THE MINISTRY OF LABOR – INVALIDS AND SOCIAL AFFAIRS
Circular No.13/2016/TT-BLDTBXH dated June 16, 2016 of the Ministry of Labor, Invalids and Social Affairs on promulgation of the list of occupations bound by strict requirements for occupational safety and hygiene
Pursuant to the Law on occupational safety and hygiene No. 84/2015/QH13 dated June 25, 2015;
Pursuant to the Government’s Decree No. 106/2012/ND-CP dated December 20, 2012 on the functions, missions, authority and organizational structure of the Ministry of Labor - Invalids and Social affairs;
At the request of the Head of the Department of Work safety,
Basing on the opinions of ministries managing relevant sectors and fields, the Minister of Labor - Invalids and Social affairs promulgates the Circular that defines the list of occupations bound by strict requirements for occupational safety and hygiene.
Article 1. List of occupations bound by strict requirements for occupational safety and hygiene
1.This Circular is enclosed with the List of occupations bound by strict requirements for occupational safety and hygiene.
2.This Circular applies to entities as stated in Article 2 of the Law on occupational safety and hygiene, except Vietnamese workers working overseas on a contract basis.
Article 2. Implementation
1.This Circular takes effect on August 01, 2016. The list of occupations bound by strict requirements for occupational safety and hygiene under this Circular shall replace the list of occupations bound by strict requirements for occupational safety and hygiene under the Circular No. 27/2013/TT-BLDTBXH dated October 18, 2013 by the Ministry of Labor - Invalids and Social affairs.
2.The list of occupations bound by strict requirements for occupational safety and hygiene under the Circular No. 27/2013/TT-BLDTBXH dated October 18, 2013 by the Ministry of Labor - Invalids and Social affairs remains in effect until July 31, 2016.
3.Difficulties ensuing shall be reported to the Ministry of Labor - Invalids and Social affairs for solutions./.

APPENDIX
LIST OF OCCUPATIONS BOUND BY STRICT REQUIREMENTS FOR OCCUPATIONAL SAFETY AND HYGIENE
(Enclosed to the Circular No. 13/2016/TT-BLDTBXH dated June 16, 2016 by the Ministry of Labor - Invalids and Social affairs)
1. Manufacturing, assembling, operating, maintaining, repairing, dismantling of machinery and equipment, examining and verifying of occupational safety techniques, supervising of operations thereof, in accordance with the list of machinery, equipment, materials and substances bound by strict requirements for occupational safety and hygiene as promulgated by the Ministry of Labor - Invalids and Social affairs.
2.Manufacturing, using, storing and transporting of dangerous and hazardous chemicals as classified by the Globally Harmonized System of Chemical Classification and Labeling.
3.Testing, manufacturing, using, storing and transporting of explosives and explosive materials (e.g. detonator, detonating cord, safety fuse, etc.)
4.Operating, maintaining, repairing, dismantling, examining and supervising of building machinery and equipment such as: pile drivers, pile pressing machines, pile drilling machines, machine hammers, sludge dredging vessels and machines, stator or plaster pumps, plaster or concrete mixers, building material crushing and conveying plants, powered shovels, excavators, bulldozers, concrete vibrating motors, hydraulic jacks, self-dumping trucks with load capacity of over 5 tons.
5.Assembling, operating, maintaining, repairing and cleaning of grinding machines, sawing machines, milling machines, planning machines, lathe machines, cutting machines, tearing machines, punching machines, shaping machines, material feeding machines, blending and mixing machines, rolling machines, centrifugal machines, drying machines, sorting machines, pressing machines, paper machines, roll forming machines, laminating machines, wrapping machines, packing machines, polishing machines, conveyor belts, water guns, pneumatic guns, industrial printing machines.
6.Mould making, refining, rolling, mounding, cleaning, plating and polishing of metals, cleaning of metal surface; ore refining, coke refining; performing of jobs at cement-producing rotary kilns, furnaces or combustion chambers for burning of refractory materials and building materials or refining of calcium carbide; operating, repairing, examining, supervising, feeding of materials, discharging of products, wastes from incinerators, kilns, furnaces.
7.Working at height over 2 meters above the ground, on mobile platforms or at precarious places.
8.Working on river, at sea and under water.
9.Operating, repairing, maintaining and examining of machinery and equipment in caves, mines, ship’s holds and water transport.
10.Working in contact with ionizing radiation.
11.Working in contact with electromagnetic currents at high frequency bands from 30 to 300 GHz.
12.Working in places that lack oxygen or potential release hazardous gases such as vaults, tunnels, tanks, wells, sewers and underground works, sewage and waste treatment facilities.
13.Industrial cleaning, environmental cleaning, cage cleaning.
14.Geological surveying, topographic surveying, marine surveying, geophysical surveying; surveying, exploring, extracting of minerals and petroleum; manufacturing, using, operating, maintaining and repairing of buildings, equipment, chemicals and solutions for the extraction of minerals, petroleum and petroleum products at sea and on land.
15.Direct engagement in construction works that include the erection and installation of equipment in newly built premises; repairing, renovating, relocating, restoring, demolishing and maintaining of buildings.
16.Installing, operating, maintaining and repairing of electrical equipment; installing, operating, maintaining and repairing of electrical systems.
17.Welding and cutting of metals./.
