ResolutionNo. 54/NQ-CP dated May 10, 2018 ofthe Government onthe Government’s Regular Meeting – April 2018
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;
Based on the discussion of the delegates and the conclusion of the Prime Minister at the Government’s regular meeting in April 2018, held on May 03, 2018
DECIDES
1. Regarding the preparation for the 5th working session of the 14th National Assembly
Over the past time, ministries and agencies have cooperated closely with agencies of the National Assembly and the Legislature’s Standing Committee in designing agendas and preparing documents for the Legislature’s working sessions and meetings of the Legislature’s Standing Committee. However, a few ministries and/or agencies still submitted dossiers and documents that are not up to quality standards and requirements on format, procedures and progress.
In order to improve the quality of proposals and reports for the 5th working session of the 14th National Assembly, the Government requests:
- Deputy Prime Ministers direct ministries and ministerial-level agencies under their authority to urgently finalize reports and documents sent to the National Assembly to ensure their quality and progress.
- Ministers, Heads of ministerial-level agencies direct and take responsibility before the Government and the Prime Minister, ensuring that all reports and documents are sent to the National Assembly Office before the opening of the working session. The Government Office accelerates the preparation, ensuring submission progress of reports and documents.
- Ministries and agencies leading the drafting of reports and documents to be submitted to 5th working session of the 14th National Assembly actively provide detailed explanation to the issues commented by National Assembly deputies.
- The Government members take the initiative in fully grasping information, promptly providing relevant dossiers and documents to explain issues raised by the National Assembly deputies and voters, especially sensitive matters and emerging issues related to sectors and fields under their management.
2. Regarding the implementation of the Law and Ordinance Making Program and the issuance of documents detailing the implementation of laws and ordinances
The Government requests:
- Ministers and Heads of ministerial-level agencies directly direct the legislative work, take responsibility before the Government and the Prime Minister for the quality and submission progress of legal documents. Strictly implement the Government and the Prime Minister s directives on the law making, especially the Prime Minister s instructions in Official Letter No. 160/LDCP dated April 18, 2018 on institutional development, ensuring the submission of draft Laws in accordance with the Law on promulgation of legal documents.
- Ministries and ministerial-level agencies shall consolidate and enhance the capacity of legal units and departments, drafting Boards and editorial teams in charge of developing legal documents. Avoid the recurrence of delays and insufficient quality of projects and draft legal documents. Closely coordinate with the National Assembly s agencies throughout the submission process of legal documents.
- Prior to May 15, 2018, ministries and ministerial-level shall have to submit documents detailing the implementation of laws that are scheduled to take effect since July 1, 2018 to the Government and the Prime Minister for promulgation.
- Ministries of Finance, Health, Industry and Trade, Information and Communications, Public Security, Labor, Invalids and Social Affairs, Home Affairs, and Planning and Investment shall, according to their authority, expeditiously complete the dossiers and procedures as required by law to submit to the Government and the Prime Minister for promulgation or promulgate documents detailing the implementation of laws which have come into effect while the detailing documents remain in suspension before May 20, 2015.
- The Ministry of Justice and the Government Office shall intensify monitoring and accelerating the development and promulgation of legal documents and promptly propose and report to the Prime Minister solutions for correction when necessary.
3. Regarding the review results of laws, ordinances and resolutions of the National Assembly and the Legislature’s Standing Committee on organizational structure, which need to be amended, supplemented or promulgated to implement the Resolution of the 6th plenum of the 12th Party Central Committee
The Ministry of Justice was assigned to assume the prime responsibility for, and coordinate with the Ministry of Home Affairs and other ministries, agencies and localities in, promptly elaborating and finalizing the draft Report on the review results and report to the Prime Minister for review before May 10, 2018 before submitting it to the National Assembly.
4. Regarding the Proposal on the development of a Law on Public-Private-Partnership Investment
The Government agrees to adopt the policies in the Proposal
The Ministry of Planning and Investment has been assigned to collect comments from the Government members, the Government Office s verification opinions, and complete the Proposal on the development of the draft law. The Ministry shall coordinate with the Ministry of Justice in submitting the draft law to the National Assembly Standing Committee for review and adding the law into the Law and Ordinance Making Program of 2019, elaborating and finalizing the draft law, and submitting it to the 14th National Assembly to collect comments at its 7th working session and for review and approval at its 8th working session.
5. Regarding the draft Report of the Government on the implementation plan of the Law on Special Administrative- Economic Units
The Ministry of Planning and Investment shall collect comments of the Government members and finalize the report on the implementation plan of the Law on Special Administrative-Economic Units. The Minister of Planning and Investment shall report to the National Assembly at its 5th session.
6. Regarding the licensing of SIMCO Song Da Joint Stock Company to provide man power service to foreign markets
The Government agrees with the proposal of the Ministry of Labor, Invalids and Social Affairs on piloting the issuance of license for SIMCO Song Da Joint Stock Company to provide the service.
7. Regarding the management and employment of public employees and labor contracts in public non-business units in the health and education sectors
The Government requires:
- Ministries, sectors and localities, based on the Resolution No. 19-NQ/TW dated October 25, 2017 of the 6th plenum of the 12th Party Central Committee and the Government s Resolution No. 08/NQ-CP dated January 24, 2018, strictly downsize personnel and organizational restructure of public non-business units, ensuring compliance with prescribed downsizing ratio and roadmap; reduce indirect payroll, decrease the number of leaders, manage and prioritize staffs for professional work, promote autonomy in public service delivery agencies and socialization of public services; apply definite term contract for new recruitment. At the same time, ensuring full satisfaction of people s interests in the fields of health and education, especially in remote and isolated areas.
In cases the number of newly recruited public employees exceeds the assigned norms, localities must evaluate, review, transfer and arrange them within the district or province. If it is impossible for local arrangement, staff downsizing shall be implemented according to Decree No. 108/2014/ND-CP. For cases of signing professional labor contracts, if payrolls is still available, the employees can be recruited as officials. Priority shall be given to the cases that have signed labor contracts for a long period, having capacity, and being suitable to the position to be recruited. Upon the full recruitment of the assigned number of payrolls, the remaining labor contracts shall be terminated.
- The Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with the Ministry of Health, the Ministry of Education and Training and concerned ministries and agencies in, studying the plan on the management of public employees in the fields of health and education during the amendment and supplementation of relevant decrees on the management of civil servants. The Task Force on Public Duty Inspection shall expeditiously deploy activities, focusing on examining the management and utilization of payrolls of ministries, sectors and localities.
8. Regarding matters related to visa policy for foreigners entering Viet Nam
The Government agrees to extend unilateral visa exemption by 03 years from July 1, 2018 to June 30, 2021 for citizens of the following countries: the United Kingdom, Federal Republic of Germany, the Italian Republic, the French Republic, and the Kingdom of Spain for temporary residence in Viet Nam not exceeding 15 days from the date of entry, irrespective of the type of passport, the purpose of entry on the basis of meeting all the conditions required by the law of Viet Nam.
The Ministry of Public Security has been assigned to assume the prime responsibility for, and coordinate with the Ministry of Foreign Affairs, the Ministry of Defense, the Ministry of Culture, Sports and Tourism, the Ministry of Justice and concerned ministries and agencies in proposing the elaboration of laws amending, supplementing a number of articles of the Law on Entry, Exit, Transit and Residence of Foreigners in Viet Nam and report to the Government.
9. Regarding the implementation of tasks and inspection results in April 2018 by the Working Group of the Prime Minister, which is headed by Minister-Chairman of the Government Office Mai Tien Dung
The Government highly appreciates the efforts and achievements of ministries, sectors and localities in implementing the assigned tasks. Ministries and agencies are requested to implement the recommendations of the Working Group. The Working Group has been assigned to intensify the inspection and urge the performance of the tasks on development, submission and promulgation of legal documents.
10. Regarding the socio-economic situation in April and the first 4 months of 2018, the implementation of the Government’s Resolution on major tasks and solutions guiding the implementation of the socio-economic development plan and State budget plan in 2018.
The Government unanimously assesses that the socio-economic situation in April and the first 4 months of 2018 continue to observe positive and comprehensive changes. Macro economy remains stable. Inflation is kept under control. Interest rate and foreign exchange market are stable. Major sectors and fields continue to develop. Agricultural production records satisfactory development. Industrial production, especially the processing industry, continues to be a bright spot. The service and tourism sectors observe decent development. The number of international tourists to Viet Nam continues to increase. Exports continue to maintain the growth momentum. Export surplus is maintained. Business investment environment continues to improve. Social welfare, poverty reduction, vocational training, job creation observe improvement. The areas of science and technology, education, training, culture, society, information and communication receive due attention. Environmental protection, disaster prevention and response to climate change have been strengthened. Drastic moves are taken in the resolution of complaints, denunciations, inspections, prevention and fighting against corruption. National defense, security and sovereignty are maintained. The social security order is guaranteed. Foreign affairs receive due attention and have achieved a number of positive results.
In addition to the above mentioned achievements, the country still faces with many difficulties and challenges, including: low labor productivity and competitiveness, limited readiness to adapt to the 4.0 industrial revolution, growing demand for investment in the context of limited resources available, low disbursement of State investment capital, low ranking on many indicators on business investment environment, a number of mechanisms and policies which are not synchronous and have not really facilitated the development, some negative manifestations of morality,lifestyle, cultural behavior raising concerns in the society, rampant environmental pollution, deforestation and traffic accidents, that some sections of cadres, civil servants and public employees have not raised the sense of responsibility before the people, and the slow transformation in discipline and administrative procedures in some agencies and units.
The Government requests all levels, sectors, especially ministers, heads of ministerial-level agencies and Chairman of provincial People s Committees be aware of their responsibilities as the heads of their respective sectors, fields and localities, and thoroughly grasp the spirit of "discipline, integrity, action, creativity and efficiency". Continue implementing drastically and synchronously the tasks and solutions set forth in the Resolutions of the Party, the National Assembly and the Government. Resolutely avoid being objective in directing, administering, be actively in monitoring the domestic and international situation, promptly have appropriate policies and solutions. Have a desire to innovate and develop. Follow up closely with the actual context and work progress, take initiative in settling problems arising, solving difficulties and obstacles, overcoming shortcomings, limitations and weaknesses in sectors and domains under their authority. Adopt appropriate policies and solutions, promote the development of potential and advantageous sectors and domains and create motive force for socio-economic development.
The Government is determined to identify the task of building and perfecting legal institutions, administrative reform and business environment improvement as the top priority in 2018 and the following years. It is requested that ministries, sectors and localities review mechanisms, policies and regulations, especially regulations on business investment, planning, environment, land, etc. abolish or revise and supplement to regulations which are no longer suitable or obstructing production and business activities. Comprehensively reform specialized inspection activities according to the set objectives. Continue reviewing and cutting administrative procedures. Ministers, heads of ministerial-level agencies and Chairmen of the provincial People s Committees shall concentrate on directing the drastic and effective implementation of the tasks of improving the investment and business environment, consider this as a central task to create fundamental changes, in each sector, field, and locality, especially changes to low index scores/ratings.
Ministries, sectors and localities continue to implement effectively the objectives of macroeconomic stabilization, inflation control, and economic growth promotion, closely monitor price and market movements in order to deploy the roadmap on electricity price adjustment, health and education service pricing at an appropriate level and time, not to affect the consumer price index. Continue implementing solutions to restructure the economy in line with the renovation of the growth model and improve labor productivity. Monitor the production and trading of commodities and strategic products of sector, domains and localities under their management and promptly solve the problems and promote the development of production and business. Concurrently, focus on the following contents:
- The State Bank of Viet Nam shall run prudent and flexible monetary policy in close combination with fiscal policy and other macro policies. Maintain tight credit control over potentially risky areas. Effectively implement the tasks assigned in the Prime Minister s Instruction No. 10/CT-TTg dated April 11, 2018 on strengthening the control of virtual currency transactions.
- The Ministry of Finance shall strengthen state financial and budgetary discipline, launch a movement fostering the financial sector to take strong action to promote integrity, say no to negative behaviors, resolutely and strictly handle the acts of negative harassment in the fields of customs and taxation. Strictly control public assets, promote publicity and transparency in alignment with market prices, and avoid loss and waste. Urge, inspect and promote the equitization and divestment of state capital.
- The Ministry of Planning and Investment shall expeditiously complete the allocation and assignment of the medium- term public investment plan in the 2016-2020 period, coordinate with the Ministry of Finance and ministries, sectors and localities to speed up the implementation and disbursement of public investment capital. Intensify the inspection and examination, strictly review and clarify the responsibilities of organizations and individuals that cause delays in the implementation of public investment plans.
- All levels and sectors shall continue to urge, inspect and speed up the completion of investment, bidding, construction and settlement procedures for public investment projects. Strengthen measures to promote public investment, urgently improve the software system to publicize on the website disbursement results of public investment of Ministries, sectors and localities.
- The Ministry of Industry and Trade shall continue to implement solutions to develop the distribution and retail system, ensuring its synchronicity and healthiness, avoid dominance and manipulation of retail market. Coordinate with the Ministry of Agriculture and Rural Development in working out programs and plans to connect Vietnamese agricultural products to distribution and retail channels. Comprehensively assess impact of the implementation of the tariff reduction roadmap under the Viet Nam-ASEAN Free Trade Agreement and trade protection policies of other countries and report to the Prime Minister. Concentrate on directing the promotion of supporting industries, having solutions to connect Vietnamese enterprises with foreign leading companies. Complete the submission procedure to the competent authority for ratification of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).
- The Ministry of Agriculture and Rural Development shall direct the close monitoring of the weather and guide localities to take timely preventive and response measures to ensure stable production and daily life of the people. Step up the implementation of the National Target Programs for New Rural Development. Monitor disease situation on plants and animals. Take the initiative in timely preventing and improving communication and information. Direct, guide and coordinate the inspection and supervision of coastal localities in strictly observing the regulations on fishing and traceability of aquatic resources and overcome the situation of illegal fishing. Coordinate with the Ministry of Industry and Trade and localities in implementing trade promotion activities, boosting the consumption of agricultural products, including longans and lychees in the coming time.
- The Ministry of Construction shall assume the prime responsibility for, and coordinate with the concerned ministries and agencies in expeditiously finalizing the Government s draft Resolution on a number of major tasks and solutions to remove difficulties and problems related to mechanisms and policies on construction investment, and submit it to the Prime Minister for signing and promulgation.
- The Ministry of Education and Training shall assume the prime responsibility for, and coordinate with ministries, sector and localities in, well organizing the national high school graduation and college entrance exams and recruitment exams for teachers in 2018. It is necessary to improve the input quality and recruitment criteria of teachers. Direct localities to organize a peak period for review, investment in renovating, building toilets and clean water supplies in schools. Prepare material conditions, schools and classes in order to deploy the renewal of national education programs and curriculums. Continue to promote the application of university autonomy. Submit to the Prime Minister for promulgation new regulations on criteria and procedures for appointment and dismissal of the titles of professor and associate professor as soon as possible.
- The Ministry of Health shall assume the prime responsibility for, and coordinate with ministries, agencies and localities in, intensifying the inspection and control of food safety. Actively implement measures to prevent highly contagious diseases in the summer. Improve medical ethics in medical examination and treatment. Coordinate with functional agencies in strictly handling acts of violence against doctors and medical workers. Mobilize investment resources to renovate toilets in hospitals. Intensify the inspection, examination and strict handling of food safety violations.
- Ministries, sectors and localities shall further accelerate the equitization of State owned enterprises and the divestment of state capital according to the approved plans. Make fundamental changes in the handling of enterprises and projects causing losses. Facilitate the private sector to participate in restructuring SOEs. Direct, intensify the inspection, and urge the implementation of the Government s action program to implement the Resolution of the Central Committee to develop the private economy.
- The Ministry of Labor, Invalids and Social Affairs shall properly implement preferential policies for people with meritorious services and sustainable poverty reduction, particularly in remote and ethnic minority areas. Assess the unemployment situation, especially unemployment of young people, graduate students to have practical and effective solutions. Effectively implement the action month on occupational safety and health in 2018.
- The Ministry of Transport shall intensify the inspection and control of aviation security and safety. Expeditiously complete and submit to the Government for promulgation a Resolution on stepping up the implementation of measures to reduce logistics costs, effectively connecting the transport infrastructure system.
- The Ministry of Natural Resources and Environment shall review, inspect, urge and report on the implementation of the tasks of ministries, sectors and localities assigned to them in Resolution No. 120/NQ-CP dated November 17, 2017 of the Government on the sustainable development of the Mekong Delta adapting to climate change.
- The Government Inspectorate shall review regulations on inspection and examination. Study and formulate mechanisms for coordination among state management agencies and functional agencies in inspecting and examining enterprises. Monitor and urge Ministries, agencies and localities to strictly implement Directive No. 20/CT- TTg dated May 22, 1977 of the Prime Minister on the adjustment of inspection and examination activities. Work with ministries, sectors and localities, to synchronously apply measures to prevent and combat corruption.
- Ministries, sectors and localities shall promote the responsibility of the leaders in the reception of citizens. Chairmen of the provincial People s Committees shall direct the prompt settlement of complaints and denunciations in their respective localities, especially the large-scale complaints related to land. Enhance the responsibility for the State management over associations and reorganize the activities of awarding prizes to organizations, associations and enterprises, ensuring the right purposes of honor and encouragement, and avoiding errors, defects, and violations, especially the review and ranking of unqualified products.
- The Ministry of Home Affairs shall intensify the inspection and examination of public duties, administrative disciplines and order. Study, amend and supplement to regulations on criteria for evaluating administrative reform indicators associated with people s satisfaction, ensuring publicity, transparency and anti-corruption. Assume the prime responsibility for, and coordinate with the concerned Ministries and agencies in, reviewing the current Decrees prescribing the functions, tasks and organizational structure of ministries and ministerial-level agencies, then submit to the Government in the second quarter of 2018 a draft Decree amending the relevant Decrees on press agencies, in line with the National Planning for Journalism Development and Management until 2025 which was adopted by the Politburo. Urgently elaborate and submit to the Government for promulgation a Decree stipulating measures for the management of organizations to review and honor the titles and to award prizes to entrepreneurs and enterprises. Urgently report to the Prime Minister solutions to handling this proposal while a Decree has not been promulgated yet. Strengthen the state management of religion, and coordinate with functional agencies in timely correcting and preventing the abuse of beliefs and religions in violation of law.
- The Ministry of Defense and the Ministry of Public Security shall continue to build and consolidate the all-people defense posture and the people s security posture. Closely monitor the global, regional and domestic situation, to promptly advise and propose to the Party and the State undertakings, solutions, plans and tactics for response and settlement, avoid inactiveness and occurrences of unforeseen situation.
- The Ministry of Foreign Affairs shall organize high-level foreign affairs activities. Take active and drastic moves to deepen concrete relationship with other countries and partners.
- The Ministry of Information and Communications shall strengthen the state management of the press, provide timely information, create social consensus. Immediately decide on the reorganization of the press agencies of the Ministry, enterprises and associations under the management of the Ministry into a press agencies in accordance with the Development Planning and Management Scheme managed by the Politburo, the Central Committee of the XI Legislature and decided by the Government in resolutions No. 25/NQ-CP dated 5 April 2015; 75/NQ-CP dated August 09, 2017; 08/NQ-CP dated January 24, 2018. The Minister of Information and Communications shall decide on the names of the press agencies according to his competence.
- Ministries and agencies in close collaboration with the Government Office shall continue to prepare content to organize symposium in 2018 as planned.
11. Regarding the plan for allocation of the medium-term public investment plan in the 2016-2020 period
The Ministry of Planning and Investment has been assigned to collect comments of the Cabinet members, finalize the plan for allocation of the medium-term public investment plan in the 2016-2020 period and the draft report of the Government and report them to the Prime Minister and the Government for review and approval. The Minister of Planning and Investment shall be authorized by the Prime Minister to report on behalf of the Government to the National Assembly Standing Committee.
12. Regarding the adjustment of the total investment capital for urban railway projects in Ho Chi Minh City for Line 1 (Ben Thanh - Suoi Tien), Line 2 (Ben Thanh - Tham Luong)
The Government Office shall coordinate with the Ministry of Transport in collecting comments of the Cabinet members on the draft Proposal of the Government on adjustments to the total investment volume of urban railway projects in Ho Chi Minh City for Line 1 (Ben Thanh - Suoi Tien), Line 2 (Ben Thanh - Tham Luong). The Ministry of Transport shall assume the prime responsibility for, and coordinate with the Government Office in, gathering comments of the Cabinet members, finalizing the draft Report of the Government and reporting to the Prime Minister. On that basis, the Minister of Transport shall report to the National Assembly at its 5th session./.
