ORDINANCE
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE ORDINANCE ON OFFICIALS AND PUBLIC EMPLOYEES
Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam;
Pursuant to Resolution of the sixth session of the Xth National Assembly on its 2000 legislative program;
This Ordinance amends and supplements a number of articles of the Ordinance on Officials and Public Employees which was adopted on February 26, 1998 by the National Assembly’s Standing Committee.

This Ordinance amends and supplements a number of articles of the Ordinance on Officials and Public Employees which was adopted on February 26, 1998 by the National Assembly’s Standing Committee.
Article 1.- To amend and supplement a number of articles of the Ordinance on Officials and Public Employees as follows:
1. Article 17 shall be amended and supplemented as follows:
"Article 17.
Officials and public employees are not allowed to establish or participate in establishing, managing or running private enterprises, limited liability companies, joint stock companies, partnerships, cooperatives, private hospitals, private schools and private scientific research institutions.
Officials and public employees are not allowed to work as consultants for enterprises, business and/or service organizations and other organizations and individuals inside and outside the country on the work relating to State secrets, work secrets and tasks under their respective handling competence as well as other tasks where their consultancy may cause damage to the national interests.
The Government shall specify the consulting work of officials and public employees".
2. Article 19 shall be amended and supplemented as follows:
"Article 19.
The heads and deputy-heads of agencies as well as their spouses shall not be allowed to contribute capital to enterprises operating in the branches and trades over which they directly perform the State management".
Article 2.- The previous regulations which are contrary to this Ordinance shall all be annulled.
Article 3.-
1. The Government shall detail and guide the implementation of this Ordinance.
2. Basing themselves on this Ordinance, political organizations and socio-political organizations shall detail the implementation thereof by officials under their respective management.
