SUMMARY

STRENGTHEN TASKS AND POWERS OF VIETNAM GOVERNMENT PORTAL

This is the content at the Decision No. 06/2013/QD-TTg dated January 24, 2013 of the Prime Minister defining the functions, tasks, powers and organizational structure of Vietnam Government Portal.

At this Decision, beside previous regulations, the Prime Minister also supplements some tasks and powers for Vietnam Government Portal, such as: To assume the prime responsibility for, and coordinate with related agencies and organizations; To coordinate with related agencies and organizations in providing information for activities of the Government, the Prime Minister and the Government Office; To professionally and operationally coordinate with ministries, sectors, localities and related agencies and organizations in connecting and synchronizing the databases; To assume the prime responsibility for, and coordinate with ministries, sectors, localities and related agencies and organizations; To coordinate with the Government Office's units; To assume the prime responsibility for, and coordinate with related units in, organizing press conferences, press receptions and press interviews and so on.

Besides, the organizational structure of Vietnam Government Portal must have changes. In particular, units directly under Vietnam Government Portal are the Electronic Administrative and Cong Bao Department; the Planning and Finance Department; the Office; the Government Electronic Newspaper (with its resident agencies in Ho Chi Minh, Da Nang and Can Tho cities); the Multimedia Technology and Communication Center; the Electronic Data Center (instead of 8 units as in previous regulations).

This Decision takes effect on March 15, 2013 and replaces the Decision No. 83/2008/QD-TTg dated June 25, 2008.

THE PRIME MINISTER

Decision No. 06/2013/QD-TTg of January 24, 2013, defining the functions, tasks, powers and organizational structure of Vietnam Government Portal

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the Government's Decree No. 08/2012/ND-CP of December 16, 2012, promulgating the Government's Working Regulation;

Pursuant to the Government's Decree No. 74/2012/ND-CP of December 29, 2012, defining the functions, tasks, powers and organizational structure of the Government Office;

At the proposal of the Minister-Chairman of the Government Office,

The Prime Minister promulgates the Decision defining the function, tasks, powers and organizational structure of Vietnam Government Portal.

Article 1. Position and functions

1. Vietnam Government Portal is an electronic administrative information-integrating agency and a multimedia agency of the Government, which is placed under the Government Office and directly managed by the Minister-Chairman of the Government Office (below referred to as the Minister-Chairman).

2. Vietnam Government Portal functions to organize, manage and publish official information of the Government and the Prime Minister; acts as the focal point in connecting the Government's electronic administrative information network with those of ministries, ministerial-level agencies, government-attached agencies, People's Councils and People's Committees of provinces and centrally run cities (below referred to as ministries, sectors and localities), and related agencies and organizations; and integrates information on online public services of the Government.

3. Vietnam Government Portal is an administrative organization, having the legal entity status, a seal with the national emblem and a state treasury account, and operating funds assured by the state budget.

Article 2. Tasks and powers

Vietnam Government Portal shall assist the Minister-Chairman in performing the following specific tasks and powers:

1. To assume the prime responsibility for, and coordinate with related agencies and organizations in, submitting to the Minister-Chairman for approval according to his/ her competence or to the Prime Minister for approval strategies, important plans and projects of Vietnam Government Portal; to coordinate with related agencies and units in organizing the implementation after they are approved.

2. To coordinate with related agencies and organizations in providing information for activities of the Government, the Prime Minister and the Government Office; to act as the focal point in organizing, managing and publishing official information of the Government, the Prime Minister and the Government Office on the Government's electronic paper and the website of the Government Office.

3. To professionally and operationally coordinate with ministries, sectors, localities and related agencies and organizations in connecting and synchronizing the databases (not classified as state secrets), which are integrated in the Government Electronic Data Center; to standardize applied software, exploit the national information resources; to exploit, receive, integrate and fully and promptly update different types of information (not classified as state secrets); to ensure compatibility and smoothness in the course of information sharing and exchange in conformity with the administrative reform program, meeting the requirements of the Government's and the Prime Minister's direction and administration and the e-government building roadmap.

4. To assume the prime responsibility for, and coordinate with ministries, sectors, localities and related agencies and organizations in, integrating information on online public services of the Government.

5. To coordinate with the Government Office's units in exploiting, receiving, processing and fully and promptly updating different types of information (not classified as state secrets) for performing assigned functions, | tasks and powers in accordance with law.

6. To assume the prime responsibility for, and coordinate with related units in, organizing press conferences, press receptions and press interviews for the Prime Minister, Deputy Prime Ministers and leaders of the Government Office; to perform the tasks of reviewing newspapers and summarizing press information; to propose the Prime Minister and Deputy Prime Ministers to assign ministries, sectors, localities and agencies to examine and report on issues reported by the press; to coordinate with related units in dealing with matters reported by the press as directed by the Prime Minister or Deputy Prime Ministers.

7. To organize the management and operation of the Government's electronic newspaper, the Government Office's website and other component websites in accordance with law.

8. To organize online exchanges, briefings and dialogues and other forms of interaction with the aid of information and communication technology between the Government, the Prime Minister, ministries, sectors, localities and related agencies or organizations and people.

9. To receive reports and proposals sent by organizations and individuals via internet to the Government, the Prime Minister and state administrative agencies and send them to competent agencies or organizations, and
request the settlement thereof and replies in accordance with law.

10. To design the technological, technical and artistic structure of Vietnam Government Portal and its information and data storage capacity; to diversify contents and forms of operation and multimedia applications and
communication products with a view to raising the capacity of disseminating the Party's lines and policies and the State's laws and
information on the domestic and international socio-economic situation, effectively serving the Government's and the Prime Minister's direction and administration.

11. To assume the prime responsibility for, and coordinate with related agencies and organizations in, managing, publishing and distributing printed and electronic Cong Bao (Official Gazette) of the Socialist Republic of Vietnam.

12. To manage and operate the public-duty email system of the Government on the internet and the Government Electronic Data Center and technological infrastructure and special-use technical equipment.

13. To manage and implement the assigned investment and construction projects in accordance with law; to give advice, design and appraise projects related to the professional areas of the system of websites/portals of ministries, sectors, localities and related agencies and organizations when so requested; to participate in the professional appraisal of other important projects assigned by the Minister-Chairman.

14. To organize training and instruction on electronic administrative operations related to the operation of Vietnam Government Portal in accordance with law.

15. To research and apply scientific and technical advances to raise the operation effectiveness of Vietnam Government Portal.

16. To implement international cooperation in the fields of operation of Vietnam Government Portal in accordance with law.

17. To assume the prime responsibility for, and coordinate with the Government Office's units and related agencies in, ensuring network confidentiality and safety as well as information security of Vietnam Government Portal.

18. To provide added-value services in accordance with law and under the guidance of the Ministry of Finance without affecting the assigned political tasks.

19. To manage the organizational apparatus and payroll; to apply the wage regime and preferential treatment, commendation and disciplinary regimes and policies to its civil servants, public employees, laborers and collaborators in accordance with law.

20. To manage and use the assigned assets, allocated funds and other financial sources in accordance with law.

21. To perform other tasks and powers assigned by the Prime Minister or the Minister-Chairman.

Article 3. Organizational structure and payroll

1. Vietnam Government Portal has the Director General and Deputy Directors General.

The Director General of Vietnam Government Portal (below referred to as the Director General) is appointed, relieved from duty or dismissed by the Minister-Chairman; is answerable to the Minister-Chairman, the Prime Minister and law for the entire operation of Vietnam Government Portal.

The Deputy Directors General are appointed, relieved from duty or dismissed by the Minister-Chairman in accordance with law; are answerable to the Director General and the Minister-Chairman for their respective assigned working fields.

The Director General or a Deputy Director General, as assigned, concurrently holds the post of Editor-in-Chief of the Government Electronic Newspaper.

2. Organizational structure

a/ The Electronic Administrative and Cong Bao Department;

b/ The Planning and Finance Department;

c/ The Office;

d/ The Government Electronic Newspaper (with its resident agencies in Ho Chi Minh, Da Nang and Can Tho cities);

dd/ The Multimedia Technology and Communication Center;

e/ The Electronic Data Center.

The units specified at Points a, b and c of this Clause are administrative organizations, and the units specified at Points d, dd and e are non-business units.

The Government Electronic Newspaper is organized and operates after the model of press, information and communications agency; is subject to the information and communication state management by the Ministry of Information and Communications n accordance with law.

3. Depending on the development requirements of Vietnam Government
portal, its Director General may propose the Minister-Chairman to report to the Prime Minister for decision the establishment, merger, dissolution or renaming of the units specified in Clause 2 of this Article.

4. The Minister-Chairman shall define the functions, tasks, powers and organizational structure of the Government Electronic Newspaper. The Director General shall define the functions, tasks and powers of other units of Vietnam Government Portal; appoint, relieve from duty or dismiss leaders of units of Vietnam Government Portal in accordance with law. When necessary, the Director General may propose the Minister-Chairman to decide on the establishment of sections of units specified in Clause 2 of this Article.

5. The civil servant and public employee payroll of Vietnam Government Portal is decided by the Minister-Chairman in accordance with law.

Article 4. Effect

This Decision takes effect on March 15, 2013, and replaces the Prime Minister's Decision No. 83/2008/QD-TTg of June 25, 2008, defining the functions, tasks, powers and organizational structure of Vietnam Government Portal.

Article 5. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People's Councils and People's Committees of provinces or centrally run cities, the Director General of Vietnam Government Portal and related agencies and organizations shall implement this Decision.-
