On April 28, 2017, the Ministry of Finance issued the Circular No. 40/2017/TT-BTC on work-trip allowances and conference expenditures. Accordingly, stay allowances mean amounts paid by agencies or units to their staff on work trips in addition to their salaries for a period from the date they begin until they finish their work trips and return to their agencies or units (including time of journey and stay in work-trip destinations). Stay allowance payable to a person on work trip: VND 200,000/day. Officials, public employees and contractual employees working on the mainland who are sent on work trips at sea or on islands are entitled to the maximum stay allowance of VND 250,000/person/day of actual work trip (applicable to days during which they work at sea or on islands and travel days at sea or to and from islands). Also in accordance with this Circular, officials, public employees and contractual employees who are sent by their agencies or units to work trips and must rent lodgings |
in work-trip destinations are entitled to payment of such lodging rents by adopting any of two following methods: payment of fixed allowance or invoice-based payment; persons on work trips to agencies or units that have arranged free lodgings are not entitled to payment of lodging rents. For commune-level officials and officials of other agencies or units who have to regularly go on work trips for over 10 days a month (such as correspondence clerks, accountants, forest rangers, officers of procedural agencies who conduct investigation, procuracy or verification or send legal notices and other duties), heads of agencies or units shall, depending on entities, task characteristics and financial capacity, set the fixed level of monthly work-trip allowance to support these officials in covering car-parking and fuel expenses, which must not exceed VND 500,000/person/month and shall be included in their internal spending regulations. This Circular takes effect on July 01, 2017. |

On May 31, 2017, the Ministry of Transport issued the Circular No. 17/2017/TT-BGTVT on requirements for foreign seafarers working onboard Vietnamese-flagged ships. Accordingly, foreign seafarers working onboard Vietnamese-flagged ships must satisfy all the general requirements, a foreign seafarer must meet all standards of seafarer’s health and working age under prevailing regulations; possess a working permit granted by a competent authority of Vietnam; have a seafarer’s employee agreement signed; have a passport issued by the competent authority of the seafarer’s State of nationality; have his name specified in the register of seafarers; be assigned to hold a position onboard a ship. Besides, foreign seafarers must satisfy the professional requirements, in particular: A foreign seafarer |
working onboard a Vietnamese-flagged ship must possess a Certificate of professional competence issued by the competent authority of Vietnam or of the State or the territory that has entered into an agreement with Vietnam on recognition of certificates of professional competence issued by the competent authority of such State or territory. If a foreign seafarer possesses a Certificate of professional competence issued by the competent authority of the State or the territory that has entered into an agreement with Vietnam on recognition of certificates of professional competence issued by the competent authority of such State or territory, he must obtain an endorsement attesting the recognition of Certificate of professional competence. This Circular takes effect on July 15, 2017 and replaces the Decision No. 47/2005/QD-BGTVT dated September 23, 2005. |

On June 02, 2017, the Ministry of Finance issued the Circular No. 57/2017/TT-BTC amending and supplementing a number of articles under the Circular No. 11/2014/TT-BTC dated January 17, 2014 of the Ministry of Finance guiding some articles of the Decree No. 86/2013/ND-CP of July 29, 2013, on the business of prize-winning electronic games for foreigners. The important content in this Circular is to annul the technical conditions for prize-winning electronic game machines. In previous regulations, the Circular 11/2014/TT-BTC prescribes strict regulations on technical characteristics of hardware, software, peripherals of the technical conditions for prize-winning electronic game machines. Besides, this Circular also requires that an enterprise engaged in the business of prize-winning electronic games shall arrange business establishment in prize-winning |
electronic games, enterprises must have electronic equipment and cameras for constant monitoring and surveillance of all activities in the facility (24/24h), in which enterprises must ensure for monitoring. Images at positions specified at Clause 2 this Article must be fully stored in the minimum duration of thirty (30) days from the day of recording. In necessary case, time of storage may be prolonged at the request of competent state management agencies. For fee for grant, re-grant, adjustment and extension of eligibility certificate for business, this Circular prescribes that the fees for grant is VND 150 million and the fee for re-grant and adjustment is VND 20 million. All these fees for grant, re-grant, adjustment and extension of eligibility certificate for the business are revenues of state budget. This Circular takes effect on July 17, 2017. |

On June 06, 2017, the State Bank of Vietnam issued the Circular No. 03/2017/TT-NHNN amending and supplementing a number of articles of the Circular No. 16/2012/TT-NHNN of May 25, 2012, guiding a number of articles of the Government’s Decree No. 24/2012/ND-CP of April 3, 2012, on management of gold business activities. In accordance with this Circular, for an enterprise, a dossier of application for a gold bar trading license comprises an application for a gold bar trading license; list of business |
places registered as places selling and purchasing gold bar (head offices, branches, business places); operation registration certificates, operation registration certificates; the tax office’s certification of the tax amounts paid for gold trading activities in 2 (two) latest consecutive years. Therefore, enterprises shall not submit the audit financial statement of 2 latest consecutive years when making the dossier of application for gold bar trading. This Circular takes effect on July 22, 2017. |

In accordance with the Circular No. 03/2017/TT-BLDTBXH dated March 01, 2017 of the Ministry of Labor, War Invalids and Social Affairs prescribing the procedures for design, evaluation and issuance of the training programs; writing, selection and evaluation of the training materials for intermediate- and college-level vocational education, from April 14, 2017, At least once every 3 years, the School Rector shall decide to establish the Educational Board performing the function of re-assessing the issued training program in order to keep it updated with and adaptable to any change in applicable laws and regulations or new scientific or technological advancements in the relevant industry or occupation sector… The training program must provide the curriculum that conforms to regulatory requirements concerning the minimum knowledge volume and competency that students may attain upon completion of their respective training industries or occupation at the college- and intermediate-level training level. The training program must define the |
framework and time length of specific subjects and modules relative to relevant training approaches, theory, practice or internship training time length. The training program must ensure transition between training levels in the national education system…. On academic year-based course time length, the college-level vocational education course takes 2-3 academic years and must provide at least 60 credits as a requirement concerning a volume of knowledge acquired in each training industry or occupation. The intermediate-level vocational education course takes 1-2 academic year(s) and must provide at least 35 credits or 50 credits as a requirement concerning a volume of knowledge that a student holding the upper secondary education diploma or a student holding the lower secondary education diploma, respectively, may acquire in each training industry or occupation. This Circular takes effect on April 14, 2017. |
