DECREE
Prescribing state management responsibilities for education[1]
Pursuant to the June 19, 2015 Law on Organization of the Government;
Pursuant to the June 19, 2015 Law on Organization of Local Administrations;
Pursuant to the June 14, 2005 Education Law and the November 25, 2009 Law Amending and Supplementing a Number of Articles of the Education Law;
Pursuant to the June 18, 2012 Law of Higher Education;
Pursuant to the November 27, 2014 Law on Vocational Education;
At the proposal of the Minister of Education and Training;
The Government promulgates the Decree prescribing state management responsibilities for education.
Chapter I
GENERAL PROVISIONS
Article 1.Scope of regulation
1. This Decree prescribes state management responsibilities for pre-school education, general education, higher education, continuing education; intermediate and collegial pedagogical education, and other education institutions as prescribed by law (below referred collectively to as state management of education).
2. This Decree does not apply to the state management of professional education.
Article 2.Subjects of application
This Decree applies to ministries and ministerial-level agencies (below referred collectively to as ministries); People’s Committees of provinces and centrally run cities (below referred collectively to as provincial-level People’s Committees); People’s Committees of rural districts, urban districts, towns, provincial cities, and cities of centrally run cities (below collectively referred to as district-level People’s Committees); People’s Committees of communes, wards and townships (below referred collectively to as commune-level People’s Committees); Departments of Education and Training under provincial-level People’s Committees; Sections of Education and Training under district-level People’s Committees and related organizations and individuals.
Article 3.Requirements on determination of state management responsibilities for education
1. To ensure the uniformity and smoothness and higher effect and efficiency in the state management of education.
2. To ensure the compatibility between tasks, powers and responsibilities and financial and human resources, conditions to ensure educational quality and other necessary conditions for the performance of assigned tasks.
3. To specify the state management tasks, powers and responsibilities of ministries, People’s Committees at different levels and related agencies.
Chapter II
STATE MANAGEMENT RESPONSIBILITIES FOR EDUCATION OF THE MINISTRY OF EDUCATION AND TRAINING, MINISTRIES, PEOPLE’S COMMITTEES AT DIFFERENT LEVELS, AND CHAIRPERSONS OF PEOPLE’S COMMITTEES AT DIFFERENT LEVELS
Article 4.State management responsibilities for education of the Ministry of Education and Training
1. To formulate and submit to the Prime Minister for promulgation education development strategies and master plans on networks of universities and teachers’ training institutions.
2. To promulgate preschool education, general education and continuing education programs and determine standard programs for higher education; the list of level-IV education and training in pedagogy at intermediate and collegial levels and at university, master and doctoral levels; and regulations on training and joint training.
3. To regulate the organization of compilation, appraisal, approval for permitted use and guided selection of learning materials, textbooks and teaching materials at preschool education, general education and continuing education institutions; to regulate the formulation, appraisal and promulgation of training programs for intermediate and collegial pedagogical education and higher education.
4. To promulgate regulations on examinations; to regulate the examination and assessment of learners; to regulate diplomas and certificates in the national education system and the recognition of diplomas granted to Vietnamese by foreign education institutions. To assume the prime responsibility for drafting agreements on diploma equivalence or mutual recognition of diplomas with other countries and international organizations.
5. To determine title criteria for and working regimes of teachers and education administrators; the framework lists of working positions and quotas of staff members in education institutions. To determine criteria for heads and deputy heads of preschool education, general education and continuing education institutions and intermediate pedagogical schools and pedagogical colleges; title criteria of directors and deputy directors of provincial-level Departments of Education and Training, heads and deputy heads of district-level Sections of Education and Training; and professional standards of teachers.
6. To formulate and announce standards and regulations on physical foundations and equipment and school sanitation according to regulations. To submit to competent authorities for promulgation mechanisms on school fee collection and use in the education sector, scholarship and other policies applicable to learners.
7. To promulgate national standards on education institutions under the Ministry’s state management according to the structural framework of the national education system and the Vietnamese qualifications framework; to determine standards for educational quality assessment; the process and cycle of educational quality accreditation at all education and training levels under the Ministry’s state management.
8. To promulgate the charters and regulations on organization and operation of preschools, primary schools, lower secondary schools, upper secondary schools, multi-level general education schools, continuing education institutions, specialized schools, intermediate pedagogical schools and pedagogical colleges and other education institutions under the Ministry’s state management; to regulate curricular and extracurricular education activities.
9. To manage and guide the implementation of the education socialization policy.
10. To perform statistical work; to establish the national education database; to apply information technology to education administration work.
11. To be accountable for results of performance of tasks within the scope of the Ministry’s assigned powers.
12. To perform other tasks as prescribed by law.
Article 5.State management responsibilities for education of ministries
1. To study and forecast human resources demands of the sectors or fields under their respective management to serve the formulation of plans on human resources training. To apply information technology to the management of human resources in the sectors or fields under their respective management.
2. To implement the education socialization policy to mobilize lawful resources and involve organizations, individuals and enterprises in training human resources for the sectors or fields under their respective management.
3. To perform statistical work and make periodical and extraordinary reports on activities and conditions to ensure educational quality of education institutions under their respective management according to regulations.
4. To be accountable for education activities and educational quality at education institutions under their respective ministries within the scope of their assigned powers.
5. To perform other tasks as prescribed by law.
Article 6.State management responsibilities for education of provincial-level People’s Committees
1. To submit to provincial-level People’s Councils for decision:
a/ Plans, programs, projects and policies on education development, streaming of and vocational guidance for local students in conformity with local education development strategies and socio-economic development plans;
b/ Annual school fee rates applicable to public education institutions under their state management as prescribed by law;
c/ Civil servant payrolls of education administration agencies in the provinces in the total civil servant payroll assigned by competent agencies;
d/ The total number of people working in public education institutions under their management as prescribed by law.
2. To organize the implementation of legal documents, programs and projects on education in localities; to promulgate policies on education development in localities according to their competence.
3. To restructure and reorganize public education institutions under their management in conformity with practical local conditions; to ensure adequate payrolls of education administrators with sufficient numbers of people working under approved working position schemes, meeting conditions to guarantee educational quality, proceeding to organize two learning sessions/day for general education; to be accountable for education activities and quality, and management of civil servants, public employees, laborers and learners under their management.
4. To specify the functions, tasks, powers and organizational structures of provincial-level Departments of Education and Training according to the regulations of the Government and the guidance of the Ministry of Education and Training.
5. To approve the establishment of pedagogical colleges and their branches, universities and their branches; to grant investment registration certificates to foreign-invested universities; to grant investment certificates and approve master plans on construction and overall designing of private universities; to participate in the appraisal of schemes on establishment of universities in localities; to examine and certify conditions to ensure training quality for the Ministry of Education and Training to license universities operating in localities according to regulations.
6. To nominate people to learn at education institutions within the national education system and employ them according to regulations.
7. To manage public universities attached to their provinces, and private universities in their localities in accordance with law.
8. To correctly and adequately allocate state budget funds for education in localities according to regulations; to manage and examine the use of these funds under the Law on the State Budget and the current regulations on state budget management decentralization in order to meet the conditions to ensure educational quality; to collect and use school fees and other lawful revenues for public education institutions under the management of their provinces; to implement the education socialization policy, mobilizing lawful resources for education development in localities.
9. To universalize education, eradicate illiteracy, and build national standard schools and a learning society in localities.
10. To employ, assess, train and retrain and provide entitlements to civil servants, public employees and laborers in education institutions under their management according to regulations.
11. To arrange adequate land areas for education institutions according to local education development strategies and plans.
12. To materialize guidelines and policies of the State and policies of localities in order to ensure autonomy and accountability for the performance of education tasks and assurance of educational quality of education institutions under their respective management; to regularly update information on teachers and education administrators under their management into the national education database.
13. To inspect the implementation of the law on education in localities according to regulations.
14. To direct the performance of statistical work, provision of information and making of annual and extraordinary reports on local education to the Ministry of Education and Training.
15. To perform other tasks as prescribed by law.
Article 7.State management responsibilities for education of provincial-level People’s Committee chairpersons
1. To decide on or permit the establishment, withdrawal of decisions on establishment or decisions to permit the establishment, merger, division, separation, dissolution, renaming and transformation of public or private education institutions according to regulations, including: pedagogical secondary schools, upper secondary schools, multi-level general education schools with upper secondary education as the highest level, provincial-level education administrators’ schools, provincial- and district-level boarding general education schools for ethnic minority children, provincial-level continuing education centers and other education institutions under their state management.
2. To decide to permit the establishment, decide on the dissolution or operation termination of foreign-invested preschools or general education institutions (excluding preschools and general education institutions founded by foreign diplomatic missions or inter-governmental international organizations) under regulations.
3. To decide on the establishment of school councils, recognition, appointment and dismissal of school council presidents, addition or replacement of school council members; recognition, appointment, dismissal, transfer, commendation, disciplining of directors and deputy directors of intermediate pedagogical schools, pedagogical colleges, provincial-level education administrators’ schools, and public universities under the management of their provinces according to title criteria and procedures prescribed by law.
4. To decide to recognize or not to recognize management boards, management board chairpersons and principals of private universities in localities according to title criteria and procedures prescribed by law.
5. To decide to appoint, relieve from duty, transfer, commend and discipline directors and deputy directors of provincial-level Departments of Education and Training according to title criteria and procedures prescribed by law.
6. To decide on or submit to competent authorities for decision the commendation of organizations and individuals with great contributions to the cause of education development in localities.
7. To administratively inspect education institutions under their management; to direct district-level People’s Committees and provincial-level Departments of Education and Training to conduct administrative inspections of education institutions under their management; to direct specialized inspections as prescribed by law.
8. To settle complaints and denunciations and handle violations related to education at education institutions under their management as prescribed by law.
9. To annually report on education in their localities to provincial-level People’s Councils and the Ministry of Education and Training as prescribed.
10. To perform other tasks as prescribed by law.
Article 8.State management responsibilities for education of district-level People’s Committees
1. To submit to their district-level People’s Councils for decision plans, programs and projects on development of preschool, primary and lower secondary education in localities in conformity with their provinces’ education development strategies and socio-economic development plans.
2. To direct, guide and organize the implementation of plans, programs and projects on preschool, primary and lower secondary education in localities after they are approved by competent authorities; to organize the implementation of legal documents on education.
3. To restructure preschool, primary and lower secondary education institutions in localities in conformity with local practical conditions; to ensure adequate education administrators, adequate staffs according to approved working position schemes, meeting the conditions to ensure educational quality, proceeding to organize two learning sessions/day for primary and lower secondary education; to be accountable for education activities and quality, to manage civil servants, public employees, laborers and learners, to implement education development policies within the scope of their management.
4. To specifically define the functions, tasks and powers of district-level Sections Education and Training according to the regulations of the Government and the guidance of the Ministry of Education and Training.
5. To guide and examine education institutions under their management in the assurance of educational quality.
6. To universalize education and eradicate illiteracy, and build national standard schools and a learning society in localities.
7. To direct the employment, assessment, training and retraining of, and the application of policies towards, civil servants, public employees and laborers in education institutions under their management according to regulations; to regularly update information on teachers and education administrators under their management into the national database on education.
8. To ensure adequate conditions on finance, assets, physical foundations and land as prescribed; to apply the education socialization policy to mobilize various resources for education development; to promulgate regulations in order to ensure autonomy and accountability of education institutions under their management with regard to task performance and educational quality.
9. To inspect the law observance by education institutions under the state management of district-level People’s Committees.
10. To direct statistical and information work and periodical and extraordinary reporting on education in localities at the request of provincial-level People’s Committees and Departments of Education and Training.
11. To perform other tasks as prescribed by law.
Article 9.State management responsibilities for education of district-level People’s Committee chairpersons
1. To decide on or permit the establishment of, to withdraw decisions on establishment or decisions to permit the establishment, merger, division, separation, dissolution, renaming and transformation of public, people-founded and private education institutions according to regulations, including crèches, kindergartens, preschools, primary schools, lower secondary schools, multi-level general education schools with lower secondary education as the highest level, semi-boarding general education schools for ethnic minority children, community learning centers and other education institutions under the state management of district-level People’s Committees.
2. To decide on appointment, dismissal, transfer, commendation and disciplining of heads and deputy heads of district-level Sections of Education and Training according to title criteria and procedures prescribed by law.
3. To decide on recruitment or authorize the decision on recruitment of public employees in the education sector according to current regulations; to distribute the number of staff members according to working positions; to recognize, appoint, dismiss, transfer, change the working positions of, and commend and discipline, heads and deputy heads of public education institutions specified in Clause 1 of this Article, district-level boarding general education schools for ethnic minority children without upper secondary education and other education institutions under their management, based on plans prepared by district-level Sections of Education and Training and appraisal comments of district-level Sections of Home Affairs.
4. To decide on the establishment of school councils, recognition, appointment and dismissal of school council presidents, addition and replacement of school council members, for public education institutions; recognition or non-recognition of management boards, chairpersons and vice chairpersons of management boards, principals and vice principals of people-founded or private education institutions under the management of district-level People’s Committees according to title criteria and procedures prescribed by law.
5. To decide on or submit to competent authorities for decision the commendation of organizations and individuals with great contributions to the cause of education development in localities.
6. To scrutinize and settle complaints and denunciations and handle education-related violations at education institutions in accordance with law .
7. To periodically report on education in localities to provincial-level Departments of Education and Training, People’s Councils and People’s Committees according to regulations.
8. To perform other tasks as prescribed by law.
Article 10.State management responsibilities for education of commune-level People’s Committees
1. To formulate and submit to commune-level People’s Councils for approval plans on education development in localities; to organize the implementation of education development plans in localities after they are approved.
2. To invest or jointly invest in the construction of preschools, primary schools, lower secondary schools, multi-level general education schools with lower secondary education as the highest level, and community learning centers according to regulations of district-level People’s Committees; to coordinate with related units in advising district-level People’s Committees on construction of national standard schools, and plans on the use of land reserved for education institutions in localities.
3. To manage community learning centers; to coordinate with district-level Sections of Education and Training in managing preschools, primary schools, lower secondary schools and multi-level general education schools with lower secondary education as the highest level; to mobilize resources for education development in their communes, building a healthy education environment, mobilizing people to care for education, coordinating with schools in educating children to adopt new cultural lifestyles, participating in protecting and re-embellishing historical relics, scenic places, cultural works and children’s learning and playing facilities.
4. To examine conditions to ensure caring and educational quality at independent child care groups and kindergartens in localities. To be accountable for education activities within the scope of their management.
5. To perform other tasks as prescribed by law.
Article 11.State management responsibilities for education of commune-level People’s Committee chairpersons
1. To permit the establishment, decide on the merger, division and separation, and suspend education activities of, and to dissolve, independent child care groups and kindergartens as prescribed.
2. To direct education institutions in their localities to register and mobilize to the utmost people in school-age groups to go to school in order to achieve the universalization of education and eradication of illiteracy, creating conditions for all people to have lifetime education.
3. To perform statistical and information work and make periodical and extraordinary reports on education according to their delegated competence at the request of district-level People’s Committees and Sections of Education and Training.
4. To settle complaints and denunciations, and handle in accordance with law education-related violations at education institutions under their management.
5. To perform other tasks as prescribed by law.
Chapter III
RESPONSIBILITIES OF PROVINCIAL-LEVEL DEPARTMENTS OF EDUCATION AND TRAINING AND DISTRICT-LEVEL SECTIONS OF EDUCATION AND TRAINING
Article 12.Responsibilities of provincial-level Departments of Education and Training
1. To advise provincial-level People’s Committees in submitting to their People’s Councils:
a/ Decisions, plans, programs, projects and policies on education development, streaming of and vocational guidance for local students in conformity with local education development strategies and socio-economic development plans.
b/ Decisions on annual school fee rates applicable to public education institutions under their provinces’ state management as prescribed by law;
c/ Decisions on civil servant payrolls of education administration agencies in the provinces as prescribed by law;
d/ Approval of the total staff of public education institutions under the provincial management as prescribed by law.
2. To submit to provincial-level People’s Committees for decision:
a/ Policies, programs, projects and schemes on education development in localities as prescribed; measures to perform administrative reforms in education;
b/ Decentralization and authorization of district-level People’s Committees and provincial-level Departments of Education and Training to perform certain tasks and exercise certain powers falling under the state management of provincial-level People’s Committees;
c/ Definition of functions, tasks, powers and organizational structure of provincial-level Departments of Education and Training according to the regulations of the Government and the guidance of the Ministry of Education and Training.
3. To submit to provincial-level People’s Committee chairpersons for decision:
a/ The establishment, establishment permission, withdrawal of establishment decisions or establishment permission decisions, merger, division, separation, dissolution, renaming, transformation of education institutions specified in Clauses 1 and 2, Article 7 of this Decree in accordance with law;
b/ The establishment of school councils, recognition, appointment, dismissal of school council presidents, addition and replacement of school council members; recognition, appointment, dismissal, transfer, position change, commendation, disciplining of principals and vice principals of intermediate pedagogical schools, pedagogical colleges, education administrators’ schools under the management of provinces; recognition or non-recognition of management boards, management board chairpersons, and principals of private universities in localities according to title criteria and procedures prescribed by law;
c/ The promulgation of decisions, directives and other documents in the field of education which fall under the competence of provincial-level People’s Committee chairpersons as assigned;
d/ Commendation or submission to competent authorities for commendation of organizations and individuals with achievements in education activities in localities.
3. To specifically define the functions, tasks and powers of units in the organizational structure of provincial-level Departments of Education and Training as prescribed.
4. To guide, disseminate, and organize the implementation of, legal documents on education, and plans, programs, projects, schemes and other contents on education, after they are approved by competent authorities.
5. To guide and organize the implementation of professional activities; education universalization and illiteracy eradication, building of national-standard schools and a learning society in localities; the enrolment, examination, withdrawal of diplomas and certificates, accreditation of educational quality by district-level Sections of Education and Training and education institutions under their respective management.
6. To manage professional issues in the implementation of continuing education programs by district-level centers as prescribed.
7. To decide to permit or suspend education activities of upper secondary schools or multi-level general education schools with upper secondary education as the highest level, provincial-level boarding upper secondary schools for ethnic children, district-level boarding general education schools with upper secondary education for ethnic minority children, foreign language and computer training centers in localities (excluding those of universities and colleges, operating in their premises), foreign-invested education institutions (excluding foreign-invested universities and their branches in Vietnam); to license or suspend pedagogical secondary education activities and withdraw certificates of pedagogical secondary education registration under regulations.
8. To decide on the establishment of school councils, recognition, appointment, dismissal of school council presidents, addition and replacement of school council members, with regard to upper secondary schools, multi-level general education schools with upper secondary education as the highest level, provincial-level boarding general education schools for ethnic minority children, and district-level boarding general education schools with upper secondary education for ethnic minority children under the management of provincial-level Departments of Education and Training; to decide on the recognition, appointment, dismissal, transfer, position change, commendation and disciplining of heads and deputy heads of units attached to provincial-level Departments of Education and Training and non-business units under provincial-level Departments of Education and Training according to title criteria and procedures prescribed by law.
9. To recognize or not to recognize management boards, management board chairmen and vice chairmen, principals and vice principals of private upper secondary schools and private general education schools with upper secondary education as the highest level in localities.
10. To grant and withdraw business registration certificates, to decide on operation suspension with regard to overseas study consultancy service organizations in localities as prescribed by law.
11. To assume the prime responsibility for the elaboration of annual plans on staffs of provincial-level Departments of Education and Training and education institutions under their management and submit them to competent agencies for approval; to allocate the number of staffs according to working positions to attached education institutions under regulations; to guide and organize the recruitment, employment, assessment, training and retraining of, and the implementation of policies towards, civil servants, public employees and laborers at education institutions under the management of provincial-level People’s Committees as prescribed.
12. To prepare education budget estimates, to decide on allocation or assignment of budget estimates to attached education institutions after they are approved by competent authorities; to approve budget finalization statements, notify annual budget finalization statements and consolidate budget finalization statements of attached education institutions; to coordinate with provincial-level Departments of Finance and Departments of Planning and Investment in determining and balancing annual state budget funds for local education for submission to competent authorities; to guide, inspect and examine the allocation and use of state budget funds and lawful financial sources for education in the provinces.
13. To guide and organize the mobilization of resources for education development, ensuring the autonomy and self-responsibility of attached education institutions; to manage the assigned finances, assets and physical foundations in accordance with law; to be accountable for education activities, educational quality, the management of teachers and learners, the application of policies on education development under their management to provincial-level People’s Councils and People’s Committees as well as the Ministry of Education and Training.
14. To conduct inspections, examinations, settle complaints and denunciations, and handle violations in accordance with law.
15. To perform statistical and information work, make periodical and extraordinary reports on local education under their management to provincial-level People’s Committees and the Ministry of Education and Training according to regulations.
16. To perform other tasks as prescribed by law.
Article 11.Responsibilities of district-level Divisions of Education and Training
1. To advise district-level People’s Committees in submitting to their People’s Councils decisions, plans, programs and projects on development of preschool, primary and lower secondary education in localities in conformity with provincial-level education development strategies and socio-economic development plans.
2. To submit to district-level People’s Committees for decision:
a/ Specific definition of functions, tasks and powers of their Sections of Education and Training according to regulations of the Government and the guidance of the Ministry of Education and Training;
b/ The decentralization and authorization of commune-level People’s Committees and district-level Sections of Education and Training to perform one or several tasks and powers under the management of district-level People’s Committees.
3. To submit to district-level People’s Committee chairpersons for decision:
a/ The establishment or establishment permission, withdrawal of establishment decisions or establishment permission decisions, merger, division, separation, dissolution, renaming, transformation of the education institutions specified in Clause 1, Article 9 of this Decree as prescribed by law;
b/ The establishment of school councils, recognition, appointment, dismissal of school council presidents, addition and replacement of school council members of public education institutions; recognition or non-recognition of management boards, management board chairpersons and vice chairpersons, principals and vice principals of people-founded or private education institutions under the state management of district-level People’s Committees according to title criteria and procedures prescribed by law;
c/ Commendation or submission to competent authorities for commendation of organizations and individuals with achievements in education activities in localities;
d/ Other state management contents in the field of education which fall under the competence of district-level People’s Committee chairpersons.
3. To guide, organize and inspect the implementation of professional regulations and operation; assurance of educational quality; enrolment, examination, grant of diplomas and certificates; education universalization, illiteracy eradication, building of national standard schools and a learning society in localities. To be accountable for education activities, educational quality, management of teachers and learners, application of education development policies under their management to district-level People’s Councils and People’s Committees, provincial-level Departments of Education and Training and the entire society.
4. To decide to permit or suspend education activities of district-level boarding general education schools without upper secondary education for ethnic minority children and the education institutions specified in Clause 1, Article 9 of this Decree.
5. To prepare plans and coordinate with district-level Divitions of Home Affairs in carrying out the procedures for recruitment of public employees in the education sector, and submit them to district-level People’s Committee chairpersons for decision; to allocate the number of staff members according to working positions; to recognize, appoint, dismiss, transfer, change the working positions of, commend and discipline heads and deputy heads of public education institutions specified in Clause 1, Article 9 of this Decree and district-level boarding general education schools without upper secondary education for ethnic minority children according to regulations of district- level People’s Committees.
6. To assume the prime responsibility for formulating annual plans on the number of staff members of district-level Divitions of Education and Training and public education institutions managed by district-level People’s Committees, and submit them to competent agencies for approval. To guide, implement and examine the employment, assessment, training and retraining of, and the application of policies towards, civil servants, public employees and laborers at education institutions under the management of district-level People’s Committees according to regulations.
7. To prepare budget estimates, send them to district-level Divitions of Finance and Planning for appraisal, and submit to district-level People’s Committee chairpersons for approval plans on allocation and assignment of budget estimates to public education institutions under the management of district-level People’s Committees; to coordinate with district-level Divitions of Finance and Planning in guiding and examining the allocation and use of state budget funds and other lawful sources by education institutions in the districts according to regulations.
8. To examine and settle complaints and denunciations, and handle violations in accordance with law.
9. To guide commune-level People’s Committees in the state management of education.
10. To perform statistical and information work, make periodical and extraordinary reports on education activities under their management to district-level People’s Committees and Divitions of Education and Training according to regulations.
11. To perform other tasks as prescribed by law.
Chapter IV
IMPLEMENTATION PROVISIONS
Article 14.Effect
1. This Decree takes effect on November 15, 2018, and replaces the Government’s Decree No. 115/2010/ND-CP of December 24, 2010, prescribing state management responsibilities for education.
2. The Ministry of Education and Training shall guide the functions, tasks, powers and organizational structures of provincial-level Departments of Education and Training, district-level Divitions of Education and Training as prescribed by this Decree and other relevant legal documents.
Article 15.Implementation responsibility
The Minister of Education and Training, other ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees and related agencies shall implement this Decree.-
