Circular 25/2025/TT-BNV amend Circular 28/2021/TT-BLDTBXH regarding the regimes for employees subject to occupational accidents and diseases

CIRCULAR

Amending and supplementing Clause 2 Article 5 of Circular No. 28/2021/TT-BLDTBXH dated December 28, 2021, of the Minister of Labor, Invalids and Social Affairs, detailing and guiding a number of articles of the Law on Occupational Safety and Health regarding the regimes for employees subject to occupational accidents and diseases

Pursuant to the Law on Occupational Safety and Health dated June 25, 2015;

Pursuant to Decree No. 25/2025/ND-CP dated February 21, 2025, of the Government, defining the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Director of the Employment Department;

The Minister of Home Affairs promulgates the Circular amending and supplementing Clause 2 Article 5 of Circular No. 28/2021/TT-BLDTBXH dated December 28, 2021, of the Minister of Labor, Invalids and Social Affairs, detailing and guiding a number of articles of the Law on Occupational Safety and Health regarding the regimes for employees subject to occupational accidents and diseases.

Article 1. To add Point e Clause 2 Article 5 of Circular No. 28/2021/TT-BLDTBXH dated December 28, 2021, of the Minister of Labor, Invalids and Social Affairs, detailing and guiding a number of articles of the Law on Occupational Safety and Health regarding the regimes for employees subject to occupational accidents and diseases:

“e. For non-commissioned officers and soldiers of the People’s Army; non-commissioned officers and conscripts of the People’s Public Security forces; military, public security, and cipher students currently studying and receiving living allowances, the monthly salary shall be determined as the salary serving as the basis for social insurance premium payment at the time of occurrence of the occupational accident or at the time of determination of the occupational disease.”

Article 2. Effect and implementation responsibility

1. This Circular takes effect from January 1, 2026.

2. Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, heads of organizations established by the Government or the Prime Minister that are not public non-business units, Chairpersons of the People’s Committees of provinces and centrally run cities, and relevant agencies, organizations, and individuals shall be responsible for the implementation of this Circular.

3. In the course of implementation, if any difficulties arise, they should be reported to the Ministry of Home Affairs and the sectoral managing ministries for guidance and resolution./.
