THE VIETNAM SOCIAL SECURITY

Official Dispatch No. 4424/BHXH-ST dated November 6, 2015 of the Vietnam Social Security guiding preservation of period of unemployment insurance payment

- Social Security Office of Public Security.

On October 1, 2015, Director General of Vietnam Social Security signed the Decision No. 1035/QD-BHXH on issuance of the template of social insurance book coming into force from January 1, 2016. Notwithstanding, the Law on employment No. 38/2013/QH13 was passed by the 13th National Assembly in the 6^th session on November 16, 2013 and come into force on January 1, 2015. In order to ensure the consistent implementation of reservation of period of unemployment insurance payment applied to employees before the effective date of the Decision No. 1035/QD-BHXH, Vietnam Social Security provides guidelines for the cases of cutting of unemployment benefit and the remaining payment period in which the unemployment benefit is not received as follows:

- The Social security office of the district where the unemployment benefit is paid shall, according to the decision on unemployment benefit payout or the decision on cutting unemployment benefit issued by the Director of Service of Labor, War Invalids and Social Affairs, grant the document which certifies the period of unemployment insurance payment (using the form No. C15-TS) upon the end of the payout period to record the preserved payment period.

- If the employee wishes to keep paying social insurance and unemployment insurance premiums, he/she shall submit a document which certifies the period of unemployment insurance payment to the Social security office in order to record the preserved payment period into the social insurance book for the next period of unemployment benefit payout. The preserved unemployment insurance period shall be the payment period beginning from the last payment month before the unemployment benefit is received.

Any difficulties arising in the course of implementation shall be reported to Vietnam Social Security for consideration./.
