RESOLUTION
On the 8th session of the XVth National Assembly
________________
THE NATIONAL ASSEMBLY
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law No. 57/2014/QH13 on Organization of the National Assembly, which had a number of articles amended and supplemented under the Law No. 65/2020/QH14;
Pursuant to the results of the 8th session of the XVth National Assembly, held from October 21, 2024, to November 13, 2024, and from November 20, 2024, to November 30, 2024;
At the proposal of the National Assembly Standing Committee and the opinions of the National Assembly deputies,
RESOLVES:
1. The National Assembly adopts 18 laws and 21 resolutions; provides initial opinions on 10 draft laws (list attached).
The National Assembly Standing Committee, the Government, the Supreme People's Court, the Supreme People's Procuracy, and relevant agencies are assigned to promptly implement the laws and resolutions adopted at the 8th session, ensuring a close connection between law-making and law enforcement, in a fair, strict, consistent, timely, effective, and efficient manner; study, explain, and incorporate the opinions of the National Assembly deputies to finalize the draft laws on which the National Assembly has provided opinions; and urgently prepare the contents to be submitted to the National Assembly at the 9th session of the XVth National Assembly, ensuring quality and timeliness. Concurrently, the Government shall direct relevant ministries and agencies to continue to comprehensively study and amend the Law on Accounting, the Law on the State Budget, the Law on Management and Use of Public Assets, and the Law on Tax Administration, and report to the National Assembly at its 9th session in accordance with the Political Bureau’s conclusion, the National Assembly’s resolutions, and the National Assembly Standing Committee’s Plan No. 81/KH-UBTVQH15.
2. The National Assembly highly appreciates the drastic and effective leadership, administration, and implementation of tasks and solutions by the Government, the Prime Minister, ministries, sectors, and localities; commends the efforts of the business community and the people for successfully achieving and exceeding numerous targets and tasks for socio-economic development and the state budget in 2024.
The Government, in coordination with relevant agencies, shall continue to implement synchronously, promptly, and comprehensively the objectives, tasks, and solutions set forth by the Party, the National Assembly, and the Government, striving to achieve the highest possible targets in the 2025 Socio-Economic Development Plan and the 2021-2025 Five-Year Plan. At the same time, they shall effectively implement the tasks and solutions in the Government's reports and proposals submitted to the National Assembly.
3. The National Assembly requests the Government, the Prime Minister, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, ministries, central agencies, and local administrations to thoroughly grasp the requirements for reform in the development and promulgation of legal normative documents, specifically:
a) To submit for promulgation and to promulgate legal normative documents within their respective authority, in accordance with the directives of the Party and the National Assembly regarding the reform of thinking, methods, and legislative processes, ensuring the requirements of state management, encouraging innovation, unleashing productive capacity, and mobilizing all resources for development; to resolutely abandon the mindset of "prohibiting what cannot be controlled"; to ensure that legal provisions are stable in the long term, transparent, accessible, adaptable to changes in practice, systematic and meticulous, contributing to building a progressive, harmonious, and developing society;
b) To further tighten discipline and order, to strengthen control over power in law-making, to uphold the responsibility of leaders and host agencies in each phase of the process. To promptly detect and severely handle all acts of corruption, waste, negativity, and the inclusion of group interests and local interests within legal normative documents, in accordance with the Political Bureau’s Regulation No. 178-QD/TW on controlling power, prevention, and combating of corruption and negativity in the work of law-making;
c) To urgently research and promptly amend the Law on Promulgation of Legal Documents, and other documents under their authority, in order to concretize the direction of reform in the development and promulgation of legal normative documents, ensuring the synchronicity and uniformity of the legal system, and the promptness, proactivity, and creativity of the relevant stakeholders; to proactively, actively, and promptly establish a legal framework for new issues, new trends, and issues arising in practice for which there are no regulations, particularly those related to the Fourth Industrial Revolution, artificial intelligence, digital transformation, green transition, and the circular economy, creating a legal framework for the successful implementation of the digital transformation revolution, creating breakthroughs for the development of the country in the following years.
4. Regarding the prevention and combating against crime and legal violations, prevention, detection, and handling of corruption, waste, and negativity, and the work of investigation, prosecution, adjudication, and enforcement of judgments, the National Assembly requires:
a) The Government, the Supreme People’s Court, the Supreme People's Procuracy, and relevant agencies to continue to effectively implement the targets, tasks, and solutions according to Resolution No. 96/2019/QH14 and other resolutions of the National Assembly. To continue to review the legal provisions in the fields of investigation, prosecution, adjudication, and enforcement of judgments; bidding, auctions, basic construction investment, land, minerals, finance and banking, petroleum, electricity, etc. and other fields prone to corruption, negativity, and waste; to promptly identify regulations that are no longer appropriate, overlapping, or inconsistent, to amend and supplement them within their authority or to propose amendments and supplements to make them appropriate; and to invest resources to effectively implement the aforementioned;
b) The Government, the Prime Minister, ministries, and sectors to strengthen effective solutions to more effectively prevent and combat all types of crime, especially drug-related crimes, property fraud, child abuse, tax evasion, illegal mineral exploitation, and high-tech crimes, etc. To strengthen state management, inspection, examination, and auditing to prevent corruption, waste, and negativity; to recover assets obtained through corruption. To direct the resolution of inadequacies in the assessment and valuation of assets; to continue to ensure discipline and order, and to improve the effectiveness and efficiency of the enforcement of judgments;
c) The Supreme People’s Court to urgently organize the implementation of the 2024 Law on the Organization of the People's Courts; to continue to implement solutions to improve the quality of adjudication and resolution of administrative cases.
The Supreme People's Procuracy to continue to implement synchronized solutions to improve the quality of exercising the right to prosecution and the oversight of judicial activities. To strengthen oversight of the enforcement of civil and administrative judgments and to propose handling of violations in the enforcement of civil and administrative judgments in accordance with the law.
5. The National Assembly fundamentally concurs with the consolidated report of opinions and recommendations from voters and the people submitted to the 8th session of the XVth National Assembly, the report on the results of monitoring the resolution and response to voters’ recommendations submitted to the 7th session of the XVth National Assembly, and the report on the results of receiving citizens, handling petitions, and supervising the resolution of complaints and denunciations of citizens submitted to the National Assembly in 2024; appreciates the efforts of the Government, the Prime Minister, ministries, sectors, central agencies, and local administrations in resolving and responding to voters’ recommendations; and in resolving petitions, complaints, and denunciations forwarded by the agencies of the National Assembly in 2024.
The Government, the Prime Minister, the Supreme People’s Court, the Supreme People's Procuracy, ministries, sectors, central agencies, and local administrations at all levels, within their assigned functions and tasks, shall study, acknowledge, resolve, and respond to the proposals and recommendations of the Presidium of the Vietnam Fatherland Front Central Committee. To pay attention to resolving and responding to voters’ recommendations; to focus on effectively resolving cases of complaints and denunciations, especially complex and prolonged cases; to direct ministries, sectors, and People’s Committees of provinces and centrally-run cities to continue to implement effectively the recommendations of the National Assembly Standing Committee in Resolution No. 623/NQ-UBTVQH15.
6. The National Assembly acknowledges the efforts and determination of the Government, the Prime Minister, ministries, sectors, and localities in implementing the resolutions of the National Assembly on piloting a number of specific mechanisms and policies for the development of Hai Phong city, Can Tho city, Thanh Hoa province, and Thua Thien Hue province. However, the results achieved have not yet met the set objectives. The National Assembly requests the Government and the Prime Minister to strengthen the direction of relevant ministries, agencies, and localities to enhance the spirit of responsibility, determination, and strive to the highest extent to implement the resolutions; to promptly direct solutions to overcome the obstacles regarding implementation and coordination between central and local agencies. The Government shall direct the review and report to the competent authorities for consideration of adjustments and supplements to the pilot policies and the promulgation of guiding documents for implementation to align with the practical development of the localities.
7. The Government is assigned to summarize and report at the 10th Session of the XVth National Assembly on the results of the implementation of Resolutions No. 120/2020/QH14, No. 24/2021/QH15, No. 25/2021/QH15, and related resolutions of the National Assembly on the National Target Programs and to propose a Program for the 2026-2030 period. To permit the extension of the implementation and disbursement time of the capital of the National Target Programs for 2024 (including capital from 2022 and 2023 transferred to 2024) until the end of December 31, 2025.
8. To continue to reduce the value-added tax rate by 2% for the groups of goods and services specified at Point a, Clause 1.1, Article 3 of the National Assembly’s Resolution No. 43/2022/QH15 on fiscal and monetary policies to support the socio-economic recovery and development program during the period from January 1, 2025, to the end of June 30, 2025. The Government is assigned to organize the implementation, and responsible for ensuring revenue collection and the ability to balance the state budget for 2025 as decided by the National Assembly; to immediately terminate the effect of the value-added tax exemption provision in the Prime Minister’s Decision No. 78/2010/QD-TTg, providing a legal basis and sanctions for tax management offices to manage the collection of taxes from foreign e-commerce platforms selling goods in Vietnam.
9. To continue implementing the policy of investing in the Ninh Thuan Nuclear Power Project according to the Government’s Report No. 811/TTr-CP dated November 25, 2024. The Government shall urgently direct the allocation of resources for implementation according to the conclusions of the competent authority; and study amendments and supplements to relevant laws, including the Law on Atomic Energy.
10. To agree on the policy of adjusting the National Land Use Master Plan for the 2021-2030 period, with a vision to 2050. The Government shall proactively implement this task in accordance with the law provisions, and submit to the National Assembly for approval the adjustment of the National Land Use Master Plan for the 2021-2030 period, with a vision to 2050, in 2025.
11. To agree on the adjustment of the investment policy of the Long Thanh International Airport Project, specifically:
a) To adjust the scale and implementation time of Phase 1 as stipulated in Clause 6, Article 2 of the National Assembly’s Resolution No. 94/2015/QH13 dated June 25, 2015, as follows: “Phase 1: To invest in the construction of two runways in the North and one passenger terminal along with synchronous auxiliary items with an annual capacity of 25 million passengers and 1.2 million tons of cargo; to be completed and put into operation no later than December 31, 2026”. To permit the Government to approve the adjusted feasibility study report for Phase 1 of the Project within its authority without reporting to the National Assembly for approval. Other provisions shall continue to comply with the National Assembly’s Resolution No. 94/2015/QH13;
b) To adjust the scale of Phase 1 as stipulated in Clause 1, Article 1 of the National Assembly’s Resolution No. 95/2019/QH14 dated November 26, 2019, as follows: “To invest in the construction of two runways in the North and one passenger terminal along with synchronous auxiliary items with an annual capacity of 25 million passengers and 1.2 million tons of cargo”. Other provisions shall continue to comply with the National Assembly’s Resolution No. 95/2019/QH14.
12. To approve the policy of supplementing state capital to maintain the state's ownership ratio at the Joint Stock Commercial Bank for Foreign Trade of Vietnam (Vietcombank) with an amount of VND 20,695,100,980,000 from stock dividends distributed to the state shareholder from the accumulated retained earnings up to the end of 2018 and the remaining profit of 2021 of Vietcombank. The Government and the Prime Minister shall direct the investment and supplementation of state capital at Vietcombank in accordance with the law; and take responsibility before the National Assembly for the accuracy of the data and the scale of state capital supplementation for Vietcombank.
13. To approve solutions to continue removing difficulties caused by the impact of the Covid-19 pandemic for Vietnam Airlines Corporation to soon recover and develop sustainably, specifically:
a) To allow Vietnam Airlines Corporation to offer additional shares to existing shareholders to increase its charter capital with a maximum scale of VND 22,000 billion, provided it meets the provisions at Points a, c, and d, Clause 2, Article 15 of the Law on Securities No. 54/2019/QH14, specifically:
- Phase 1: To allow the Government to assign the State Capital Investment Corporation (SCIC) to represent the Government to invest in purchasing shares of Vietnam Airlines Corporation under the pre-emptive rights of the State shareholder (the Commission for Management of State Capital at Enterprises is the representative agency for the State shareholder's capital) according to the method of transferring pre-emptive rights when Vietnam Airlines Corporation implements the plan to increase charter capital in phase 01 with an issuance scale of VND 9,000 billion;
- Phase 2: To approve in principle and assign the Government to direct the implementation of the plan (including the plan for the State to transfer pre-emptive rights to the enterprise) with a maximum issuance scale of VND 13,000 billion. Any arising issues shall be reported to competent authorities.
b) To allow Pacific Airlines Aviation Joint Stock Company to write off late payment penalties and late payment interest calculated on tax debts arising according to decisions of competent tax offices, outstanding as of December 31, 2024. Pacific Airlines Aviation Joint Stock Company shall be responsible for paying the entire outstanding tax amount (principal) before December 31, 2024. After the above deadline, the tax office shall calculate late payment interest, urge and apply coercive measures in accordance with regulations.
The Government shall be fully responsible for the data, the content of the proposed plan; at the same time, clearly define the responsibilities of agencies and organizations in fulfilling their commitments to the National Assembly on the effectiveness of implementing these solutions. The State Audit shall conduct audits according to the tasks assigned in the National Assembly's resolutions, including considering and arranging in the 2025 audit plan the audit of financial statements and activities related to the management and use of state capital and assets at Vietnam Airlines Corporation, promptly making recommendations to competent authorities and Vietnam Airlines Corporation to avoid loss and waste of the State's support resources and contribute to improving the efficiency of production and business activities of Vietnam Airlines Corporation.
14. To agree to supplement the state budget expenditure estimate for 2024 for ministries, central agencies, and localities to implement the base salary in accordance with the Government's Decree No. 73/2024/ND-CP, specifically:
a) To add VND 55,000 billion from the central budget's salary reform accumulation to the state budget revenue estimate for 2024, and correspondingly supplement the state budget expenditure estimate for 2024, in which:
- The salary reform expenditure estimate is supplemented for the Ministry of National Defence and the Ministry of Public Security as stated in the Government's Report No. 54/TTr-CP dated November 25, 2024;
- For the remaining amount within the scope of VND 55,000 billion after supplementing for the Ministry of National Defence, the Ministry of Public Security, and VND 2,980 billion in the state budget balance for 2024 already decided by the National Assembly in Resolution No. 105/2023/QH15, the Government shall decide to supplement the salary reform expenditure estimate for 2024 for ministries, central agencies, and localities as stated in the Government's Report No. 54/TTr-CP. The Government shall expeditiously allocate this expenditure to ministries, agencies, and localities in a timely manner;
b) The Government shall be responsible for the proposed content to ensure compliance with law provisions, the accuracy of reported information and data, the necessity, completeness, rationality, and adherence to expenditure standards, quotas, and regimes in accordance with the law; at the same time, expeditiously organize the implementation, ensuring the right purpose and efficiency of the state budget.
15. To allow the implementation of a number of urgent and necessary mechanisms and solutions to implement 03 important projects of the CPV Central Committee Office as proposed by the Government in Report No. 56/TTr-CP dated November 27, 2024. The Government shall direct the organization and implementation of the projects, ensuring progress, quality, thrift, efficiency, and preventing negativity, loss, and waste of the state budget.
16. The National Assembly Standing Committee, the Government, the Prime Minister, the Vietnam Fatherland Front Central Committee, the Supreme People's Court, the Supreme People's Procuracy, the Ethnic Council, the National Assembly Committees, the State Audit, ministries, central agencies, and local administrations at all levels, within their respective functions and tasks, shall effectively organize the implementation of this Resolution; strengthen legal propaganda, dissemination, and education to promptly implement the laws and resolutions passed by the National Assembly.
The National Assembly Standing Committee, the Ethnic Council, the National Assembly Committees, National Assembly deputies’ delegations, and National Assembly deputies shall supervise the implementation of this Resolution.
The Vietnam Fatherland Front Central Committee and its member organizations shall supervise and mobilize the people to implement this Resolution.
