DECISION
ISSUING THE POST AND TELECOMMUNICATION OPERATION LICENSING FEE LEVELS
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No. 15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Government’s Decree No. 109/1997/ND-CP of November 12, 1997 on Post and Telecommunications;
Pursuant to the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
After consulting with the General Department of Post and Telecommunications and at the proposal of the General Director of Tax,
DECIDES:
Article 1.- To issue together with this Decision the Table of post and telecommunication (PT) operation licensing fee levels
Article 2.- Organizations and individuals that are granted post and telecommunication operation licenses in Vietnam shall have to pay fees at the levels prescribed in Article 1 of this Decision, except in the following cases:
- The exclusive-use telecommunication networks of the Ministry of Public Security, the Ministry of Defense and the Ministry for Foreign Affairs in direct service of security, defense and external relations.
- The communication networks used in emergency cases when storms, floods or other natural calamities occur.
- Special networks in direct service of the direction of the Party Central Committee, the National Assembly and the Government.
- The communication networks of international agencies and organizations in Vietnam, which are entitled to diplomatic immunities.
Article 3.- The agencies that collect PT operation licensing fees may deduct 25% (twenty five per cent) of the collected fee amounts before remitting them into the State budget to cover expenses for the work of granting of PT operation licenses and the charge and fee collection according to the prescribed regime; the remainder of the collected fees (75%) must be remitted into the State budget.
The agencies collecting PT operation licensing fees shall have to organize the collection, payment declaration, remittance, management of the use of, and settle PT operation licensing fees according to the provisions of Circular No. 54/1999/TT-BTC of May 10, 1999 of the Ministry of Finance guiding the implementation of the Government’s Decree No. 04/1999/ND-CP on charges and fees belonging to the State budget.
Article 4.- The tax offices of the localities where PT operation licensing fees are collected shall have to issue fee collection documents, guide and supervise the collection of PT operation licensing fees according to this Decision and Circular No. 54/1999/TT-BTC of May 10, 1999 of the Ministry of Finance guiding the implementation of the Government’s Decree No. 04/1999/ND-CP on charges and fees belonging to the State budget.
Article 5.- This Decision takes effect 15 days after its signing. All regulations on PT operation licensing fees, which are contrary to this Decision, are now annulled.
Article 6.- Organizations liable to pay PT operation licensing fees, units assigned to organize the PT operation licensing fee collection and concerned agencies shall have to implement this Decision.
