Takes effect on June 01, 2017, the Decree No. 43/2017/ND-CP dated April 04, 2017 of the Government on good labels, prescribing that manufacturers and traders of goods in Vietnam; importers of goods must present good labels, exempt for real property; goods temporarily imported for re-export; goods temporarily imported for re-export after participation in fairs or exhibitions; goods in transit, goods involved in merchant trade transactions; transshipped goods; gifts, presents; baggage of incoming/outgoing passengers; personal belongings; confiscated goods for auction purpose; goods being fresh, raw food, processed food without packaging and sold directly to consumers… Within that, the mandatory information shown on a label includes name of good; name and address of entity responsible for the good; origin of good. In particular, for food, the mandatory information includes food quantity; date of manufacture; expiry date; warnings (if any); liquor quantity; ethanol content; expiry date (if any); instructions |
for storage (for wines); warnings (if any); lot number (if any); for cigarettes, the mandatory information includes quantity; date of manufacture; warnings; expiry date; codes, bar codes…. If the good imported into Vietnam of which the label has not represented or represented insufficiently mandatory information in Vietnamese, a supplementary label containing mandatory information in Vietnamese is required and the original label shall remain unchanged. The Vietnamese content shall be consistent with the original label text. The supplementary label shall used for goods not eligible for import or to be returned and circulated in the domestic market, a bold phrase of “Made in Vietnam” shall be required. Those labels and commercial containers attached to labels that have been produced or printed before June 01, 2017 shall keep being used to June 01, 2019. |

In accordance with the Circular No. 01/2017/TT-BXD dated February 06, 2017 guiding the determination and management of construction survey costs, project owners shall assume the prime responsibility for ensuring quality of construction surveys and managing construction survey costs. Within that, construction survey costs shall be correctly and fully calculated for each project or work and in conformity with stages of the construction investment process, designing steps, types of construction surveys, grades of works, and relevant regulations. Project owners may hire |
organizations and individuals that fully satisfy the capacity conditions to make and verify construction survey tasks, unit prices and estimates. Also in accordance with this Circular, the cost of formulation of construction survey tasks must equal 3% of the estimated construction survey cost. The cost of survey supervision shall be determined with the limits in percentage (%) promulgated by the Ministry of Construction. This Circular takes effect on April 01, 2017. |

Takes effect on April 15, 2017, the Decree No. 22/2017/ND-CP dated February 24, 2017 of the Government on commercial mediation prescribing that a commercial mediator must possess a university or higher degree and having at least 2 years’ working experience in the discipline he/she has studied; have full civil act capacity as prescribed by the Civil Code; having good moral qualities and prestige, and working in an independent, impartial and objective manner; have mediation skills and knowledge about law, business and commercial practices and relevant issues. The accused or defendants or those who are serving criminal sentences or have not had their criminal records expunged or are serving the administrative measure of consignment to a compulsory education institution or compulsory detoxification establishment may not act as commercial mediators. |
Another important content is on the registration of operation of commercial mediation centers, accordingly, within 30 days from the effective date of the decision on grant of its establishment license, a commercial mediation center shall send a dossier for operation registration to the provincial-level Department of Justice of the locality where its head office is located. Past this time limit, if the center fails to register its operation, its establishment license shall be invalidated, unless it has a plausible reason. At the same time. within 30 days after being granted an operation registration certificate, a commercial mediation center shall publish in 3 consecutive issues of a central daily or a newspaper of the locality where it registers its operation… |

In accordance with the Decree No. 17/2017/ND-CP dated February 17, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications, from February 17, 2017, the Ministry of Information and Communications has 28 attached units instead of 29 attached units in previous regulations. In particular, the new units include the Grassroots Information Authority; the Vietnamnet electronic newspaper; The Post and Telecommunications Technology Institute; The Information and Communications Journal…the old units include The Information Center; The Central Post Department; The Information Technology Application Authority; The Information Security Authority… |
Within that, the Planning and Finance Department may have 4 divisions; the Legal Affairs Department, 1 division; the Ministry’s Inpectorate, 6 divisions; the Ministry’s Office, 5 divisions; the Press Authority, 5 divisions; the Broadcasting and Electronic Information Authority, 6 divisions; the Publishing, Printing and Distribution Authority, 6 divisions; the Grassroots Information Authority, 5 divisions; the Foreign Information Service Authority, 5 divisions; the Telecommunications Authority, 10 divisions; the Radio Frequency Authority, 9 divisions; the Information Technology Application Authority, 8 divisions; the Information Security Authority, 5 divisions; and the Central Post Department, 7 divisions.. This Decree takes effect on the signing date. |

This is the content prescribed at the Decree No. 15/2017/ND-CP of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development and takes effect on February 17, 2017. In particular, beside units in the previous regulations such as the Department of Crop Production; the Plant Protection Department; the Department of Livestock Husbandry; Vietnam Administration of Forestry; the Directorate of Fisheries; the Water Resources Directorate…from February 17, 2017, the organizational structure of the Ministry of Agriculture and Rural Development include the Directorate of Natural Disaster Prevention and Control helping the Minister in state management. The Minister of Agriculture and Rural Development shall submit to the Prime Minister regulations on the functions, |
tasks, powers and organizational structures of the Water Resources Directorate, Vietnam Administration of Forestry, Directorate of Fisheries and Directorate of Natural Disaster Prevention and Control; and promulgate a list of other public non-business units attached to the Ministry. Besides, the Ministry of Agriculture and Rural Development is a governmental agency performing the function of state management of the sectors and fields of agriculture, forestry, salt production, fisheries, irrigation, natural disaster prevention and control, and rural development; and state management of public services in the sectors and fields under its management as prescribed by law. This Decree replaces the Decree No. 199/2013/ND-CP dated November 26, 2013. |
