Decree is VND 1,515,000, instead of VND 1,417,000 as before.

 

Therefore, death subsidies for relatives of war martyrs is VND 1,515,000; for Armed Force heroes and heroines; labor heroes and heroines is VND 1,270,000; the subsidies for diseased army men is from VND 1,581,000 to VND 3,859,000 depends on the declining working capacity; the preferential allowances for diseased army men with working capacity loss of 80% or higher is from VND 760,000 to VND 1,515,000 per month.

This Decree takes effect on August 27, 2018.

TO MAKE HEALTH DECLARATION WHEN TRANSFER CORPSES, BONES ACROSS BORDER
 

On June 25, 2018, the Government issues the Decree No. 89/2018/ND-CP guiding the implementation of the law on infectious disease prevention and control regarding border health quarantine.

This Decree requires making health declaration when transport corpses, bones (including body ash), microorganism sample, biological products, tissues and human body organs across the border between Vietnam and other countries. The corpse or bones of a person with any group-A infectious diseases is not allowed to be transported through the border. The microorganism sample concerning human medical specimens is not allowed to be imported if the permit to import human medical specimens is not available.

 

Inspection of documents is made with every corpse, bones transported through the border. Documents to be inspected include: The health quarantine declaration of corpse, bones (including body ash); The certificate of health control measures implemented at the place of departure; The permit for corpse, bones to enter Vietnam; Documents proving death (for corpse, bones).

Each inspection of documents of corpse, bones must be completed within a maximum period of 15 minutes. For a physical inspection of corpse, bones, must be completed within a maximum period of 01 hour from the submission of sufficient documents.

This Decree takes effect on August 10, 2018.

LAW ON COMPETITION 2018
 

Law No.  23/2018/QH14 on Competition is passed on June 12, 2018 by the National Assembly, takes effect on July 01, 2019.

This Law removes the limitation of economic concentration. Specifically, instead of prohibiting economic concentration if the combined market shares of enterprises participating in economic concentration account for over 50% on the relevant market, this Law only prohibits economic concentration if it causes or probably cause substantial anti-competitive effects on the Vietnamese market.

 

Concurrently, this Law also prescribes about fines imposed on violations of competition law. Within that, the maximum fine for violations of economic concentration regulations shall be 5% of the total turnover of violating enterprises on the relevant market in the fiscal year preceding the year of violation; the maximum fine for violations of regulations on unfair competition shall be VND 02 billion; the maximum fine for other violations of this Law shall be VND 200 million…

This Law replaces the Competition Law 2004.

SEND SHIP FUEL OIL CONSUMPTION DATA REPORT

The Circular No. 40/2018/TT-BGTVT on providing for data collection and reporting on fuel oil consumption of Vietnamese-flagged ships is issued on June 29, 2018 by the Ministry of Transport.

As from the calendar year 2019 onwards, ship-owners are required to collect and submit reports on ship fuel oil consumption data in the calendar year via the Vietnam Register’s portal (www.vr.org.vn) by February 28 of the following year.

In case of change in ship-owner, the existing ship-owner is required to collect and submit report on the ship fuel oil

 

consumption data for the period of calendar year during which the ship is still under the ownership of that ship-owner.

In additionally, shipmasters are responsible to keep documents and evidences of the ship fuel oil consumption for a minimum period of 03 years in order to serve the inspection and control by regulatory authorities as regulated.

This Circular takes effect on August 15, 2018.

LAW ON AMENDING PHYSICAL TRAINING AND SPORTS 2018
 

The most noticeable content is the provision: Organize illegal sports betting or participate in illegal sports betting is not allowed. Concurrently, annul the condition “having financial sources for business activities” with sports enterprises. Certificate of eligibility for sports business shall be granted by the People's Committee of province within 07 working days from the date on which the valid and complete application is received.

In additionally, for the first time this Law has provision on sports betting. Accordingly, sports betting is a form of entertainment with rewards in which participants predict the result of sporting events used for betting purpose.

Sports betting must meet the following rules:
 

- Sports betting business is a conditional business activity under the strict control of competent regulatory bodies;

- Sports betting companies are permitted to operate only after obtaining certificate of eligibility for sports betting;

- Betting business activities must be conduct in a transparent, objective and honest manner and protect rights and legitimate interests of involved parties;

- The Vietnamese dong is the currency used for sports betting and rewards.

This Law takes effect on January 01, 2019.

BETWEEN THE STATE’S AGENCIES
 

The sending and receipt of e-documents between agencies in the State administrative system is prescribed by the Prime Minister at the Decision No. 28/2018/QD-TTg dated July 12, 2018.

This Decision provides some rules about sending and receipt of e-documents between agencies in the State administrative system, conclude:

- All e-documents falling under the issuing and settling competence of agencies in the State administrative system shall be sent and received via document management and administration systems, except the case the recipients do not meet the requirement on technological infrastructure.

 

- Agencies in the state administrative system shall issue no paper documents to recipients after having sent e-documents to them, except documents to be sent to the Government or Prime Minister and documents on lists decided by ministers, heads of sectors or localities.

- Recipients may refuse to receive e-documents which do not satisfy the principles and requirements on sending and receipt and shall take responsibility for their refusal.

This Decision also prescribes: Every e-document shall be sent right on the day when it is signed for issuance or in the morning of the subsequent working day.

This Decision takes effect on September 06, 2018.
