THE RESIDENTIAL LAND PRICE HIGHER NOT MORE THAN 30%
OF THE SAME TYPE OF LAND
 

On May 15, 2014, the Government issued the Decree No. 44/2014/ND-CP on land prices, within that every type of land shall apply its corresponding land price bracket under the regulations.

With regard to residential land in urban areas, commercial land in urban areas, the non-agricultural land other than commercial land in urban areas which are profitable and suitable to be used as business premises, the People’s Committee of the province shall impose a higher price but not more than 30% of the maximum price of the same type of land in the land price bracket depending on the local market. If the land price imposed is higher than 30%, it is required to send a report to the Ministry of Natural Resources and Environment for consideration.

 

 

With regard to the agricultural land in residential areas or administrative boundaries of wards, the People’s Committee of provinces shall impose a higher price but not more than 50% in comparison with the maximum price of the same type of land in the land price bracket.

The land price list shall be adjusted in the cases that the land price bracket adjusted by the Government increased by 20% or more in comparison with the maximum land price or decreases by 20% or more in comparison with the minimum land price in the land price list of the similar land. And the common market price of land increases by 20% or more in comparison with the maximum land price or decreases by 20% or more in comparison with the minimum land price in the land price list after 180 days.

This Decree takes effect on July 01, 2014.

MINIMUM TRAINING DURATION IS THREE HOURS/QUARTER FOR STAFF
OF CREDIT INSTITUTIONS PERFORMING INSURANCE AGENCY ACTIVITIES
 

This is the content prescribed at the Joint Circular No. 86/2014/TTLT-BTC-NHNNVN dated July 02, 2014 of the Ministry of Finance and the State Bank of Vietnam guiding operation of insurance agents of credit institutions, foreign banks’ branches for life insurance enterprises.

Accordingly, enterprises of credit institutions, foreign banks’ branches must be permitted for performing insurance agency activities as specified in the establishment and operation license; sign insurance agency contract with life insurance enterprises; Staff performing insurance agency activities of credit institutions and foreign banks’ branches must be trained and granted the insurance agency certificate.

Also in accordance with this Circular, life insurance enterprise must set up the training program, coordinating

 

with credit institutions, foreign banks’ branches to organize the training and being responsible for granting insurance agency certificate for staff of credit institutions, foreign banks’ branches directly performing insurance agency activities. Life insurance enterprise, credit institutions, foreign banks’ branches agree and select the forms of training for basic training program, including online training, continuous training or other forms according to the law. For the product training program, form of training is continuous, excluding products under the term insurance professions. Minimum duration for training is four hours for one insurance product and 16 hours for insurance products of investment linked products. And minimum duration for quarterly training for staff of credit institutions, foreign banks’ branches selling linked insurance is three hours.

This Circular takes effect on September 01, 2014.

NEW REGULATIONS ON EVALUATING STRATEGIC ENVIRONMENT
 

On April 29, 2014, the Government issued the Decree No. 35/2014/ND-CP amending and supplementing some articles of the Decree No. 29/2011/ND-CP dated April 18, 2011 of the Government providing strategic environmental assessment, environmental impact assessment and environmental protection commitment.

The concentrated areas of production, business, services or the facilities of production, business and services by June 5, 2011 have come into operation but have no decision on approving the report on environmental impact assessment, decision on approving the additional report on environmental impact assessment, the registration of

 

environmental standards, and commitment to environmental protection. In addition to the handling of violation as stipulated by the law, before December 31, 2014 one of two remedial measures of violations must formulate the detailed environmental protection scheme for the facilities with their scale and nature equivalent to the subjects that have to prepare the report on environmental impact assessment  and the simple environmental protection scheme for the facilities with their scale and nature equivalent to the subjects that have to register the commitment to environmental protection .

This Decree takes effect on June 15, 2014.

THE MASTER PLAN ON SOLID WASTE DISPOSAL OF HANOI CAPITAL
 

With the planning to project the total volume of generated solid waste and solid waste disposal demands, to determine modes of solid waste collection, transportation and disposal; to identify locations and sizes of solid waste transfer stations and disposal complexes in Hanoi capital; provide a basis for the implementation of investment projects to build, upgrade, improve or expand the collection and transportation systems and solid waste transfer stations and disposal complexes in Hanoi capital..on April 25, 2014, the Prime Minister signed the Decision No. 609/QD-TTg approving the master plan on solid waste disposal of Hanoi Capital to 2030, with a vision to 2050.

Scope of study and planning is the entire administrative territory of Hanoi capital with a total area of 3,344.6 km2. Based on current standards and regulations, a number of basic planning targets as: solid waste collection targets for daily-life solid waste: The collection rate will reach 85-100%

 

in urban areas and 70-80% in rural areas in 2020; The collection rate will reach 90-100% in urban areas and 80-95% in rural areas in 2030, for construction solid waste: the collection rate will reach 80-100% in urban areas and 60-80% in rural areas in 2020 and the collection rate will reach 85-100% in urban areas and 70-90% in rural areas in 2030..for the medical solid waste:  the collection rate will reach 100%, including around 20% for hazardous solid waste and around 80% for ordinary solid waste.

The total capital needed for the solid waste planning of Hanoi capital to 2030, with a vision to 2050, is estimated at around VND 11 trillion, including around VND 3.5 trillion in construction costs to 2020, ensured by the State budget funds; ODA loans, foreign capital; Investment credit capital; domestic commercial loans.

This Decision takes effect on the signing date.

OFFICE OF A PROVINCIAL-LEVEL PEOPLE’S COMMITTEE MUST HAVE A PORTAL
 

In accordance with the Decree No. 24/2014/ND-CP providing the organization of specialized agencies under People’s Committees of provinces or centrally run cities, the organizational structure of a provincial-level department consists of the Office; the Inspectorate; specialized divisions; branches and public non-business units. Within that, provincial-level departments do not necessarily have all the organizations. Particularly, the Office of a provincial-level People’s Committee must have a portal.

Besides, the Decree also details the conditions to establish the Foreign Affairs Departments and Ethnic Affairs Committees. The Foreign Affairs Departments shall advise and assist provincial-level People’s Committees in performing the state management of foreign affairs and national border and territory affairs (for provinces having borders). A Foreign Affairs Department shall be established when having land borderlines and international or national border gates, a province having no land borderlines when having an industrial park, an export-processing zone, a hi-

 

tech park, an open economic zone or a border-gate economic zone established under the Prime Minister’s decision and having a national tourist zone or cultural heritage recognized by the UNESCO.

The Ethnic Affairs Committees shall advise and assist provincial-level People’s Committees in performing the state management of ethnic affairs. An Ethnic Affairs Committee shall be established in a province or centrally run city when meeting 2 out of 3 criteria as having over 20,000 (twenty thousand) ethnic minority people who live in village or hamlet communities; having over 5,000 (five thousand) ethnic minority people who need the State’s assistance and support for development and having ethnic minority people who live in important security and defense areas; areas in which ethnic minority people simultaneously live and conduct cultivation; or border areas which ethnic minority people of Vietnam and neighboring countries regularly visit.

This Decree takes effect on May 20, 2014.
