Circular 57/2020/TT-BCA amending Circular 04/2015/TT-BCA

CIRCULAR

Amending and supplementing a number of articles of the Ministry of Public Security’s Circular No. 04/2015/TT-BCA of January 5, 2015, providing document forms for entry, exit and residence of foreigners in Vietnam^[1]

Pursuant to the June 16, 2014 Law on Foreigners’ Entry in, Exit from, Transit through and Residence in Vietnam, and the November 25, 2019 Law Amending and Supplementing a Number of Articles of the Law on Foreigners’ Entry in, Exit from, Transit through and Residence in Vietnam;

Pursuant to the Government’s Decree No. 01/2018/ND-CP of August 6, 2018, defining the functions, tasks, powers and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Vietnam Immigration Department;

The Minister of Public Security promulgates the Circular amending and supplementing a number of articles of the Ministry of Public Security’s Circular No. 04/2015/TT-BCA of January 5, 2015, providing document forms for entry, exit and residence of foreigners in Vietnam.

Article 1.To amend and supplement a number of articles of the Ministry of Public Security’s Circular No. 04/2015/TT-BCA of January 5, 2015, providing document forms for entry, exit and residence of foreigners in Vietnam

1. To amend and supplement Clause 1 of Article 1 as follows:

“1. This Circular provides, and guides the use and management of, document forms for entry, exit and residence of foreigners in Vietnam in accordance with the Law on Foreigners’ Entry in, Exit from, Transit through and Residence in Vietnam and the Law Amending and Supplementing a Number of Articles of the Law on Foreigners’ Entry in, Exit from, Transit through and Residence in Vietnam.”

2. To add the following clauses to Article 2:

a/ To add Clause 1a after Clause 1 as follows:

“1a/ Vietnamese e-visa application form (Form NA1a).”.

b/ To add Clauses 19 and 20 after Clause 18 as follows:

“19. Written request for grant of e-account (Form NA19).

20. Written request for cancelation of e-account (Form NA20)”.

3. To add Clauses 3a, 3b and 3c after Clause 3 of Article 3 as follows:

“3a/ Official Letter replying the request for grant of e-account (Form NB8).

3b/ Official Letter notifying the refusal to grant an e-account (Form NB9).

3c/ Official Letter notifying the cancellation of e-account (Form NB10).”.

4. To add Clauses 2a and 2b after Clause 2, and Clauses 14 and 15 after Clause 13, of Article 4 as follows:

“2a/ E-visa (Form NC2a).

2b/ Visa accompanying the list of foreigners issued by the immigration authority (Form NC2b).

14. Specimen seal cancelled (Form NC17).

15. Specimen seal used (Form NC18).”.

5. To amend Point a, Clause 1 of Article 5 as follows:

“a/ The Vietnam Immigration Department shall enter into contracts with the Institute of Science and Technology under the Ministry of Public Security to research, design, produce and supply blank forms to meet requirements of competent agencies in charge of granting visas, temporary residence cards, permanent residence cards and visa exemption certificates.”.

6.To replace the phrase “January 29, 2012” by the phrase “January 29, 2002”, the phrase “Circular No. 02/2012/TT-BCA” by the phrase “Circular No. 02/2013/TT-BCA”, and the phrase “Circular No. 25/2013/TT-BCA” by the phrase “Circular No. 25/2014/TT-BCA”, in Clause 1 of Article 6.

Article 2.Effect and implementation responsibility

1. This Circular takes effect on July 1, 2020.

2. The Vietnam Immigration Department shall assume the prime responsibility for, and coordinate with public security offices of units and  localities and other related units in, organizing, guiding and inspecting the implementation of this Circular. Heads of units attached to the Ministry of Public Security and directors of provincial-level Departments of Public Security shall implement this Circular. Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Public Security (via the Vietnam Immigration Department) for timely guidance.-
