DECISION
On the implementation of agricultural insurance support policy

Pursuant to Law on Organization of the Government dated the June 19, 2015; the Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration, dated November 22, 2019;
Pursuant to the Law on Insurance Business dated December 9, 2000; and the Law on Amending and Supplementing a Number of Articles of the Law on Insurance Business dated November 24, 2010;
Pursuant to the National Assembly’s Resolution No. 32/2016/QH14 dated November 23, 2016, on further raising the capacity for and effectiveness of implementation of the national target program on building a new countryside associated with agriculture restructuring;
Pursuant to the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018, on agricultural insurance;
At the request of the Minister of Finance and Minister of Agriculture and Rural Development;
The Prime Minister hereby issues the Decision on the implementation of agricultural insurance support policy.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
This Decision prescribes the implementation of agricultural insurance support policy prescribed in the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018, on agricultural insurance including support-eligible organizations and individuals engaged in agricultural production; plants, livestock and cultured aquatic animals eligible for support; insured risks eligible for support; support levels; period of provision of support; geographical areas eligible for support; and levels of support from the central budget to local budgets for agricultural insurance premiums.
Article 2. Subject of application
This Decision applies to:
1. Organizations and individuals growing rice, rubber, pepper, cashew and coffee; raising buffaloes, cows, pigs, black tiger shrimps, white leg shrimps and pangasius as prescribed in Clause 2, Article 22 of the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018, on agricultural insurance.
2. Non-life insurance enterprises, branches of foreign non-life insurance enterprises and reinsurance enterprises established, organized and operating under the Law on Insurance Business and relevant law regulations.
3. Other agencies, organizations and individuals involved in the implementation of agricultural insurance support policy.
Chapter II
AGRICULTURAL INSURANCE SUPPORT POLICY
Article 3. Insured objects eligible for agricultural insurance premium support
1. Crop: rice, rubber, pepper, cashew and coffee.
2. Livestock: buffaloes, cows and pigs.
3. Aquatic animals: black tiger shrimps and white leg shrimps and pangasius.
Article 4. Agricultural insurance premium support levels
1. Individuals engaged in agricultural production being poor households, near-poverty households in accordance with the Government’s Decree No. 07/2021/ND-CP dated January 27, 2021, promulgating multidimensional poverty standards for the 2021-2025 period and other amending, supplementing, replacing documents (if any): Providing support at the maximum level in accordance with Clause 1, Article 19 of the Government’s Decree No. 58/2018/ND-CP and other amending, supplementing, replacing documents (if any).
2. Individuals engaged in agricultural production not being poor households, near-poverty households in accordance with regulation in Clause 1 of this Article: Providing support at the maximum level in accordance with Clause 2, Article 19 of the Government’s Decree No. 58/2018/ND-CP and other amending, supplementing, replacing documents (if any).
3. Organizations engaged in agricultural production: Providing support at the maximum level in accordance with Clause 3, Article 19 of the Government’s Decree No. 58/2018/ND-CP and other amending, supplementing, replacing documents (if any) when fully meeting the following requirements:
a) Being enterprises established in accordance with the Law on Enterprises or cooperatives established in accordance with the Law on Cooperatives;
b) Having contracts associated with agricultural products which are eligible for agricultural insurance support policy, and complying with regulations in Article 4 and Article 5 of the Government’s Decree No. 98/2018/ND-CP dated July 5, 2018, on policies to encourage the development of cooperatives and linkage in production and sale of agricultural products, and amending, supplementing or replacing documents (if any);
c) Having agricultural products which are entitled to agricultural insurance support policy and certified as meeting food quality and safety requirements by competent agencies, being recognized as hi-tech agricultural enterprises in accordance with law regulations on the criteria, competence, order and procedures for recognition of entities as hi-tech agricultural enterprises.
Article 5. Insured risks eligible for agricultural insurance premium support
1. For rice, rubber, pepper, cashew and coffee, insured risks eligible for insurance support shall include
a) Disasters for rice shall include storm, tropical low pressure, cyclone, lightning, heavy rain, flood, flash flood, inundation, landslide due to flood or water flow, land subsidence due to flood or water flow, water level rise, saltwater intrusion, hot spell, drought, cold, hail, hoarfrost, earthquake and tsunami. Disasters must be announced or certified by a competent state agency;
Disasters for rubber, pepper, cashew and coffee shall include storm, tropical low pressure, cyclone, lightning, flood, flash flood, inundation, hail, hoarfrost. Disasters must be announced or certified by a competent state agency.
b) Epidemics for rice shall include rice grassy stunt virus, rice ragged stunt virus, rice black-streaked dwarf virus, magnaporthe grisea, and bacterial leaf blight disease; and brown plant hopper, white-backed plant hopper; stem borers, small leaf rollers, caterpillars; rat. Epidemics must be announced or certified by a competent state agency.
Epidemics for rubber, pepper, cashew and coffee shall not be eligible for support.
2. For buffaloes, cows and pigs insured risks eligible for support shall include
a) Disasters shall include storm, tropical low pressure, cyclone, lightning, heavy rain, flood, flash flood, inundation, landslide due to flood or water flow, land subsidence due to flood or water flow, hot spell, drought, cold, hail, hoarfrost, earthquake and tsunami. Disasters must be announced or certified by a competent state agency.
b) Epidemics shall include Foot-and-mouth disease, blue ear in pigs (reproductive and respiratory syndrome in pigs), anthracnose, spirochetes. Epidemics must be announced or certified by a competent state agency.
3. For black tiger shrimps, white leg shrimps and pangasius, insured risks eligible for insurance support shall include:
a) Disasters shall include storm, tropical low pressure, cyclone, lightning, heavy rain, inundation, landslide due to flood or water flow, land subsidence due to flood or water flow, water level rise, saltwater intrusion, hot spell, drought, hail, earthquake and tsunami. Disasters must be announced or certified by a competent state agency.
b) Epidemics: No support shall be provided for epidemic-related risks for black tiger shrimps, white leg shrimps and pangasius.
Article 6. Geographical areas eligible for agricultural insurance premium support
1. For plants:
a) For rice: Thai Binh, Nam Dinh, Nghe An, Ha Tinh, Binh Thuan, An Giang and Dong Thap provinces
b) For rubber: Kon Tum, Gia Lai, Dak Lak, Binh Thuan, Binh Phuoc, Tay Ninh, Binh Duong and Dong Nai provinces.
c) For coffee: Son La, Kon Tum, Gia Lai, Dak Lak, Dak Nong, Lam Dong and Binh Phuoc provinces.
d) For pepper: Gia Lai, Dak Lak, Dak Nong, Binh Phuoc, Dong Nai and Ba Ria - Vung Tau provinces.
dd) For cashew: Gia Lai, Dak Lak, Lam Dong, Binh Thuan, Binh Phuoc and Dong Nai provinces.
2. For livestock:
a) For buffaloes and cows: The provinces and centrally-run cities of Ha Giang, Vinh Phuc, Hanoi, Thanh Hoa, Nghe An, Binh Dinh, Gia Lai, Dak Lak, Lam Dong, Dong Nai and Binh Duong.
b) For pigs: The provinces and centrally-run cities of Bac Giang, Hanoi, Thai Binh, Nam Dinh, Thanh Hoa, Nghe An, Binh Dinh, Dak Lak and Dong Nai.
3. For black tiger shrimps, white leg shrimps, pangasius: Ben Tre, Tra Vinh, Soc Trang, Bac Lieu and Ca Mau provinces
The provincial and centrally-run People’s Committees of the localities prescribed in Clause 1, Clause 2 and Clause 3 of this Article shall organize the selection of geographical areas eligible for agricultural insurance premium support as prescribed in Clause 2, Article 21 of the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018, on agricultural insurance.
Article 7. Period of provision of agricultural insurance premium support
The period of provision of agricultural insurance premium support shall from the effective date of this Decision to the end of December 31, 2025.
Article 8. Levels of support from the central budget to local budgets for agricultural insurance premiums
To apply the maximum support levels prescribed in the Decision No. 127/QD-TTg dated January 24, 2022 of the Prime Minister prescribing the principle of targeted support from the central budget to local budgets for implementation of social welfare policies issued by the Central level for the period of 2022-2025.
The provincial and centrally-run People’s Committees of the localities prescribed in Clauses 1, 2 and 3, Article 6 of this Decision shall be responsible for allocating local budget funds as agricultural insurance premium support in accordance with this Decision.
Chapter III
IMPLEMENTATION PROVISIONS
Article 9. Effect
1. This Decision takes effect from June 24, 2022 to December 31, 2025.
2. This Decision replaces the Decision No. 22/2019/QD-TTg dated June 26, 2019 of the Prime Minister on the implementation of agricultural insurance support policy and the Decision No. 03/2021/QD-TTg dated January 25, 2021 of the Prime Minister on amending and supplementing a number of articles of the Decision No. 22/2019/QD-TTg dated June 26, 2019 of the Prime Minister on the implementation of agricultural insurance support policy.
Article 10. Implementation responsibilities
1. The Ministry of Finance shall assume the prime responsibility for, and coordinate with relevant agencies in, summarizing, assessing and proposing the formulation of a draft Decision of this kind for the period after 2025.
2. The Minister of Finance, Minister of Agriculture and Rural Development, Heads of ministerial-level agencies and Government-attached agencies, and Chairpersons of provincial and centrally-run People’s Committees shall be responsible for implementing this Decision./.
