SUMMARY

Compel training institutions to have their educational quality inspected

The Government issued Resolution No. 99/NQ-CP on October 03, 2017, promulgating the Government’s Program of Action to implement Resolution No. 11-NQ/TW of June 03, 2017, of the 5th plenum of the XIIth Central Committee of the Communist Party of Vietnam, on completing the institution of the socialist-oriented market economy.

In which, the Government asked the Ministry of Education and Training to promulgate or submit to the Government for promulgation in 2019 mechanisms and policies to encourage and eventually compel training institutions to have their educational quality inspected by independent and prestigious educational quality inspection organizations in the country and the world. Also in 2019, the Ministry of Education and Training has to promulgate policies to step up the mobilization of all social resources for development of education…

The Ministry of Industry and Trade complete the institution of protection of consumer interests, properly and fully promoting the role of consumers and consumer interest protection associations; increasingly establishing and applying technical barriers to trade so as to rationally protect the domestic market against foreign acquisition and manipulation. The Ministry of Finance shall complete the legal system on price; ensuring the correct, full, public and transparent calculation of constituents of prices of essential commodities and public services. Not incorporating social policies in commodity and service prices; focusing on completing the management mechanism and prices of services which are shifted from being charged to being managed under the pricing mechanism.

This Resolution takes effect on the signing date.

THE GOVERNMENT

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to Resolution No. 11-NQ/TW of June 3, 2017, of the 5thplenum of the XIIthCentral Committee of the Communist Party of Vietnam, on completing the institution of the socialist-oriented market economy;

At the proposal of the Minister of Planning and Investment,

 

RESOLVES:

Article 1.To promulgate together with this Resolution the Government’s Program of Action to implement Resolution No. 11-NQ/TW of June 3, 2017, of the 5thplenum of the XIIthCentral Committee of the Communist Party of Vietnam, on completing the institution of the socialist-oriented market economy.

Article 2.This Resolution takes effect on the date of its signing.

Article 3.Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees and related organizations and individuals shall implement this Resolution.

THE GOVERNMENT’S PROGRAM OF ACTION

To implement Resolution No. 11-NQ/TW of June 3, 2017, of the 5thplenum of the XIIthCentral Committee of the Communist Party of Vietnam, on completing the institution of the socialist-oriented market economy

(Promulgated together with the Government’s Resolution No. 99/NQ-CP
of October 3, 2017)

Resolution No. 11-NQ/TW of June 3, 2017, of the 5thplenum of the XIIthCentral Committee of the Communist Party of Vietnam, on completing the institution of the socialist-oriented market economy (below referred to as Resolution No. 11-NQ/TW) set forth the general objective: “To further complete the socialist-oriented market economy institution, creating firm prerequisites for the successful building and synchronous and smooth operation of the socialist-oriented market economy; to contribute to the mobilization, distribution and most efficient use of all resources for promoting fast and sustainable socio-economic development to achieve the goal of a prosperous people and a strong, democratic, equitable and civilized country.”

Based on the guiding viewpoints, objectives, tasks and main solutions mentioned in Resolution No. 11-NQ/TW, the Government promulgates the Program of Action to implement the Resolution of the fifth plenum of the XIIthCentral Committee of the Communist Party of Vietnam, on completing the institution of the socialist-oriented market economy with the following specific contents:

I. OBJECTIVES AND REQUIREMENTS

1. To organize the profound grasp and strict and effective implementation of Resolution No. 11-NQ/TW, bringing about a significant change in the awareness and action of leaders, cadres, civil servants and public employees of all levels, sectors and the entire society about completing the institution of the socialist-oriented market economy.

2. To ensure the Party’s leadership and the State’s unified management in formulating and completing the institution of the socialist-oriented market economy.

3. To determine principal contents and tasks to be subject to direction by the Government as well as the ministries, sectors and localities for achievement of the general and specific objectives offset forth in Resolution No. 11-NQ/TW of June 3, 2017, of the fifth plenum of the XIIthCentral Committee of the Communist Party of Vietnam.

II. MAJOR TASKS AND SOLUTIONS

1. To continue implementing the Government’s resolutions and programs of actions on renewing the growth model, restructuring the economy and improving the business environment, and enhancing the national competitiveness.

The ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees shall further organize the comprehensive, drastic, practical and effective implementation of the Government’s Resolution No. 27/NQ-CP of February 21, 2017, promulgating the Program of Action to implement Resolution No. 05-NQ/TW of November 1, 2016, of the fourth plenum of the XIIthCentral Committee of the Communist Party of Vietnam and the National Assembly’s Resolution No. 24/2016/QH14 of November 8, 2016; the Government’s Resolution No. 35/NQ-CP of May 16, 2016, on support for and development of enterprises through 2020; the Government’s Resolution No. 19/2017/NQ-CP of February 6, 2017, on continued performance of major tasks and solutions to improve the business environment and raise the national competitiveness in 2017, with a vision toward 2020, and the Government’s relevant resolutions and programs of action.

Clear and urgent tasks assigned in compliance with Resolution No. 11-NQ/TW shall be performed in a prompt and effective manner without formulating any more schemes.

2. To study, grasp and achieve the unanimous perception of the socialist-oriented market economy

a/ The ministries, ministerial-level agencies and government-attached agencies shall closely coordinate with the Party’s organizations and committees in organizing, studying and grasping contents of Resolution No. 11-NQ/TW in the contingent of cadres, civil servants, public employees and laborers under their management;

b/ The Ministry of Information and Communications shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment, the Central Propaganda Department of the Central Committee of the Communist Party of Vietnam, the Vietnam Fatherland Front, and ministries, agencies, localities, media agencies and the press in, properly performing information and communications tasks so as to raise the awareness, create social consensus, promote the sense of responsibility of the leaders and efforts of all sectors, levels, business community and people to successful achieve the target of completing the institution of the socialist-oriented market economy.

3. To continue completing the institution of ownership and development of different economic sectors and various types of enterprises

a/ The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Promptly studying and promulgating or submitting for promulgation of, legal documents guiding the implementation of the Law on Support for Small- and Medium-Sized Enterprises in 2017-2018; formulating support policies for enterprises, cooperatives and cooperative unions to access capital, human resources training, technology transfer, and market development support.

- Formulating the scheme on completion of the institution of public investment management, covering allocation, appraisal, bidding, implementation and management of projects and assessment of public investment projects in order to increase the effectiveness of public investment, and submitting it to the Prime Minister in 2018.

- Preparing a resolution on continued attraction and renovation of the management and effective use of foreign investment capital during 2016-2020, with a vision toward 2025, thus contributing to green and sustainable development, and submitting it to the Government for promulgation in the first quarter of 2018.

b/ The Ministry of Finance shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Completing the institution and mechanism for stepping up the restructuring of state enterprises, renovation and raising of operation efficiency of state enterprises up to the international standards on business governance.

- Focusing on reviewing and proposing amendments and supplementations to the regulations on the state budget, public debts and public asset management, thereby ensuring strict management and effective use of public assets.

- Compiling, finalizing and submitting a list of assets to be put into business and those to be used for implementation of social policies to the Government in the fourth quarter of 2017.

c/ The Ministry of Agriculture and Rural Development shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Studying and devising a solution to renewing and raising the quality of forecasts on production and consumption of agricultural products.

- Formulating and submitting a scheme on development of 15,000 agricultural cooperatives and cooperative unions to operate efficiently during 2017-2020 to the Prime Minister for approval in 2018.

d/ The Ministry of Justice shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Formulating a scheme on full institutionalization of the property ownership right of organizations and individuals which is enshrined in the 2013 Constitution in order to ensure that the property rights are traded smoothly and effectively protected, and submitting it to the Prime Minister in 2019.

- Formulating a scheme on completion of the law on contracts and settlement of civil disputes by commercial arbitration, commercial conciliation and other dispute settling methods other than legal proceedings in a uniform and synchronous manner, ensuring the effect and protecting the property ownership right, and submitting it to the Prime Minister in 2018.

- Completing the institution and reforming the administrative procedures for notarization, certification and registration of security property, formulating and completing the law on property registration; developing a transparent, transferrable and accessible property registration system, particularly for real estate.

- Continuing to step up the provision of legal aid for enterprises, particularly small- and medium-sized enterprises, and provision of legal consultancy for startup enterprises and enterprises in localities with socio-economic difficulties or special socio-economic difficulties. To effectively implement the Program on provision of legal aid for enterprises mentioned in the 2017 Law on Support for Small- and Medium-Sized Enterprises.

dd/ The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Reviewing and adjusting the land price bracket, and submitting it to the Government for promulgation in the second quarter of 2019.

- Formulating a scheme on completion of the institution of public land management toward publicity, transparency and effectiveness, and submitting it to the Government in the first quarter of 2019.

e/ The Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

Formulating and finalizing a scheme on renewal of the management mechanism and reorganization of the system of public non-business units.

g/ The Ministry of Science and Technology shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

Finalizing policies on enhancement of the protection and enforcement of intellectual property rights; formulating and submitting the National Intellectual Property Strategy to the Prime Minister for approval in 2019.

4. To complete the institution of synchronous development of market elements and smooth operation of various types of markets

a/ The Ministry of Finance shall assume prime responsibility for, and coordinate with related ministries and sectors in:

- Studying and completing mechanisms and policies to raise the operation efficiency of the capital, stock, debt trading, insurance, accounting, auditing, tax consultancy and price appraisal service markets.

- Completing the legal system on price; ensuring the correct, full, public and transparent calculation of constituents of prices of essential commodities and public services; not incorporating social policies in commodity and service prices; focusing on completing the management mechanism and prices of services which are shifted from being charged to being managed under the pricing mechanism.

- Studying, formulating and completing policies and regulations on property tax, particularly tax on real estate; and on land-related financial policies toward stability, publicity, transparency and fairness.

- Completing the institution of and policies on development of the insurance market in agriculture, formulating and submitting a decree on agricultural insurance to the Government for promulgation in the fourth quarter of 2017.

- Studying the possibility to shift from the mechanism of allocation to the mechanism of order placement; from the provision of support to service providers to provision of support directly to essential commodity consumers and public service users.

b/ The State Bank of Vietnam shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Promulgating or submitting to the Government for promulgation policies on effective management of foreign currency and gold markets; increasing the State’s foreign-exchange reserves to suit practical conditions; administering appropriate credit solutions, focusing on priority fields, and at the same time raising the credit quality and facilitating assess to credit capital.

- Studying and revising or proposing the competent authority to amend and supplement legal documents so as to increase the independence of the State Bank of Vietnam in administering the monetary policies and ensure the implementation of the monetary policies for the purposes of inflation control, macroeconomic stability and effective coordination between monetary policies, fiscal policies and other policies.

- Regulating interest rates to suit the macro-economic developments, inflation rate and monetary market; continuing to regulate exchange rates to suit the domestic and international market developments as well as currency balances, macroeconomy and the objectives of the monetary policies.

- Completing the legal frameworks, mechanisms and policies on monetary and banking activities, particularly the legal frameworks on settlement of non-performing loans and restructuring of credit institutions.

- Drafting and submitting the Law Amending and Supplementing a Number of Articles of the Law on Credit Institutions to the National Assembly for promulgation.

c/ The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Promulgating or submitting to the Prime Minister for promulgation in 2019 mechanisms to promote the development of the commodity and service markets, including export and import markets, domestic markets and border trading markets.

- Completing the institution of protection of consumer interests, properly and fully promoting the role of consumers and consumer interest protection associations.

- Establishing and applying product and commodity quality, food hygiene and safety and environment standards under its state management as conformable with the domestic requirements and international commitments; increasingly establishing and applying technical barriers to trade so as to rationally protect the domestic market against foreign acquisition and manipulation.

- Studying, formulating and promulgating mechanisms and policies to promote the development and enhance the management of e-commerce business.

d/ The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

Submitting to the Government for promulgation in 2019 the mechanism for determining the value of land use rights according to the market mechanism in order to organize auction of land use rights and bidding of land-using projects and make agreements on transfer of land use rights.

dd/ The Ministry of Science and Technology shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Studying and completing mechanisms for renewing and vigorously and synchronously developing the science and technology market; actively implementing the Prime Minister’s Decision No. 2075/QD-TTg of November 8, 2013, approving the Program on development of the science technology market through 2020; increasing the operation capacity of the established science-technology enterprise nurseries; formulating mechanisms to promote the development of scientific and technological product consultancy, appraisal, brokerage and valuation services, industrial parks and hi-tech parks.

- Promulgating or submitting to the Government for promulgation in 2018 legal documents guiding the implementation of the 2017 Law on Technology Transfer, focusing on completing the mechanism to support and encourage enterprises to transfer, apply and renew technologies; raising the technology absorption capacity of enterprises; and enhancing domestic designing, engineering and manufacturing level.

- Promulgating or submitting to the Government for promulgation in 2019 technology import policies through 2025. Apply on a pilot basis the public-private partnership mechanism to encourage enterprises to implement technology research and development, renewal and innovation projects.

- Formulating or submitting to the Prime Minister for approval and organization of implementation in 2019 a scheme on intensification and renewal of measurement activities in order to help Vietnamese enterprises raise their competitiveness and ability for international integration; revising the regulations on standards and technical regulations, announcement of standard conformity, announcement of procedures for assessment of standard and technical regulation conformity toward raising the enterprises’ accountability for product quality; and intensifying the posterior inspection.

e/ The Ministry of Construction shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Promulgating or submitting to the Government for promulgation in 2019 the system of tools to manage and control the development of a stable and sustainable real estate market with a complete and synchronous structure which can be connected with other markets of the economy.

- Studying and completing the institution and suitable models to combine the process of industrialization with the urbanization and building of a new countryside.

g/ The Ministry of Labor, War Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Drafting the Labor Code (revised) for submission to the National Assembly during 2018 - 2019.

- Completing the policies on development of the labor market, ensuring their consistency and flexibility, facilitating the labor movement and rational labor distribution; forecasting and coupling the human resource supply with human resource demand in the national, regional and international labor markets; completing the regulations on conciliation and arbitration in the settlement of labor disputes, creating favorable conditions for enterprises to recruit and employ laborers.

- Formulating and submitting to the Government for approval contents of the reform of wage policies for the production and business sector under the market principles.

- Promulgating or submitting to the Prime Minister for promulgation mechanisms and policies to support the prevention and control of occupational accidents and diseases in high-risk sectors and fields; encouraging organizations and enterprises to establish, announce or use advanced and modern technical standards on occupational safety and health in the working process.

h/ The Ministry of Education and Training shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Promulgating or submitting to the Government for promulgation in 2019 mechanisms and policies to encourage and eventually compel training institutions to have their educational quality inspected by independent and prestigious educational quality inspection organizations in the country and the world.

- Promulgating or submitting to the Government for promulgation in 2019 policies to step up the mobilization of all social resources for development of education, increase efficiency of investment in education, set aside adequate budget funds for building better classrooms, subject classrooms, libraries and school toilets; improving accommodations and traveling conditions for boarding pupils in deep-lying and remote areas; and ensuring the equality in education and training; mobilizing the participation of the entire society to increase sources for investment in physical facilities and support activities for educational and training institutions, especially enterprises engaged in training activities; further promoting the development of non-public education and training institutions.

i/ The Ministry of Health shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Drafting a decree prescribing the mechanism of autonomy of public non-business medical establishments to replace Decree No. 85/2012/ND-CP of October 15, 2012, on operational and financial mechanisms applicable to public non-business medical establishments and prices of medical examination and treatment services of public medical examination and treatment establishments, and submitting it to the Government in 2018.

- Promulgating or submitting to the Government for promulgation mechanisms to renew and improve the system of health organizations in a streamlined, effective, coordinated and internationally integrated manner; identifying the types of medical services prioritized for use of investment capital from the state budget; types of charged services eligible for attraction of investment capital from the non-state budget sources, and submitting them to the Prime Minister in 2019.

- Accelerating the implementation of universal health insurance attached with the schedule of correct and full calculation of service charges, removing all barriers and discrimination, creating a healthy competition between public and private clinic facilities, particularly policies on hospital charges and health insurance and fixing of medical examination- and treatment-lines, and creating favorable conditions for attracting investment in the healthcare sector.

- Completing mechanisms and policies for bidding to purchase medicines, supplies, chemicals, medical equipment, ensuring the publicity, transparency, equality and efficiency.

- Strictly managing the import and sale of medicines inside and outside hospitals; putting an end to the sale of medicines in contravention of the regulations on medical prescription.

- Fully implementing the regulations on the right to distribute medicines, permitting no foreign enterprises to distribute medicines.

- Completing the policies on mobilization of social resources for health care and attraction of investment from the private sector.

- Formulating a scheme on development of medical tourism.

k/ The Ministry of Culture, Sports and Tourism shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Reviewing, studying and completing the institutions and policies to promote the vigorous development of tourist products and services suitable to the market mechanism so that the tourism sector will become a spearhead economy under the Strategy for Development of Vietnam’s Tourism through 2020, with a vision toward 2030, and the Politburo’s Resolution No. 08-NQ/TW of January 16, 2017.

- Approving and stepping up the implementation of the Program of Action to implement the Strategy for Development of Vietnam’s Cultural Industry through 2020, with a vision toward 2030.

5. To complete the legal framework for associating the economic growth with ensuring the sustainable development, social progress and equality, protecting the environment and coping with climate change

a/ The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

- Studying and promulgating mechanisms and policies to associate the socio-economic development with sustainable development and implementing the  green growth strategy; closely associating fast and sustainable economic development with sustainable social development, realizing social progress and equality, creating opportunities for all members of the society to equally participate in, and equitably enjoy benefits of, the development of the social security system.

-  Completing the institution of planning and finalizing the draft Planning Law, and submitting it to the National Assembly for approval in 2017.

- Studying and formulating a scheme on regional connection institution, and submitting it to the Prime Minister during 2019 - 2020.

- Finalizing the draft Law on Special Administrative-Economic Units, and submitting it to the National Assembly in the 4thsession in October 2017. Once the Law is promulgated, revising and finalizing the scheme on establishment of three special administrative-economic units (Van Don in Quang Ninh province, Bac Van Phong in Khanh Hoa province, and Phu Quoc in Kien Giang province), and reporting it to the Government for submission to the National Assembly Standing Committee in 2018.

b/ The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

- Reviewing, assessing and supplementing the legal framework on environmental protection and biodiversity conservation, formulating a scheme on formulation of a breakthrough mechanism for mobilization of resources, attraction of investment and mobilization of social resources for environmental protection, and submitting them to the Prime Minister during 2018 - 2020.

- Promulgating or submitting to the Government for promulgation mechanisms and policies to implement solutions to improving capacity and effectiveness of enforcement of the law on environmental protection and biodiversity conservation; zoning off, treating and rehabilitating polluted areas; supervising cross-border environmental pollution; and effectively coping with climate change.

c/ The Ministry of Culture, Sports and Tourism shall assume the prime responsibility for, and coordinate with related ministries and sectors in:

Further improving regulations, mechanisms and policies for, and taking synchronous solutions to promote, cultural development and building a comprehensively developed Vietnamese.

d/ The Ministry of Labor, War Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

Developing a diversified, multi-level and uniform social security system; mobilizing the participation of people from all walks of life, the community and society in implementing the social security policies; encouraging people to voluntarily participate in social security assurance.

6. To complete the institutions for stepping up and raising the effectiveness of international economic integration

a/ The Ministry of Foreign Affairs shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

- Completing the legal framework on the conclusion and implementation of international treaties and agreements; mechanisms for review and supervision of effective implementation by the ministries, sectors and localities; translating international integration commitments into domestic laws.

- Attaching importance to assessing the conformity of proposals on formulation of laws, ordinances and draft legal documents with treaties to which Vietnam is a contracting party.

- Broadening and deepening the relations with other countries and parties toward multilateralization and diversification; putting the relations into essence and cementing partnership relations with mutual benefits.

- Intensifying research into, providing information and making forecasts about the world economy in order to assist the Government, ministries and sectors in formulating and implementing strategies and plans on socio-economic development, taking appropriate solutions to cope with changes in the world economy, increasingly supporting localities and enterprises in increasing the effectiveness of the international economic integration.

- Accelerating political and diplomatic lobby campaigns so that other countries soon recognize Vietnam’s market economy status.

b/ The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

Continuing to complete the institutions and policies to encourage enterprises to participate in the regional supply chain, have clear orientations for choosing to and build domestic brands or participate in the regional supply chain, particularly in commodity groups with comparative advantages.

c/ The Ministry of Justice shall submit to the Government solutions to heighten the effectiveness of the state management of international cooperation and law and intensify judicial assistance activities.

7. To complete the institutions to associate economic growth with assurance of national defense and security

a/ The Ministry of National Defense shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

- Formulating and implementing a strategy for development of an advanced and modern national defense industry; completing the regulations on consolidation of national defense associated with development of culture and society in peacetime, the state of emergency and state of war; projects on social, cultural and economic development in defense areas, borderlines and strategic positions subject to national defense requirements.

- Specifying areas that are required to ensure security and national defense in each locality to serve as a basis for localities to implement their projects on socio-economic development and assurance of security and national defense.

b/ The Ministry of Public Security shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

- Ensuring the economic security in the process of building and completing the institution of the socialist-oriented market economy; preventing hostile elements from taking advantage of the building and completion of institutions for political transformation and economic manipulation. Assuming the prime responsibility for developing and implementing the Strategy for development of an advanced and modern security industry.

- Determining areas in each locality where security and national defense need to be ensured, ensuring social security, order and safety, and creating a favorable environment for production and business development.

c/ The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

- Formulating and submitting the Government for promulgation mechanisms and policies for economic development associated with national defense and security assurance; having mechanisms for mobilizing social sources to participate in developing border areas on land, at sea and on islands associated with firm protection of national sovereignty and improvement of people’s living standards.

- Formulating and submitting the Government for promulgation mechanisms and policies to develop economic-national defense zones and special policies for national defense and security enterprises, closely combining the national defense and security industry with economic industries in the system of national industrial policies.

8. To improve the capacity for formulation and implementation of institutions

a/ The Government Office shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

Further stepping up the reform of administrative procedures, particularly those for people- and enterprise-related issues, ensuring the publicity and transparency of their obligations and responsibilities so as to create a favorable environment for transactions and ensure the enforcement effect.

b/ The Ministry of Justice shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

- Studying, revising and renewing the formulation and promulgation of legal documents. Increasing the quality of legal documents, ensuring their transparency, consistency, stability and predictability.

- Formulating and submitting to the Government in 2017 a scheme on renewal and raising of effectiveness of the implementation of law in order to devise measures to ensure the law be implemented in a strict, thorough and accurate manner, satisfying the requirements of completing the institution of socialist-oriented market economy and building a law-ruled socialist state.

- Studying and submitting to the Government for promulgation in 2019 mechanisms for implementing measures to step up the judicial reform in the governmental agencies; improving the capacity, effect and effectiveness of reconciliation and commercial arbitration activities; promoting the independence of the civil and economic judgment execution systems.

- Reviewing and renewing the formulation and promulgation of legal documents on completion of the Party’s leadership mechanism in the law making process; completely and clearly determining the role and responsibilities of the Government in the entire process of examination and passage of draft laws and ordinances by the National Assembly and National Assembly Standing Committee; completing mechanisms for strict control, particularly prior control, of the formulation and promulgation of legal documents of ministries, ministerial-level agencies and local authorities.

c/ The Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with other ministries and sectors in:

Reviewing and restructuring the state apparatus toward streamlined organization and higher efficiency and effectiveness; completing the institutions of local administrations and relation between the Government and local administrations; renovating the criteria for and method of evaluating the performance of administrations at all levels as suitable to the institution of socialist-oriented market economy.

III. ORGANIZATION OF IMPLEMENTATION

1. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall, within the ambit of their functions, powers and tasks, formulate and promulgate plans for implementation of Resolution No. 11-NQ/TW and this Resolution in the fourth quarter of 2017.

2.  The Ministry of Justice shall assume the prime responsibility for, and coordinate with related agencies in, formulating and proposing to the Government and National Assembly for adjustment the 2018 law- and ordinance-making program, and the 2017 law- and ordinance-making program, paying attention to laws and ordinances which need to be promulgated or revised for completing the institution of socialist-oriented market economy in Vietnam.

3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees shall direct, inspect and urge the implementation of the Government’s Program of Action and program of action of each ministry, agency or locality; send annual reports on implementation results to the Ministry of Planning and Investment before December 10 for summing up and reporting to the Government.

4. The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with ministries, agencies and localities in, supervising and urging the implementation of this Program of Action, periodically reporting and proposing to the Government and Prime Minister necessary solutions to implement the Program of Action in a coordinated and effective manner; closely following relevant contents in the working programs of the Politburo, Secretariat, Central Committee of the Communist Party of Vietnam, National Assembly and National Assembly Standing Committee for reporting as required.

5. In the course of implementation of the Program of Action, if finding it necessary to amend and supplement specific contents of the Program, ministries, agencies and localities shall take the initiative in proposing  them to the Ministry of Planning and Investment for summing up and reporting to the Government for consideration and decision.-
