Official Dispatch No. 3052/LDTBXH-LDTL dated September 14, 2011 of the Ministry of Labor, War Invalids and Social Affairs on salary level for paying social insurance
To: The Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City
On answering the Official Dispatch No. 5402/SLDTBXH-LD dated June 13, 2011 of the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh on salary level for paying social insurance, the Ministry of Labor, War Invalids and Social Affairs has opinions as follows:
In accordance with clause 2, Article 94 of the Law on Social Insurance Monthly compulsory social insurance payment salaries, remuneration for laborers paying social insurance premiums according to the salary regime decided by their employers, their monthly social insurance payment salaries or remuneration are the salaries or remuneration stated in their labor contracts.
Salary level or wage written in the labor contract is the main salary level and wage written at the content (8), clause 1, Article 3 of the labor contract sample issued with the Circular No. 21/2003/TT-BLDTBXH dated September 22, 2003 of the Ministry of Labor, War Invalids and Social Affairs.
The Ministry of Labor, War Invalids and Social Affairs answers the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City for knowing and guiding all units to implement in accordance with State regulations.
