RESOLUTION
On applying the regime of grant of export license for medical masks in the period of prevention and control of COV-19 epidemic

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 10, 2016 on promulgating the Working Regulation of the Government;
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on guidelines of the Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 36/2016/ND-CP dated May 15, 2016 on medical equipment management; the Government’s Decree No. 169/2018/ND-CP dated December 31, 2018 on amending and supplementing a number of Articles of the Decree No. 36/2016/ND-CP on medical equipment management;
At the proposal of the Minister of Health,
DECIDES:
1. The Ministry of Health shall apply the regime of grant of export license for medical masks in the period of prevention and control of COV-19 epidemic. Medical masks are only exported for the purposes of international support and aid which are performed by the Government of Vietnam (maximum of 25% of the quantity is for the purpose of export, the 75% remain is for the works of prevention and control of epidemics within our country). The provision mentioned above shall not apply to the export activities of processing enterprises which have already been granted certificates of investment and enterprises processing medical masks for foreign traders under the processing contracts signed before March 01, 2020.
2. The Ministry of Health shall be assigned to preside, coordinate with the Ministry of Industry and Trade and the Ministry of Finance to promulgate the applications, orders and procedures for the grant of export license with medical masks in the period of prevention and control of COV-19 epidemic as prescribed in Clause 1 of this Resolution and guidance on the standards of medical masks.
3. The General Department of Customs (the Ministry of Finance) shall be assigned to coordinate to supervise the export of medical masks.
4. Manufacture factories shall be responsible for reporting on the production capacity as required by the Ministry of Health./.
