DECISION

On launching the Secretariat for the Political Declaration on establishing the Just Energy Transition Partnership

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated June 19, 2015, and the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Government’s Decree No. 39/2022/ND-CP dated June 18, 2022, on promulgating the Working Regulation of the Government;

Pursuant to the Prime Minister’s Decision No. 2157/QD-TTg dated December 21, 2021, on establishing a National Steering Committee to implement Vietnam's commitments at the 26^th Conference of the Parties to the United Nations Framework Convention on Climate Change (COP26 Steering Committee), and Decision No. 840/QD-TTg dated July 14, 2023, on consolidating members of COP26 Steering Committee;

Pursuant to the Prime Minister’s Decision No. 2201/QD-TTg dated December 26, 2021, on the promulgation of the Operation Regulation of the COP26 Steering Committee;

Based on the Political Declaration on establishing the Just Energy Transition Partnership between Vietnam and developed partners (JETP);

At the proposal of the Minister of Natural Resources and Environment.

DECIDES:

Article 1. To launch the Secretariat for the JETP (hereinafter referred to as the Secretariat), including the following members:

1. Head of the Secretariat: Mr. Dang Quoc Khanh - Minister of Natural Resources and Environment.

2. Deputy Heads of the Secretariat:

- The Deputy Minister of the Ministry of Natural Resources and Environment shall act as the Deputy Head of the Standing Secretariat.

- Representatives of Deputy Ministers of Industry and Trade, Planning and Investment, and Finance shall act as Deputy Heads of the Secretariat.

3. The Secretariat’s members include representatives of Departments/Agencies under the Government Office; Ministries of Natural Resources and Environment, Industry and Trade, Planning and Investment, Finance, Justice, Transport, Agriculture and Rural Development, Labor, Invalids and Social Affairs, Science and Technology, Public Security; the State Bank of Vietnam; representatives of leaders of the Commission for the Management of State Capital at Enterprises.

Article 2. Functions of the Secretariat

The Secretariat is a working group to assist the Prime Minister - Head of the COP26 Steering Committee in coordinating to settle matters related to the JETP Declaration, and at the same time coordinating with the Group of International Partners in the implementation of the JETP Declaration.

Article 3. Duties and powers of the Secretariat

1. To advise the Prime Minister - Head of the COP26 Steering Committee in directing, administering and handling the implementation of the JETP Declaration, including:

a) Developing and implementing a Resource Mobilization Plan for JETP implementation in accordance with the JETP Declaration for implementation in the next 5 years at least; revised resource mobilization plan (if any) on the basis of Vietnam's investment and policy development needs related to just energy transition goals.

b) Synthesizing information, reports and proposals and recommendations related to the implementation of JETP to the Prime Minister, including requesting relevant ministries, sectors, localities, agencies and organizations to provide information and coordinate in performing tasks of the Secretariat; organizing regular evaluation of the implementation of the objectives stated in the JETP Declaration, and recommending modifications to such goals in case of necessity.

c) Urging and monitoring financial and technical support from the Group of International Partners, the Glasgow Financial Alliance for the Net Zero Emissions Target (GFANZ) and others.

d) Urging to resolve issues about processes and procedures for organizations and individuals prosing programs and projects participating in the implementation of the JETP resource mobilization plan and supervising the implementation of the selected program or project.

dd) Coordinating with representatives of the Group of International Partners in implementation of JETP; organizing a forum for exchange and discussion between ministries and sectors with the Group of International Partners, GFANZ and concerned parties in the process of implementing JETP.

e) Carry out communication activities and disseminate information on the implementation of the JETP Declaration.

g) Reporting periodically or irregularly at the request of the Prime Minister - Head of the COP26 Steering Committee.

2. To perform other related tasks assigned by the Prime Minister or the Head of the Steering Committee.

3. The Chairperson and Deputy Head of the Standing Secretariat shall use the seal of the Ministry of Natural Resources and Environment; other Deputy Heads shall use the seals of their ministries in dealing with tasks under the Secretariat’s duties.

Article 4. Standing agency and working groups supporting the implementation of JETP

1. The Ministry of Natural Resources and Environment is the standing agency of the Secretariat, using its apparatus to carry out the support, and is guaranteed in terms of resources, people, facilities and working facilities.

2. Working groups supporting the implementation of JETP include:

a) General Group: Established by the Minister of Natural Resources and Environment, with the Head is the Deputy Minister of Natural Resources and Environment.

b) Institution, Policy and Investment Group:  Established by the Minister of Planning and Investment, with the Head is the Deputy Minister of Planning and Investment.

c) Technology and Energy Group: Established by the Minister of Natural Resources and Environment, of which the Leader is the Deputy Minister of Natural Resources and Environment.

d) Finance Group: Established by the Minister of Finance, of which the Leader is the Deputy Minister of Finance.

Concerned ministries and agencies shall appoint staff with appropriate expertise to participate in working groups at the request of the Leaders.

3. The Secretariat may mobilize scientists and consultants to support and assist the Secretariat when necessary.

Article 5. Funding

Funding for the operation of the Secretariat and working groups to support the implementation of the JETP Declaration specified in Clause 2, Article 4 of this Decision shall be included in the annual state budget estimates of that ministry or agency and mobilized from international partners as prescribed.

Article 6. Effect

1. This Decision takes effect on the date of its signing.

2. Ministers and Heads of ministerial-level agencies and government-attached agencies, and the Secretariat’s members shall implement this Decision.
