RESOLUTION

On promulgating the support policy for employees and employers affected by the COVID-19 pandemic from the Unemployment Insurance Fund

THE NATIONAL ASSEMBLY STANDING COMMITTEE

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Employment No. 38/2013/QH13;

Pursuant to the Resolution No. 30/2021/QH15 on the first session of the 15^th National Assembly;

Pursuant to the notice of the Political Bureau’s opinions in Document No. 1789-CV/VPTW dated September 11, 2021 and Document No. 1911-CV/VPTW dated September 23, 2021 of the Office of the Party Central Committee;

After considering the Government’s Report No. 32/TTr-CP dated September 21, 2021, Verification Report No. 13/BC-UBXH15-tm dated September 23, 2021 of the Social Commission;

RESOLVES:

Article 1. Support policy for employees affected by the COVID-19 pandemic

1. Use VND 30,000 billion from the Unemployment Insurance Fund’s surplus balance until the end of 2020 to support the following employees:

a) Those who are paying unemployment insurance premiums as of September 30, 2021 (excluding employees currently working at state agencies, political organizations, socio-political organizations, people’s armed forces units and public non-business units whose frequent expenditures are covered by the state budget).

b) Those who have stopped paying unemployment insurance premiums due to the termination of labor contracts or working contracts in the period of from January 01, 2020, until September 30, 2021, with the unemployment insurance premium payment period reserved in accordance with law regulations on employment, excluding persons entitled to enjoyment of monthly pensions.

2. This support policy shall be implemented from October 01, 2021 and completed by December 31, 2021.

Article 2. Support policy for employers affected by the COVID-19 pandemic

Employers specified in Article 43 of the Law on Employment (excluding state agencies, political organizations, socio-political organizations, people’s armed forces units and public non-business units whose frequent expenditures are covered by the state budget) that have been paying in unemployment insurance premiums before October 01, 2021 are allowed to reduce the contribution rate from 1% to 0% of the monthly wage fund of the employees obliged to participate in unemployment insurance within 12 months, from October 01, 2021 to the ends of September 30, 2022.

Article 3. Organization of implementation

1. The Government shall detail subjects entitled to the support specified in Articles 1 and 2 of this Resolution and the support levels, ensuring the principle of payment - enjoyment, sharing and fairness for employees and employers participating in unemployment insurance; direct the concerned ministries, branches and localities to implement the policy in a timely, transparent, public and effective manner, ensuring that the support shall be provided for the right beneficiaries.

2. The National Assembly Standing Committee, Ethnic Council, Social Commission, the Finance and Budget Committee, other committees of the National Assembly, National Assembly deputies’ delegations, National Assembly deputies shall monitor the implementation of this Resolution.

3. The Vietnam Fatherlands Front Central Committee, the Vietnam General Confederation of Labor, employers’ representative organizations, member organizations of the Front shall participate in the dissemination, mobilization, and supervision of the implementation of this Resolution.

            Article 4. Effect

This Resolution takes effect on the signing date.
