DECREE
Defining the functions, tasks, powers and organizational structure of the Ministry of Health[1]
Pursuant to the February 18, 2025 Law on Organization of the Government;
At the proposal of the Minister of Health;
The Government promulgates the Decree defining the functions, tasks, powers and organizational structure of the Ministry of Health.
Article 1. Position and functions
The Ministry of Health is an agency of the Government, performing the state management in the fields of: preventive medicine; medical examination and treatment, rehabilitation; medical assessment, forensic medicine, forensic psychiatry; mothers and children; population; prevention and control of social evils (except drug addiction treatment and post-drug addiction treatment management); social protection; traditional medicine and pharmacy; pharmaceuticals, cosmetics; food safety; medical equipment; health insurance, and state management of public services in the fields under the Ministry of Health’s state management.
Article 2. Tasks and powers
The Ministry of Health shall perform the tasks and exercise the powers prescribed in the Law on Organization of the Government, and the Government’s regulations on the functions, tasks, powers and organizational structures of ministries and ministerial-level agencies, and has the following specific tasks and powers:
1. To submit to the Government draft laws and draft resolutions of the National Assembly, draft ordinances and draft resolutions of the National Assembly Standing Committee, draft decrees and draft resolutions of the Government according to the Ministry’s approved annual law-making programs and plans and programs, projects and schemes as assigned by the Government or the Prime Minister; to submit to the Government and the Prime Minister for approval strategies, master plans, and long-term, medium-term, annual development plans and important national programs, projects and works in the fields under the Ministry’s state management.
2. To submit to the Prime Minister drafts of decisions, directives and other documents on the spheres under the Ministry’s state management or as assigned.
3. To promulgate circulars, decisions, directives and other documents on state management of the fields under the Ministry’s state management.
4. To direct, guide and organize the implementation of legal documents, strategies, master plans, plans, national target programs, programs, projects and important national works after they are approved; to examine, review, systematize, consolidate, and codify the system of legal documents, conduct the dissemination and education and monitor the implementation of the law in the fields under the Ministry’s state management.
5. Regarding preventive medicine:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, professional regulations, national standards, national technical regulations and techno-economic norms on: monitoring, prevention and control of infectious diseases, HIV/AIDS, non-communicable diseases, occupational diseases, accidents and injuries; vaccination; biosafety at medical laboratories; border health quarantine; environmental health and hygiene, occupational hygiene, and workplace and school health and hygiene; community nutrition; prevention and control of tobacco harms; prevention and control of harms of liquors and beers; quality of clean water for domestic use; and management of chemicals, insecticides and disinfectants for household and medical use;
b/ To promulgate, modify and supplement lists of infectious diseases of different groups, the list of infectious diseases requiring the use of vaccines and biologicals; to manage vaccination activities and organize the implementation of vaccination and use of biologicals for compulsory subjects as prescribed by law;
c/ To assume the prime responsibility for, and coordinate with related ministries and sectors in, promulgating, amending and supplementing health standards for each type of occupation and job, list of diseases requiring long-term treatment entitled to sickness benefits and list of occupational diseases entitled to social insurance benefits in Vietnam;
d/ To formulate and promulgate regulations on management of medical wastes and environmental protection in medical establishments and hygiene in burial and cremation for deaths due to dangerous epidemics;
dd/ To deploy the surveillance of infectious diseases, non-communicable diseases, diseases of unknown etiology, risk factors affecting health, and other public health issues; to early detect infectious diseases causing epidemics and carry out declaration of epidemics and declaration of termination of epidemics in accordance with law; to assume the prime responsibility for, and coordinate with related agencies in, providing accurate and timely information on infectious diseases;
e/ To submit to competent authorities for decision, or to decide according to the Ministry’s competence, the implementation of special measures to prevent and control epidemics; to examine, urge and support units and localities in organizing the implementation of epidemic prevention and control measures; to formulate plans and deploy activities in response to public health emergencies;
g/ To guide and organize the implementation of health quarantine activities at border gates; to promptly inform and report on the situation of dangerous infectious diseases and public health issues in the world for proactive prevention and control;
h/ To manage, guide and organize occupational environment monitoring at the workplace, and direct occupational environment monitoring in industrial parks and cottage industry zones with high risks of causing occupational diseases; to assess, control and manage harmful factors at the workplace; to build a database on occupational environment monitoring activities, announce occupational environment monitoring organizations qualified for operation and occupational environmental monitoring organizations suspended from operation in accordance with law;
i/ To provide guidance on the management of occupational hygiene, health check-ups for workers, occupational disease screening, and management of workers’ health at the workplace; to assume the prime responsibility for managing the issuance of occupational health certificates, first aid training, and emergency care at the workplace in accordance with law;
k/ To direct and guide the control of impacts of environmental pollution on human health;
l/ To direct and guide the assessment of the scope, subjects, and levels of impacts of environmental incidents on human health; to prevent and respond to environmental incidents caused by dangerous infectious diseases; to implement measures to prevent and limit impacts of environmental incidents on human health;
m/ To direct, guide and organize the implementation of the regulations on sorting, collection, storage and management of medical wastes, environmental protection in medical establishments, and hygiene in burial and cremation for deaths due to dangerous epidemics in accordance with law;
n/ To direct and guide community-based primary health care for people;
o/ To appraise, grant, re-grant and revoke certificates of laboratories meeting level-III or level-IV biosafety standards, except laboratories under the management of the Ministry of National Defense;
p/ To grant, re-grant, supplement, renew and revoke circulation registration numbers, import licenses, and certificates of free sale for, and suspend the circulation of, chemicals, insecticides and disinfectants for household and medical use in accordance with law;
q/ To grant, re-grant, modify and revoke certificates of eligibility for confirmatory HIV testing, suspend confirmatory HIV testing activities for HIV laboratories under the Ministry and decide to designate, and to adjust and revoke decisions on designation of, laboratories conducting reference testing for HIV confirmation, suspend reference testing for HIV confirmation;
r/ To designate organizations conducting technical regulation conformity certification for tobacco; to grant, suspend, revoke, and re-grant receipts of declarations of conformity with technical regulations for tobacco in accordance with law;
s/ To manage, guide, and organize the implementation of HIV/AIDS prevention and control activities; HIV counseling and testing; and treatment of opium addiction and tobacco addiction treatment;
t/ To direct, guide, and organize the implementation of professional regulations and national technical regulations in the field of preventive medicine nationwide.
6. Regarding medical examination and treatment, and rehabilitation; medical assessment, forensic medical examination, and forensic psychiatric assessment:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, professional regulations, national standards, national technical regulations, techno-economic norms, and quality criteria regarding: medical examination and treatment, pre-hospital emergency care, blood transfusion safety, nursing, rehabilitation, clinical pharmacy, clinical nutrition, and infection control; cosmetic surgery; donation, removal and transplantation of human tissues and organs; medical assessment, forensic medical examination, and forensic psychiatric assessment in accordance with law;
b/ To formulate and submit to competent authorities for approval the master plan on the system of medical examination and treatment establishments; to stipulate in detail the grading of medical establishments based on technical and professional capacity;
c/ To manage and organize the grant, re-grant, extension and modification of practice licenses, suspension of professional practice, revocation of licenses for medical examination and treatment practice for people working at medical examination and treatment establishments under the Ministry’s management; to grant, re-grant, modify, suspend operation and revoke operation licenses for medical examination and treatment establishments under the Ministry’s management; to suspend the operation of other medical examination and treatment establishments nationwide in accordance with law;
d/ To appraise, and permit medical examination and treatment establishments to apply, new techniques and new methods in accordance with law;
dd/ To issue certificates of advertising content for medical examination and treatment activities under the Ministry’s competence in accordance with law;
e/ To assume the prime responsibility for, and coordinate with related ministries and sectors in, organizing medical professional activities in provision of health care for central-level officials according to regulations;
g/ To direct, guide and organize the implementation of legal documents, professional regulations, national standards, and national technical regulations in the fields of medical examination and treatment, rehabilitation, cosmetic surgery, medical assessment, forensic medical examination, and forensic psychiatric assessment.
7. Regarding mothers and children:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, legal documents, strategies, policies, programs, plans, and national goals on mothers and children;
b/ To formulate and promulgate, or submit to competent authorities for promulgation, the systems of targets and indicators on mothers and children; professional regulations and national technical regulations on reproductive health care services and child protection services;
c/ To guide and organize the implementation of reproductive health counseling and care; counseling, nutrition, and health care for mothers and children; prenatal and neonatal counseling, screening, diagnosis, and treatment;
d/ To regulate the exercise of children’s rights; to assume the prime responsibility for, and coordinate with related agencies and organizations in, ensuring the exercise of children’s rights, the protection of children and children’s participation in children’s issues;
dd/ To guide and organize the implementation of legal documents, policy strategies, programs, plans, national goals on children and the Month of Action for Children; the prevention and control of child accidents and injuries and the care and nurturing of children in special circumstances;
e/ To appraise, and decide to recognize, medical establishments allowed to perform surrogacy techniques for humanitarian purposes and gender reassignment in accordance with law;
g/ To manage and use the National Fund for Vietnamese Children in accordance with law;
h/ To manage the National Child Protection Hotline.
8. Regarding population:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, legal documents, strategies, policies, programs, and plans on population;
b/ To formulate and promulgate, or submit to competent authorities for promulgation, a system of population targets and indicators; professional regulations and national technical regulations on services in the population sector;
c/ To direct and guide the implementation of legal documents, strategies, policies, programs, plans, professional regulations, and national technical regulations on population.
9. Regarding social protection and prevention of social evils:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, legal documents, policies, programs and plans on social assistance, social pension allowances, social work, elderly affairs, disability affairs and other social assistances;
b/ To formulate and promulgate, or submit to competent authorities for promulgation, legal documents, policies, programs and plans on prostitution prevention and combat and support for victims of trafficking and people undergoing procedures for being identified as victims of trafficking;
c/ To promulgate, or submit to competent authorities for promulgation, and organize the implementation of, legal documents on emergency social assistance in overcoming the consequences of disasters, catastrophes, epidemics or other force majeure events;
d/ To direct, guide and organize the implementation of policies and laws on social assistance, social pension allowances, support for funeral expenses, nurturing and caring for the elderly and people with disabilities in care facilities for the elderly and people with disabilities;
dd/ To direct, guide and organize the implementation of regulations on conditions and procedures for establishment and registration, grant of operation licenses for social assistance facilities and care facilities for people with disabilities;
e/ To guide and organize the implementation of legal documents, policies, programs and plans on social work, elderly affairs, disability affairs, promotion of the role of the elderly, health care for the elderly, and health care and rehabilitation for people with disabilities;
g/ To direct, guide and organize the implementation of regulations on prostitution prevention and combat;
h/ To guide the screening for signs of trafficking among workers; to guide and organize the implementation of medical and psychological support measures for victims, people undergoing procedures for being identified as victims of trafficking and support victims of trafficking to integrate into the community;
i/ To direct and guide the integration of human trafficking prevention and control contents into programs on prevention and combat of social evils and protection of children, programs for women’s advancement and other programs on socio-economic development.
10. Regarding traditional medicine and pharmacy:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, professional regulations, national standards, and national technical regulations on traditional medicine and pharmacy;
b/ To formulate and submit to competent authorities for promulgation mechanisms and policies on takeover, preservation, development and modernization of traditional medicine and pharmacy; development of medicinal plant cultivation areas and combination of traditional medicine and pharmacy with modern medicine;
c/ To formulate and promulgate a list of precious, rare, and endemic medicinal species and varieties subject to control; to organize the implementation of measures to conserve, exploit, and use medicinal resources rationally and sustainably;
d/ To grant, re-grant, extend, modify, and revoke licenses for medical examination and treatment practice by traditional medicine under the Ministry’s management; to grant, re-grant, modify, and revoke operation licenses for examination and treatment establishments by traditional medicine under the Ministry’s management in accordance with law;
dd/ To grant, extend, change, supplement, and revoke certificates of registration for circulation of medicinal materials and traditional medicines in accordance with law; to grant, re-grant, modify, and revoke: certificates of eligibility for trading in pharmaceuticals for establishments trading in medicinal materials and traditional medicines; certificates of compliance with Good Agricultural and Collection Practices (GACP) for medicinal materials under the Ministry’s management in accordance with law;
e/ To grant and re-grant letters of confirmation of advertising contents for medical examination and treatment by traditional medicine; letters of confirmation of advertising contents of traditional medicines and adjustment of advertising contents of traditional medicines under the Ministry’s management in accordance with law;
g/ To direct, guide, and organize the implementation of mechanisms, policies, legal documents, professional regulations, and national technical regulations on traditional medicine and pharmacy, and combination of traditional medicine and pharmacy with modern medicine and pharmacy.
11. Regarding pharmaceuticals and cosmetics:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, professional regulations and national technical regulations on pharmaceuticals and cosmetics; and national standards on drugs; to promulgate and update the Vietnamese Pharmacopoeia and the Vietnamese National Drug Formulary;
b/ To formulate and promulgate, or submit to competent authorities for promulgation, a list of drugs and drug materials subject to special control; a list of orphan drugs; a list of essential drugs; a list of drugs subject to bidding; a list of drugs subject to centralized bidding; and a list of drugs subject to price negotiation; to declare a list of non-prescription drugs;
c/ To grant, extend, change, modify, supplement and revoke certificates of registration for circulation of drugs and drug materials; to grant certificates of pharmaceutical products; licenses for export and import of drugs, drug materials, and packaging in direct contact with drugs in accordance with law and in conformity with international practices;
d/ To grant through organization of examination, extend, adjust, modify, supplement and revoke pharmaceutical practice certificates; to grant, extend, adjust, modify, supplement and revoke certificates of eligibility for pharmaceutical business, and good practice certificates for drug and drug material production and trading establishments in accordance with law and in conformity with international practices. To announce the list of drug and drug material production and trading establishments; foreign drug and drug material preservation service establishments registered to supply drugs and drug materials to Vietnam; to assess the compliance with good manufacturing practices of foreign drug and drug material production establishments when registering drugs and drug materials for circulation in Vietnam in accordance with law;
dd/ To grant and revoke receipt numbers of declarations of imported cosmetic products; to approve changes to the contents announced on the declarations of cosmetic products; to grant, re-grant, adjust and revoke certificates of establishments meeting cosmetic good manufacturing practices (CGMP) in accordance with law;
e/ To manage the quality of drugs, drug materials and cosmetics; decide on the suspension of circulation and recall of drugs, drug materials and cosmetics in accordance with law; to coordinate with related agencies in preventing and combating acts of manufacturing and circulating fake, poor-quality, and unknown-origin drugs, drug materials and cosmetics, and preventing and combating smuggling of drugs, drug materials and cosmetics in accordance with law;
g/ To organize the drug information and pharmacovigilance system; to manage and implement drug information and drug advertising in accordance with law;
h/ To guide the implementation of drug bidding for disease prevention, and medical examination and treatment activities funded by the state budget, health insurance fund and other lawful revenue sources in medical establishments; to organize centralized procurement of drugs at the national level and assume the prime responsibility for drug price negotiations in accordance with law;
i/ To direct, guide and organize the implementation of regulations in the fields of pharmaceuticals and cosmetics and the rational, safe and effective use of drugs.
12. Regarding medical equipment and medical works:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, national standards, national technical regulations, strategies, policies and plans on medical equipment;
b/ To promulgate detailed regulations guiding the standards and norms for the use of specialized machinery and equipment serving non-business health activities; to issue a list of medical equipment subject to inspection and the inspection process for each type of medical equipment on the list;
c/ To grant, suspend, and revoke medical equipment circulation numbers; to grant and revoke certificates of free sale for medical equipment; to issue documents to revoke, and publicize documents on revocation of, medical equipment classification results; to grant medical equipment import licenses; to publicize information and dossiers of declaration of raw materials for the production of medical equipment and external quality assessment materials containing narcotics and precursors; to publicize the list of medical equipment whose circulation numbers have been revoked;
d/ To grant, re-grant, supplement, and revoke certificates of registration for medical equipment inspection services under the Ministry’s management as assigned in accordance with law; to publicize information and dossiers of declaration of eligibility for provision of medical equipment technical consulting services;
dd/ To assume the prime responsibility for, and coordinate with related agencies in, directing, guiding and organizing the implementation of legal documents, national standards and national technical regulations in the field of medical equipment;
e/ To assume the prime responsibility for, and coordinate with related agencies in, formulating and promulgating technical regulations and specific regulations on standards and norms for use of works belonging to non-business health establishments in accordance with law and the Ministry’s competence as assigned.
13. Regarding food safety:
a/ To assume the prime responsibility for formulating and promulgating national technical regulations for food and food products under the Ministry’s management as assigned; to promulgate national technical regulations or regulations on safety limits for product groups at the request of line ministries; to promulgate a list of additives and processing aids permitted for use in food;
b/ To formulate, and submit to competent authorities for promulgation, regulations on conditions for assurance of food safety applicable to establishments producing or trading in food and food products under the Ministry’s management as assigned, and street catering service and street food establishments;
c/ To assume the prime responsibility for implementing information, communication, and dissemination of knowledge and conducting education of law on food safety within the scope of the Ministry’s management;
d/ To assume the prime responsibility for, and coordinate with related ministries and sectors in, developing a food safety incident warning system; to specify the reporting of food safety incidents; to organize the monitoring, risk analysis, prevention, investigation and coordination to prevent food poisoning, and handle food safety incidents under the Ministry’s management;
dd/ To manage food safety throughout the process of production, preliminary processing, processing, preservation, transportation, export, import, and trading of food and food products under the Ministry’s management as assigned;
e/ To organize the receipt and management of dossiers, grant and revoke certificates of receipt of registration for food and food product declarations under the Ministry’s management as assigned; to issue certificates of advertising contents and certificates of free sale for food products in the fields under the Ministry’s management as assigned; to grant health certificates and other certificates for exported food products when requested by related organizations and individuals in accordance with law;
g/ To grant and revoke food safety eligibility certificates for establishments producing or trading in food and food products under the Ministry’s management as assigned; to grant and revoke certificates of establishments meeting food safety conditions and Good Manufacturing Practice (GMP) requirements with regard to health supplements in accordance with law;
h/ To designate, re-designate, suspend, and revoke decisions on designation of, food testing laboratories serving the state management work and laboratories conducting reference testing under the scope of the Ministry’s management;
i/ To designate/assign tasks, suspend, and revoke decisions on designation/ assignment of tasks to, state inspection agencies in charge of imported food safety with regard to products under the Ministry’s management;
k/ To direct and guide the implementation of legal documents, national standards, and national technical regulations on food safety under the Ministry’s state management;
l/ To synthesize, compile statistics and make periodical and extraordinary reports on food safety management on the basis of monitoring and synthesizing reports of line ministries and localities.
14. Regarding health insurance:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, policies and laws on health insurance; strategies and overall master plans on health insurance development;
b/ To assume the prime responsibility for, and coordinate with related ministries and sectors in, formulating and promulgating principles and criteria for developing lists of drugs and lists of medical equipment and medical technical services covered by health insurance; lists, rates and levels of, and conditions for payment of drugs, chemicals, medical equipment, and medical technical services covered by health insurance;
c/ To promulgate regulations on data sharing in the field of health insurance, the interconnection and use of para-clinical test results between health insurance-covered examination and treatment establishments in conformity with professional requirements;
d/ To issue according to the Ministry’s competence, or submit to competent authorities for issuance, solutions for ensuring the balance of the health insurance fund;
dd/ To direct and guide medical establishments, organizations, and individuals in implementing the law on health insurance.
15. Regarding the management of public employees working in the sectors of medicine, pharmacy, population and social work:
a/ To formulate, amend, supplement, and promulgate specific regulations on codes, professional title standards, and salary scales for specialized public employees working in the fields under the Ministry’s state management;
b/ To provide guidance on leading and managerial positions and job positions of holders of professional titles of public employees working in the fields of medicine, pharmacy, population and social work; the structure of public employees based on professional titles and the number of employees working in public non-business units of the health sector;
c/ To formulate and promulgate specific regulations on standards and conditions for consideration for promotion of professional titles of public employees working in the fields of medicine, pharmacy, population and social work to grade II and grade I in accordance with law; to organize the consideration of promotion of professional titles of public employees working in the fields of medicine, pharmacy, population, and social work in accordance with law;
d/ To assume the prime responsibility for, and coordinate with related agencies in, formulating and submitting to competent authorities for promulgation, regimes and policies for public employees and employees in the health sector, and amendments and supplementations thereto;
dd/ To provide detailed regulations on the content, program, form and duration of further training for specialized public employees workIng in the fields of medicine, pharmacy, population and social work according to the professional title standards of specialized public employees working in the fields of medicine, pharmacy, population and social work and guide and organize the implementation thereof.
16. Regarding training in health disciplines:
a/ To formulate and promulgate according to the Ministry’s competence, or submit to competent authorities for promulgation, strategies and plans on training in health disciplines, and particular mechanisms and policies in training in health disciplines, and guide the implementation thereof;
b/ To formulate and promulgate professional qualification standards to serve as a basis for formulating and developing training program standards and output standards of training programs of health disciplines at all levels; to coordinate with the Ministry of Education and Training in formulating training program standards and output standards for each discipline and training level of health disciplines;
c/ To formulate and promulgate conditions for assurance of the quality and output standards of training programs in specialized disciplines and continuous training in health disciplines;
d/ To manage the training in specialized disciplines continuous training in health disciplines in accordance with law;
dd/ To guide, examine and assess according to the Ministry’s competence the implementation of regulations on training in health disciplines; to examine and review the satisfaction of requirements on organization of practice training applicable to practice facilities of education institutions providing training in health disciplines;
e/ To provide for, guide, and organize exams and assessments for grant of practice licenses in health disciplines in accordance with law.
17. Regarding science, technology and innovation in the health sector:
a/ To formulate and submit to competent authorities for promulgation mechanisms, policies, strategies and plans on scientific research, technology development and innovation in the fields under the Ministry’s state management;
b/ To manage, guide and carry out biomedical researches on humans, research and development of new methods, techniques, technologies and products in the fields under the Ministry’s management;
c/ To guide and examine the implementation of regulations on performance of scientific and technological tasks; to carry out technology transfer and popularize and apply scientific research and technology development results in the fields under the Ministry’s management; to manage and use scientific and technological resources in the fields under the Ministry’s management as assigned;
d/ To organize the implementation of regulations on intellectual property and innovative activities under the Ministry’s management;
dd/ To manage the formulation and promulgation of national technical regulations in the fields under the Ministry’s state management in accordance with law; to guide, monitor and manage the popularization and application of national standards and national technical regulations in the fields under the Ministry’s state management;
e/ To organize the implementation of agreements on technical barriers to trade (TBT) in in the fields under the Ministry’s state management.
18. Regarding information technology application and digital transformation in the health sector:
a/ To formulate and promulgate, or submit to competent authorities for promulgation, strategies and plans on information technology application and development, e-transactions, information security and digital transformation in the health sector;
b/ To formulate and promulgate, or submit to competent authorities for promulgation, professional regulations, technical processes, national standards and national technical regulations on information technology application and development, e-transactions, and digital transformation in the fields under the the Ministry’s management, and assurance of health information security and safety in the cyber environment;
c/ To formulate, maintain, update, and organize the implementation of, the Ministry’s e-government architecture toward digital government; to formulate, manage, maintain, update, and ensure security and safety for, the national health information system and database, and health information systems; to manage, connect and share digital health data in accordance with law;
d/ To direct, guide, and organize the implementation of strategies, plans, regulations and technical processes on information technology application and development, artificial intelligence application, digital transformation and e-transactions in the fields under the Ministry’s state management, and assurance of cyber security and safety for health information systems nationwide in accordance with law.
19. To formulate programs and plans on health communications and education and provision of information about the health sector’s activities and direct, guide, organize and examine the implementation thereof.
20. To perform the state management of public services in the fields under the Ministry’s state management in accordance with law; to formulate and promulgate, or submit to competent authorities for promulgation, mechanisms and policies on provision of public non-business services in the fields under the Ministry’s state management; to promulgate techno-economic norms applicable to State-managed public non-business services; to set quality criteria and standards of public non-business services, and provide mechanisms for supervision, assessment and inspection of the quality of public non-business services and operational efficiency of public non-business units in the fields under the Ministry’s state management.
21. To guide and organize the implementation of regulations on management of prices of services, products and goods in the fields under the Ministry’s state management in accordance with law.
22. To assume the prime responsibility for, and coordinate with related agencies in, carrying out disaster and catastrophe prevention and control, and providing emergency aid and treatment for disaster and catastrophe victims.
23. To formulate, and organize the implementation of, plans on national reserves of medicines, chemicals, medical equipment, and epidemic, disaster and catastrophe prevention and control equipment according to the list of national reserves decided by the Government and in accordance with law.
24. To manage associations and non-governmental organizations operating in the fields under the Ministry’s state management in accordance with law.
25. To work out, and direct the implementation of, the Ministry’s administrative reform plan in line with objectives and contents of the Government’s overall state administrative reform program.
26. To undertake international cooperation and integration in the fields under the Ministry’s state management in accordance with law. To organize negotiation and conclusion of treaties in accordance with law and as authorized by competent state agencies; to assume the prime responsibility for, and coordinate with other authorities in, signing international agreements in the name of the Ministry in accordance with law; to participate in international organizations as assigned by the Government.
27. To manage the organizational apparatus, payroll of civil servants and the number of workers of the Ministry, job positions, structure of civil servant ranks, structure of public employees by professional title; to decide on rotation, transfer, appointment, relief from duty, leave from office, resignation, dismissal, secondment, commendation, disciplining and retirement of, and implementation of the salary regime and preferential treatment and training and further training for, cadres, civil servants, public employees and workers under the Ministry’s management in accordance with law.
28. To manage finances and assets assigned to the Ministry and organize the implementation of allocations from the state budget in accordance with law; to manage the Fund for Prevention and Control of Tobacco Harms in accordance with law.
29. To inspect and examine the performance of functions and tasks, exercise of powers and the implementation of policies and laws by agencies, organizations and individuals; to conduct administrative inspections of agencies, organizations and individuals under the Ministry’s management; to conduct specialized inspections in the fields under the Ministry’s state management in accordance with law. To organize prevention and combat of corruption and negative practices; to practice thrift and combat waste; to receive citizens, settle complaints, denunciations and petitions in the fields under the Ministry’s state management; to handle law violations or report to competent authorities for handling acts of law violation in the fields under the Ministry’s state management in accordance with law.
30. To formulate and promulgate the system of statistical indicators and reporting regime applicable to the health sector in accordance with law; to collect, synthesize, analyze, manage and archive statistical information on the health sector; to establish a national database of the health sector.
31. To perform other tasks and exercise other powers as assigned or vested by the Government or the Prime Minister or as provided by law.

15. The Agency for Disease Control.
16. The Agency for Maternal and Child Health.
17. The Department of Social Protection.
18. The Health Strategy and Policy Institute.
19. The National Health Information Center.
20. The Health and Lifestyle Newspaper.
The organizations referred to in Clauses 1 thru 17 of this Article are those assisting the Minister in performing the state management functions; the organizations referred to in Clauses 18 thru 20 of this Article are public non-business units performing the state management functions of the Ministry of Health.
The Department of Planning and Finance has 5 divisions.
The Minister of Health shall submit to the Prime Minister for promulgation the list of other public non-business units attached to the Ministry of Health under regulations.
The Minister of Health shall promulgate decisions defining the functions, tasks, powers and organizational structures of organizations and units of the Ministry of Health.
Article 4. Effect
This Decree takes effect on March 1, 2025.
The Government’s Decree No. 95/2022/ND-CP of November 15, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Health, ceases to be effective on the effective date of this Decree.
Article 5. Implementation responsibility
Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decree.-
