CIRCULAR
Prescribing the rates of charges and fees for the national domain name “.vn” and Internet Protocol (IP) addresses of Vietnam and charge and fee collection, remittance, management and use[1]
Pursuant to the November 25, 2015 Law on Charges and Fees;
Pursuant to the June 25, 2015 Law on the State Budget;
Pursuant to the November 23, 2009 Telecommunications Law;
Pursuant to the Government’s Decree No. 72/2013/ND-CP of July 15, 2013, on the management, provision and use of Internet services and online information;
Pursuant to the Government’s Decree No. 120/2016/ND-CP of August 23, 2016, detailing and guiding a number of articles of the Law on Charges and Fees;
Pursuant to the Government’s Decree No. 215/2013/ND-CP of December 23, 2013, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Tax Policy Department,
The Minister of Finance issues the Circular prescribing the rates of charges and fees for the national domain name “.vn” and IP addresses of Vietnam and charge and fee the collection, remittance, management and use, as follows:
Article 1. Scope of regulation and subjects of application
1. Scope of regulation
This Circular prescribes the rates of charges and fees for the national domain name “.vn” and IP addresses of Vietnam and charge and fee collection, remittance, management and use.
2. Subjects of application
a/ Domestic and foreign organizations and individuals registering and using the national domain name of Vietnam “.vn”; domestic organizations registering and using IP addresses in Vietnam;
b/ State agencies competent to make grant registration of the national domain name “.vn” and IP addresses of Vietnam;
c/ Other organizations and individuals engaged in the collection and remittance of charges and fees for the national domain name “.vn” and IP addresses of Vietnam.
Article 2. Charge and fee payers
Charge and fee payers are domestic and foreign organizations and individuals registering and using the national domain name “.vn”; domestic organizations registering, managing and using IP addresses in Vietnam under the Telecommunications Law and the Government’s Decree No. 72/2013/ND-CP of July 15, 2013, on the management, provision and use of Internet services and online information.
Article 3. Charge- and fee-collecting organization
The charge- and fee-collecting organization is the Vietnam Internet Network Information Center, which is assigned by the Ministry of Information and Communications to grant registration of the national domain name “.vn” and IP addresses of Vietnam and shall collect charges and fees specified in this Circular.
Article 4. Charge and fee rates
1. To promulgate together with this Circular the Tariff of fees for registration and charges for maintenance of the national domain name “.vn” and IP addresses of Vietnam.
2. Fees for registration and charges for maintenance of the national domain name “.vn” and IP addresses of Vietnam shall be collected in Vietnam dong (VND).
Article 5. Charge and fee declaration and remittance
1. On Monday every week at the latest, the charge- and fee-collecting organization shall deposit collected charge amounts into its State Treasury account of charge revenues awaiting remittance into the state budget.
2. The charge- and fee-collecting organization shall declare collected charge and fee amounts on a monthly basis and make finalization on an annual basis under Clause 3, Article 19 of; and remit collected charge and fee amounts into the state budget under Clause 2, Article 26 of the Minister of Finance’s Circular No. 156/2013/TT-BTC of November 6, 2013, guiding a number of articles of the Law on Tax Administration; the Law Amending and Supplementing a Number of Articles of the Law on Tax Administration and the Government’s Decree No. 83/2013/ND-CP of July 22, 2013.
