IN 2017. THE SUGAR IMPORT QUANTITY FOR AUCTION TARIFF QUOTAS
IS 89,500 TONS
 

The Ministry of Industry and Trade issued the Circular No. 05/2017/TT-BCT dated April 21, 2017 prescribing the auction of import tariff quota for sugar in 2017; applicable to traders that directly use sugar as an input material for production and traders that manufacture coarse sugar for refining.

Accordingly, the sugar import quantity (HS Code 1701) put for auction under the 2017 tariff quotas is 89,500 tons.

 

The import tariff quota for sugar in 2017 shall be auctioned through the council for pilot auction of import tariff quota for sugar in 2017. The principles, order and procedures for property auction must comply with the law on auction suitable to the characteristics of property put up for auction.

This Circular takes effect from June 5, 2017, through December 31, 2017.

THE WAGE OF THE EMPLOYEES OF COMMUNITY-BASED PROJECTS
 

This is the important content prescribed at the Circular No. 11/2017/TT-BLDTBXH issued by the Ministry of Labor, War Invalids and Social Affairs guiding the implementation of Decree No. 61/2015/ND-CP on job creation policies and national employment fund in terms of temporary employment policy.

In particular, Employees’ wage is paid according to the agreement with employees of community-based projects and based on their actual working time, work quality and volume. If the employee works 8 hours a day and 26 days a month, the wage shall be paid on a monthly basis and shall not be lower than the regional minimum wage paid those working in the place where the projects or operations are being carried out; if an employee works less than 8 hours a day or 26 days a month, the wage shall be paid on an hourly basis and shall not be lower than the regional minimum wage paid those working in the place where the

 

projects or operations are being carried out; in case the employee works overtime, the wage shall be paid on an hourly basis for overtime working.

On the working time and rest time of the employees of community-based projects, the organization and arrangement of working time and rest time shall be approved by the employees of community-based projects but comply with the regulations such as the working time must not exceed 8 hours a day; the employee must have at least 1 day off (24 consecutive hours) every week. In special cases, the employee is not able to take weekly rest due to the work cycle, the employee may take monthly rest on the basis of at least 04 days per month and in case the employee has to work overtime, the sum of normal working hours and overtime working hours must not exceed 12 hours a day.

This Circular takes effect on June 15, 2017.

12 LAWFUL PAPERS ON LAND FOR GRANT OF CONSTRUCTION PERMITS
 

At the Decree No. 53/2017/ND-CP dated May 08, 2017, the Government specifying lawful papers on land for grant of construction permits.

Within 12 lawful papers on land for grant of construction permits, the most important permits are Land use rights certificate granted in accordance with the 1987 Land Law, the 1993 Land Law, the 2001 Law Amending and Supplementing a Number of Articles of the Land Law or the 2003 Land Law; Certificate of land use rights and ownership of houses and land-attached assets granted under the 2013 Land Law and Law No. 38/2009/QH12 Amending and Supplementing a Number of Articles of the Laws concerning Capital Construction Investment; papers on land, for land areas allocated or leased by the State or having their use purposes changed after July 1, 2004, but for which certificates of land use rights and ownership of houses and other land-attached assets have not yet been granted in accordance with the land law, including the

 

competent state agency’s land allocation decisions, the competent state agency’s land lease decisions enclosed with land lease contracts (if any), papers on winning of auction of land use rights or bidding for land-using projects, or the competent state agency’s decisions on permission for land use purpose change….

Land rent contract between the project owner and manager or user of a traffic work or written approval by the competent state management agency in charge of transport of a work allowed to be built in the land area reserved for transport. Land use rights certificate or written approval of construction location granted by district-level People’s Committees, for construction of billboards, telecommunications stations and antenna posts in areas not categorized as land used for construction and ineligible for land use purpose change.

This Decree takes effect on June 25, 2017.

TO SUPPLEMENT THE LIST OF HIGH TECHNOLOGIES PRIORITIZED
FOR DEVELOPMENT INVESTMENT
 

On April 28, 2017, the Prime Minister issued the Decision No. 13/2017/QD-TTg on amending and supplementing the list of high technologies prioritized for development investment and the list of hi-tech products eligible for development promotion promulgated together with the Prime Minister’s Decision No. 66/2014/QD-TTg of November 25, 2014.

At the Decision, the Prime Minister supplements the list of high technologies prioritized for development investment and the list of hi-tech products, including: Internet of Things (IoT) technology; Virtual Reality technology; Augmented Reality technology; Smart television technology; Three-dimensional (3D) printing technology.

At the same time, to supplement 16 products to the list of hi-tech products eligible for development

 

promotion as follows: IoT module, equipment, software and solution; Software, equipment, solution and service of virtualization and cloud computing; Software, equipment, solution and service for e-government, e-enterprise, e-commerce, e-training and e-advertisement; Software, equipment, solution and service of virtual reality and augmented reality; Software, equipment and solution of smart television; Software, equipment, solution and service of automatic software testing; Information technology consultancy and designing service; Service of integrating information technology system; Service of administering information technology system; Service of leasing information technology system; Big data processing, analysis and exploitation service…

This Decision takes effect on June 15, 2017.

MUST HAVE CONSENT WHEN PUBLISHING PRIVATE INFORMATION OF A CHILD IF HE/SHE
IS FULL 7 YEARS OR OLDER
 

Takes effect July 01, 2017, the Decree No. 56/2017/ND-CP detailing a number of articles of the Law on Children, prescribing that when publishing private information of a child on a network, a provider of services in the Internet environment or a person shall obtain the consent of the child’s parent(s) or caregiver and the child himself/herself if he/she is full 7 years or older; and shall ensure information safety for the child.

Besides, the Decree also requires that enterprises providing services in the Internet environment shall give warnings or remove information and services that are harmful to children, and fake information and services that infringe upon the lawful rights and interests of children; providers of video games in the Internet environment must have tools for controlling playing time and for protecting children from being abused or addicted to video games; organizations, enterprises and individuals operating or providing services in the Internet environment shall develop or use and widely disseminate software and tools for protecting children in the Internet environment.

 

On health care policies, the State shall pay, or support the payment of, health insurance premiums for disadvantaged children in accordance with the law on health insurance; the State shall pay, or support the payment of, medical examination and treatment or medical assessment expenses for disadvantaged children.

Also in accordance with this Decree, the Ministry of Labor, War Invalids and Social Affairs shall manage the child protection services via telephone numbers; The National Telephone Exchange for Child Protection shall operate round the clock and be provided by the State with resources for its operation; the National Telephone Exchange for Child Protection may use 3-digit telephone numbers and does not collect telecommunications and counseling charges for incoming calls; the National Telephone Exchange for Child Protection may receive financial and technical assistance from agencies, organizations and individuals; and advertise its telephone numbers and services…
