AMENDING THE REGULATIONS ON FOR DOSSIER OF ISSUING
CERTIFICATE OF ORIGIN REFERENTIAL GOODS
 

This is one of the contents under the Circular No. 01/2013/TT-BCT dated January 03, 2013 of the Ministry of Industry and Trade amending and supplementing the Circular No. 06/2011/TT-BCT providing for procedures of issuing certificate of origin referential goods.

This Circular amends and supplements the regulations on dossier requesting for C/O issuance in case of export goods in bonded warehouse. Specifically, dossier not only includes papers such as: the application for certificate of origin which is declared completely and regularly; Correlative C/O form declared completely; A copy of customs declarations completed customs formalities…as stipulated from clause 1 to clause 8 Article 9 of the Circular

 

No. 01/2013/TT-BCT but also includes the following papers: the declaration of export- import goods at bonded warehouse certified that goods reach the border gate by the Customs agencies and delivery bill; Contract or agreement commitment signed between Vietnamese traders and foreign customers deposited in the bonded warehouses; Contract or agreement commitment between the foreign customers having goods deposited in the bonded warehouses with the importer at countries signing the Free Trade Agreement with Vietnam.

Besides, this Circular also regulates: the applicant for the certificate of goods origin must be Vietnamese trader.

This Circular shall take effect on February 16, 2013.

MUST MAKE ENVIRONMENTAL REMEDIATION PLANS FOR
MINERAL EXTRACTION LICENSE’S EXTENSION
 

The Prime Minister issued the Decision No. 18/2013/QD-TTg dated March 29, 2013 of the Prime Minister on environmental improvement and remediation in mineral extraction.

Under this Decision, the Prime Minister stressed that all organizations and individuals involved in mineral extraction shall make and submit plans to competent authorities for consideration and approval. However, for organizations and individuals engaged in mineral extraction that have approved plans for environmental remediation or paid environmental remediation payments as prescribed or organizations and individuals engaged in ordinary building material extraction, they are exempt from making and submitting plans.

Besides, the subjects shall make supplementary environmental remediation projects including: organizations and individuals requesting the adjustment of the Licenses for mineral extraction; organizations and individuals

 

applying for extension of Licenses for mineral extraction; Organizations and individuals applying for changes in environmental remediation projects.

Besides, in order to ensure the participation of all organizations and individuals engaged in mineral extraction in environmental remediation as prescribed by law, the Prime Minister requests all organizations and individuals engaged in mineral extraction shall pay payments to environment protection funds. Organizations and individuals engaged in mineral extraction in localities without environment protection funds shall pay payments to Vietnam Environment Protection Fund. Payments shall be paid and refunded in VND. Payments shall enjoy demand payment interest rates from the payment time. Especially, interest shall be withdrawn only once after having the Certificate of Environmental Remediation Completion.

This Decision takes effect on May 15, 2013 and supersedes the Decision No. 71/2008/QD-TTg dated May 29, 2008.

35 DAYS IS THE TIME LIMITED FOR INTERNATIONAL
CONFERENCE’S APPLICATION DOSSIER
 

This is regulated under the Circular No. 09/2013/TT-BYT dated March 29, 2013 of the Ministry of Health guiding the organization, management of international medical conferences and seminars in Vietnam.

Under this Circular, the Ministry  of Health regulated the organization, of High-ranking international conferences and seminars or international conferences and seminars on matters related to politics, security, defense, nationalities, religion, human rights, border and territory or matters of state secret that comply with the provision in Clause 1 Article 3 of the Decision No. 76/2010/QD-TTg dated November 30, 2010 of the Prime Minister on organization and management of international conferences and seminars in Vietnam must apply for Prime Minister’s permission; The organization of  other international conferences and seminars must be also permitted by the Ministry of Health’s leaders.

 

Of which, for international conferences and seminars under the competence of the Prime Minister, organization agencies of international conferences and seminars shall send dossier of applying for international conferences and seminars organization to the Ministry of Health (the international cooperation Department) no shorter than 60 working days before day is expected for international conferences and seminars organization; Not shorter than 35 working days before day is expected for international conferences and seminars organization applicable to international conferences and seminars under decision competence of leaders of the Ministry of Health. Application dossier for international conferences and seminars organization includes: official dispatch applying for international conferences and seminars organization…

This Circular takes effect on April 15, 2013 and replaces the Circular No. 24/2001/TT-BYT dated December 21, 2001.

TELECOMMUNICATIONS SERVICE QUALITY MUST BE DISCLOSED ON WEBSITES
 

This is the requirement for the telecommunication enterprises under the Circular No. 08/2013/TT-BTTTT dated March 26, 2013 of the Ministry of Information and Communications on the management telecommunications services quality.

Specifically, Telecommunication enterprises licensed to provide telecommunications services by the Ministry of Information and Communications shall make voluntary quality announcement according to voluntary standards applicable to telecommunications services not in the “List of telecommunications services subject to quality management” posted on the websites of telecommunication enterprises; make the quality announcement according to National Technical Regulations on telecommunications services in the “List of telecommunications services subject to quality management”. The quality announced must not contradict that in National Technical Regulations.

 

At the same time, the contracts to provide postpaid services and sheets of conditions for using prepaid services must specify the quality of the services provided by telecommunication enterprises, stating “Quality of services provided for clients is conformable with the announcement made by the enterprise”.

Besides, the Ministry of Information and Communication also requests that telecommunication enterprises must shall actively supervise the quality of all services in the “List of telecommunications services subject to quality management” that they provide. Where a problem occurs to a service they provide, the telecommunication enterprise shall make an irregular report as prescribed.

This Circular takes effect on May 10, 2013 and annuls the “Regulation on postal and telecommunications service quality management” enclosed with the Decision No. 33/2006/QD-BBCVT dated September 06, 2006.

STRENGTHEN CAPABILITY FOR STAFF CONTINGENT
IN CHARGE OF FAMILY AFFAIRS
 

This is the content at the regulation on supply, management, use of cospas-sarsat beacon data and receipt, handling, transmittance of the cospas-sarsat emergency alert information issued with the Decision No. 19/2013/QD-TTg of the Prime Minister on April 02, 2013.

. Cospas-Sarsat organization means international organization of satellite information for search and rescue, . Cospas-Sarsat beacon means a device of the Cospas-Sarsat system used for transmittance of emergency alert information and position instruction and notification through satellite, assist activities of search, rescue; including types: EPIRB, ELT and PLB installed and used on the sea ships and sea construction works operating offshore.

 

Cospas-Sarsat beacon owner shall exactly, fully and timely provide Cospas-Sarsat beacon information and data for the VNMCC in order to serve for search and rescue. The Vietnam Maritime Administration shall hold management of Cospas-Sarsat beacon data; apply information technology in formulation, management and use of the national Cospas-Sarsat beacon data. The VNMCC shall perform management, opeartion and use of Cospas-Sarsat beacon data. Vietnamese competent organizations and individuals relating to activities of search and rescue, Cospas-Sarsat beacon owners and functional agencies relating to activities of search and rescue have right to access, use the Cospas-Sarsat beacon information and data.

This Decision takes effect on June 01, 2013.
