SUMMARY

To announce 21 micronutrients required for school milk

On December 05, 2019, the Ministry of Health issues the Circular No. 31/2019/TT-BYT on requirements for fresh milk products in the school milk Program.

Accordingly, fresh milk products in the school milk Program include pure sterilized milk and sterilized milk. Such milk must meet the Technical regulations QCVN 5-1:2010/BYT on liquid milk products issued with the Circular No. 30/2010/TT-BYT.

In particular, fresh milk products in the school milk Program must contain 21 micronutrients with the average contents in 100ml of milk as follows: Calcium: 114 mg - 150 mg; Iron: 1.4 mg - 1.9 mg; Vitamin E: 0.35 mg - 0.5 mg; Vitamin C: 6.4 mg - 8.4 mg; Vitamin B3 (Niacin - PP): 1.0 mg - 1.4 mg; Zinc: 1.1 mg - 1.6 mg; Phosphorus: 76.0 mg - 100 mg; Magnesium: 10.0 mg - 14.8 mg...

Within that, the maximum content is not mentioned here because of the high content of Vitamin B2 and Biotin in milk and the content of Iodine in milk is flexible and depends on crop season.

This Circular also regulates on raw input material of milk products in the school milk Program. Such raw input milk must meet the Technical regulations on raw milk issued with the Circular No. 29/2017/TT-BNNPTNT.

This Circular takes effect on January 20, 2020.

CIRCULAR

On requirements for fresh milk products in the school milk Program

Pursuant to the Law on Food Safety dated June 17, 2010;

Pursuant to the Government’s Decree No. 15/2018/ND-CP dated February 02, 2018, detailing a number of Articles of the Law on Food Safety;

Pursuant to the Government’s Decree No. 75/2017/ND-CP dated June 20, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Health;

At the proposal of the Director General of the Department of Children - Mother Health and the Agency of Food Safety;

The Minister of Health hereby issues the Circular on requirements for fresh milk products in the school milk Program.

 

Chapter I

SPECIFIC PROVISIONS

 

Article 1. Scope of regulation

This Circular regulates requirements for fresh milk products in the school milk Program according to the Government’s Decision No. 1340/QD-TTg dated July 08, 2016 on approving a school milk program to improve nutritional standards and contribute to improving the physique of children in kindergartens and elementary schools by 2020.

Article 2. Subject of application

This Circular applies to factories that manufacture and purchase and sale fresh milk products in the school milk Program and agencies, organizations and individuals concerned to the deployment and implementation of the school milk Program.

 

Chapter II

REQUIREMENTS FOR FRESH MILK PRODUCTS IN THE SCHOOL MILK PROGRAM

 

Article 3. Fresh milk products in the school milk Program

Fresh milk products in the school milk Program include pure sterilized milk and sterilized milk. Such milk must meet the Technical regulations QCVN 5-1:2010/BYT on liquid milk products issued with the Circular No. 30/2010/TT-BYT dated June 20, 2010 of the Minister of Health and regulations in Articles 4 and 5 herein

Article 4. Requirements for micronutrients of fresh milk products in the school milk Program

2. Raw input material of milk products in the school milk Program must meet the Technical regulations on raw milk issued with the Circular No. 29/2017/TT-BNNPTNT dated December 29, 2017 of the Minister of the Agriculture and Rural Development.

Article 5. Management requirements for fresh milk products in the school milk Program

1. Announcement

Fresh milk products in the school milk Program must be announced before circulating in market by the manufacturer and business in accordance with the Government’s Decree No. 15/2018/ND-CP dated February 02, 2018, detailing a number of Articles of the Law on Food Safety and the Government’s Decree No. 155/2018/ND-CP dated November 12, 2018 on amending and supplementing provisions related to investment and business conditions under the state management of the Ministry of Health.

2. Labeling

Fresh milk products in the school milk Program are labeled in accordance with the Government’s Decree No. 43/2017/ND-CP dated April 14, 2017 on goods labeling and the Decision No. 1783/QD-BYT dated May 13, 2019 of the Minister of Health on approving the logos for milk products in the school milk Program.

 

Chapter III

IMPLEMENTATION PROVISIONS

 

Article 6. Effect

1. This Circular takes effect on January 20, 2020.

2. Decision No. 5450/QD-BYT dated September 28, 2018 on temporary regulations on fresh milk products serving a school milk Program to improve nutritional standards and contribute to improving the physique of children in kindergartens and elementary schools by 2020 shall be null and void from the effective date of this Circular.

Article 7. Transitional provisions

1. Milk products in the school milk Program which are bid by the localities (calculated from the time of bid opening) and provided for kindergartens and elementary schools before the effective date of this Circular shall be used until running out according to signed/will-be-signed contracts.

2. Milk labels used in school milk products that manufactured, imported and circulated before the effective date of this Circular shall be continue to be used until their expired date.

Facilities that manufacture, purchase and sell these above milk products shall be responsible for declaring the number of labels and reporting to the Ministry of Health (Department of Children - Mother Health) before the effective date of this Circular.

Article 8. Reference provisions

In case referential legal normative documents in this Circular are amended, supplemented or replaced, the new amended, supplemented or replaced documents of such documents shall be applied.

Article 9. Implementation responsibility

Department of Children - Mother Health, Heads of affiliated units of Ministry; Director of Health Department of provinces and central-affiliated cities and related individuals, organizations shall take responsibility for the implementation of this Circular.

Any difficulties arising in the course of implementation of this Circular should be reported to the Ministry of Health (Department of Children - Mother Health) for consideration and settlement./.
