CIRCULAR
Guiding methods of sending reports by credit rating enterprises or makers of the market of the Government’s debt instruments specified in the Government’s Decree No. 88/2014/ND-CP of September 26, 2014, on credit rating services, and the Government’s Decree No. 95/2018/ND-CP of June 30, 2018, prescribing the issuance, registration, depositing, listing and trading of the Government’s debt instruments on the securities market[1]
Pursuant to the Government’s Decree No. 09/2019/ND-CP of January 24, 2019, prescribing the reporting regime applicable to state administrative agencies;
Pursuant to the Government’s Decree No. No. 88/2014/ND-CP of September 26, 2014, on credit rating services;
Pursuant to the Government’s Decree No. No. 95/2018/ND-CP of June 30, 2018, prescribing the issuance, registration, depositing, listing and trading of the Government’s debt instruments on the securities market;
Pursuant to the Government’s Decree No. 87/2017/ND-CP of July 26, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Department of Banking and Financial Institutions;
The Minister of Finance promulgates the Circular guiding methods of sending reports by credit rating enterprises or makers of the market of the Government’s debt instruments specified in the Government’s Decree No. 88/2014/ND-CP of September 26, 2014, on credit rating services, and the Government’s Decree No. 95/2018/ND-CP of June 30, 2018, prescribing the issuance, registration, depositing, listing and trading of the Government’s debt instruments on the securities market.
Article 1.Scope of regulation
This Circular guides methods of sending reports by credit rating enterprises specified in Article 42 of the Government’s Decree No. 88/2014/ND-CP of September 26, 2014, on credit rating services (below referred to as Decree No. 88/2014/ND-CP), and methods of sending reports by makers of the market of the Government’s debt instruments specified at Point dd, Clause 2, Article 27 of the Government’s Decree No. 95/2018/ND-CP of June 30, 2018, prescribing the issuance, registration, depositing, listing and trading of the Government’s debt instruments on the securities market (below referred to as Decree No. 95/2018/ND-CP).
Article 2.Subjects of application
1. Credit rating enterprises specified in Decree No. 88/2014/ND-CP.
2. Makers of the market of the Government’s debt instruments specified in Decree No. 95/2018/ND-CP.
3. Agencies, organizations and individuals involved in the sending of reports of credit rating enterprises specified in Decree No. 88/2014/ND-CP or makers of the market of the Government’s debt instruments specified in Decree No. 95/2018/ND-CP.
Article 3.Methods of sending reports of credit rating enterprises
Credit rating enterprises shall send reports specified in Article 42 of Decree No. 88/2014/ND-CP to the Ministry of Finance by one of the following methods:
1. Sending paper reports directly or by post.
2. Sending reports to the email: [email protected].
3. Other methods as prescribed by law.
Article 4.Methods of sending reports for makers of the market of the Government’s debt instruments
Makers of the market of the Government’s debt instruments shall send reports specified at Point dd, Clause 2, Article 27 of Decree No. 95/2018/ND-CP to the Ministry of Finance by one of the following methods:
1. Sending paper reports directly or by post.
2. Sending reports to the email: [email protected].
3. Other methods as prescribed by law.
Article 5.Effect
1. This Circular takes effect on October 19, 2020.
2. Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Finance for consideration and settlement.-
