SUMMARY:

Takes effect on January 01, 2017, the Decree No. 164/2016/ND-CP dated December 24, 2016 of the Government on environmental protection charge on mineral exploitation prescribing that the rates of environmental protection charge on mineral exploitation are VND 100,000/ton for crude, VND 50/m3 for natural gas and coal seam gas, and VND 35/m3 for natural gas obtained from crude oil exploitation (associated gas). For mineral exploitation, the environmental protection charge tariffs are from VND 10.000 /ton – VND 270,000/ton; within that, the maximum charge rate is VND 270,000/ton for Gold ore; Platinum ore; Silver ore, tin ore; Lead ore, zinc ore; Cobalt ore, molybdenum ore, mercury ore, magnesium ore and vanadium ore, and the minimum charge rate of aluminum ore, bauxite ore is VND 10,000/ton; for manganese ore, wolfram ore, antimony ore, the minimum charge rate is VND… The rate of environmental protection charge for salvage exploitation of a mineral equals 60% of that on exploitation of such type of mineral specified in the charge tariff. |
Besides, the Decree also promulgates the payable amount of environmental protection charge on mineral exploitation in a charge payment period. Accordingly, the payable environmental protection charge amount in the period equals the volume of earth and stone excavated and discharged in the period (m3) multiplied by the charge rate applicable to earth and stone excavated and discharged, which is VND 200/m3 plus the volume of mineral ore exploited in the period (ton or m3) multiplied by the charge rate applicable to the exploited mineral (VND/ton or VND/m3) and then multiplied by the charge calculation coefficient based on the method of exploitation. A mineral exploiter shall submit a dossier of environmental protection charge declaration to its directly managing tax agency of the locality where such exploiter makes declaration for royalty payment. The deadline for environmental protection charge declaration is the 20th day of the subsequent month. |

From February 17, 2017, the Ministry of Labor, War Invalids and Social Affairs only have 23 affiliated units, reduced by 01 unit compared with previous regulations is the important content in the Decree No. 14/2017/ND-CP dated February 17, 2017 of the Government on functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs. Within that the Orthopedics and Rehabilitation is no more under the Ministry of Labor, War Invalids and Social Affairs. Ministerial Inspectorate and Ministerial Office are renamed Inspectorate and Office; the Department of Saving and Caring Children is renamed by the Department of Children. The General Department of Vocation is renamed by General Department of Vocational Education. Other 18 affiliated units are stayed the same such as Department of Social Security; Department of Gender Equality; Legal |
Department; Department of Overseas Labor Management; Department of Labor Safety; Department of Employment…. The Ministry of Labor, War Invalids and Social Affairs shall provide guidelines for registration and management of operation of employee representatives as prescribed by labor law; discharge the duties of national-level contact point in terms of labor sector in the course that Vietnam entering into international trade agreements; provide guidelines for wages, bonuses, and remuneration paid to employees and managers working in state-owned enterprises, state-invested enterprises; promulgate charters of junior colleges, professional secondary schools vocational education centers; regulations of enrollment and training; regulations on exams, tests, and graduation assessment… This Decree takes effect on the signing date. |

On March 20, 2017, the Government issued the Decree No. 29/2017/ND-CP dated March 20, 2017 of the Government on conditions for seafarer's training facilities and seafarer’s recruitment and placement service providers. Within that, the most important regulations is the conditions for seafarer’s training facilities. In particular, training facilities and equipment shall meet the purposes and scope of training of each seafarer training program and comply with National Technical Regulation issued by the Minister of Transport; a certification of quality management system in accordance with ISO 9001 is issued by a certification body; an electronic database of management of seafarer’s certificates for the searching purpose is available in accordance with STCW Convention. Besides, a training facility must have sufficient lecturers and instructors that meet number requirement of each training program, in which at least 50% of tenured lecturers and |
instructors are available for each training program; a theoretical lecturer must obtain at least a bachelor's degree in any of majors consistent with subjects or majors as assigned, or obtain a pedagogical certificate; a practical lecturer or instructor must obtain at least a main instructor certificate issued by International Maritime Organization (IMO) or an organization recognized by IMO in accordance with STCW Convention for particular type of training program as prescribed by the Minister of Transport… Another important content is the regulations on revocation of certification, accordingly, a training facility shall have its Certification revoked when it does not provide any seafarer's training course within 18 months from the date on which the Certification is issued; it falsifies information deliberately when applying for issuance of the Certification… This Decree takes effect on July 01, 2017. |

On March 02, 2017, the Ministry of Labor, War Invalids and Social Affairs issued the Circular No. 05/2017/TT-BLDTBXH dated March 2, 2017 of the Ministry of Labor, War Invalids and Social Affairs on regulations of enrollment and determination of enrollment targets at intermediate and college level. In accordance with this Circular, the enrollment shall be administered one or multiple times in a year. The eligible candidates at intermediate level are lower secondary graduate students and higher; and at college level are upper secondary graduate students and higher… Regulations of enrollment shall be formulated by schools themselves, at least containing: major; enrollment duration; eligible candidates; enrollment forms; enrollment incentives, |
priority score frame, etc…; conditions for ensuring quality of successful candidates (if any); enrollment fees; conditions for implementing enrollment plan, including: personnel, facilities, equipment; enrollment plan and enrollment announcement; inspection, overseeing and handle claims and denunciation; reporting; commendation, disciplinary actions; other relevant matters. The candidate may apply for registration of enrollment in one or multiple schools by through application form. An application shall consist of an application form; and valid copies of necessary documents subject to requirements and criteria for assessment or examination of each school. Candidates may submit applications and pay enrollment fees directly, online or by post. This Circular takes effect on April 15, 2017. |

On December 26, 2016, the Ministry of Information and Communications issued the Circular No. 46/2016/TT-BTTTT dated December 26, 2016 of the Ministry of Information and Communications on the List of license-exempt radio devices and accompanying technical and operational conditions. The List of license-exempt radio devices includes 14 short range devices; Radio devices placed on fishing vessels; Receive-only radio device; Low-power handie-talkies; Group of radio devices for marine safety and rescue purposes. Low-power handie-talkies which are specified in the List prescribed in Appendix 1 enclosed herewith and satisfy corresponding frequency, technical and operational conditions prescribed in Appendix 2 and Appendix 18 |
enclosed herewith shall be exempted from radio frequency licensing as from January 01, 2020. To get the license-exempt radio devices, license-exempt radio devices must tolerate harmful interference caused by radio devices licensed to use radio frequency or radio devices licensed to operate by competent supervisory agencies; license-exempt radio devices must tolerate harmful interference caused by devices using radio frequency for industrial, scientific and medical (ISM) purposes when they share the following ISM frequency bands…Particularly, licensing to use new radio devices at the 446-446.2 MHz frequency band with more than 500 mW power shall be terminated from February 14, 2017. This Circular takes effect on February 14, 2017. |
