Based on the work program in 2012 of the branch of Labour - Invalids and Social Affairs and work direction of the Government Inspectorate, Ministry of Labour - Invalids and Social Affairs guides the contents of inspection of branch in 2012 as follows:
I. GENERAL OBJECTIVES
Inspection of the branch in 2012 needs to stick to the requirements of leadership and direction of the Ministry, the People s Committees of provinces and cities to achieve the objectives:
- Completion of the schemes, programs, and political tasks of the branch in the area and the whole country.
- Maintenance of social and political stability; increase of the effectiveness and efficiency of state management in the sectors under its management.
- Detection and timely correction of errors for the contents of its field of state management.
II. THE ORIENTATION
1. Inspection:
Based on the 2012 work Plan of the Ministry and the local direction, actively to build the plans of inspection and examination of the units, the Departments on the principles of sticking to political tasks of the sector, strengthen the coordination between ministries and units and departments to avoid overlapping, waste and inconvenience to the subjects. The specific contents:
1.1. Actively inspect and self-examine, review the implementation of preferential policies for those who have contributed to the revolution in the areas; focus on the certification of those who are enjoyed policies such as war invalids; youth volunteers, participants of resistance contaminated with toxic chemicals.
1.2. Inspect the implementation of labor law: Actively deploy the implementation of the release, recovery, analysis, processing of self-examination sheet of implementation of labor laws at enterprises, focusing on the enterprises of construction, mining, enterprises employing many workers such as textiles, footwear, processing aquatic products enterprises with many risks of occupational accidents and occupational diseases. Implement the inspection at the enterprises that did not report the results of self-examination by self-examination sheet or the enterprises having many errors.
- Survey the occupational accidents. The cases of serious occupational accidents must be reported immediately to the Ministry for review and processing and reporting to the Prime Minister.
- Continue to implement the direction of the Ministry on inspection, examination, correction of the management for foreign laborers working in Vietnam.
1.3. Inspect the implementation of policies for children, which focuses on policies for children who work early, children in especially difficult circumstances, children affected by violence...
1.4. Conduct the extensive inspection of vocational training for rural workers in accordance with Decision No.1956/QD-TTg on 27/11/2009 of the Prime Minister.
1.5. Implement the administrative inspection, anti-corruption for the organizations, individuals under management of the departments, strive to inspect from 10 to 20% of subordinate agencies and units; pay attention to the "re-inspection" in accordance with provisions of the Inspection Law in 2010.
2. The settlement of complaints, denunciations and reception of citizens
- This is an important task, so request the heads of units, the Directors of Departments to solve positively, definitely, according to law the complaint cases from the base, not to let stagnation and prolonging, causing adverse effects and unduly claims.
- Continue to reform administrative procedures; carry out publicly, democratically and improve efficiency in the reception of citizens and settlement of complaints and denunciations.
3. Construction of work force
- Consolidate and strengthen the inspection force of departments, arrange officials, inspectors fully to participate in courses of training, retraining organized by the Ministry of Labour - Invalids and Social Affairs or inspectorate of province, city; arrange officials, inspectors who have not been learned the basic inspection professional skill to be attend in the class of the basic inspection professional skill.
- Implement publicly and transparent operations of the units to create the unity, high internal consistency.
4. Information, report
Seriously implement the information and report as prescribed; it is considered as a criterion in assessing of the completion extent of the tasks of the units.
III. IMPLEMENTATIONORGANIZATION
Ministry of Labour - Invalids and Social Affairs requires Mr. Directors of Departments of Labor - Invalids and Social Affairs based on functions, tasks, powers and the actual situation to determine the work plan in 2012 of Departments’ Inspectorate; heads of the units based on functions, tasks, powers and the actual situation to determine the plans of inspection (for the units assigned to perform the specialized inspection function), examination of the units and report the plans of inspection, examination to the Ministry (through the Ministerial Inspectorate).
Require the comrades Directors of Departments of Labor - Invalids and Social Affairs, the Heads of units of the Ministry based on the inspection plan in 2012 of the Ministry of Labour - Invalids and Social Affairs to plan and coordinate with the Ministry’s Inspectorate for implementation organization to avoid overlapping.
The Ministerial Inspectorate shall synthesize and act as contact point to advise the Ministry’s leaders to direct the activities of inspection, examination, reception of citizens and settle complaints and denunciations of the whole sector.
