Official Dispatch No. 2386/BNN-TCLN dated July 17, 2013 of the Ministry of Agriculture and Rural Development on strengthening international trade control in specimens protected by CITES

Vietnam has entered into the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) since 1994. According to CITES and the Government's Decree No. 82/2006/NĐ-CP dated August 10, 2006 on the management of export, import, re-export, import by sea, transit, breeding, propagation, and culture of endangered and rare wild fauna and flora, every import of species in CITES appendices must obtain the license issued by the CITES agency of the exporting country and the import license issued by the CITES of Vietnam; the breeding facilities in CITES appendices must be registered with competent authorities.
The lists of endangered wild fauna and flora in CITES are promulgated in the Circular no. 59/2010/TT-BNNPTNT dated October 19, 2010 of the Ministry of Agriculture and Rural Development on the promulgation of lists of wild fauna and flora protected by CITES, including sturgeons (Acipenseriformes spp.) in Appendix II, Atlantic sturgeons (Acipenser brevirostrum) and Baltic sturgeons (Acipenser sturio) in Appendix I.
For the prevention and actions against the violations of the Convention, the assurance of order and compliance with laws on control of trade in specimens of wild fauna and flora in CITES appendices, especially specimens of sturgeons, the Ministry of Agriculture and Rural Development hereby requests that:
1. Provincial People’s Committees provide guidance on the implementation of regulations of the State and CITES; propagate the laws on management and conservation of wild animals; carry out inspections, prevent and take actions against the organizations and individuals that violates regulations of the State on hunting, catching, transporting, breeding, slaughtering, trading, storing, exporting, importing, and re-exporting wild animals and their products against the law and CITES; register the sturgeon aqua farms that satisfy the conditions in Article 10 and Article 11 of the Government's Decree No. 82/2006/NĐ-CP dated August 10, 2006.
2. The Ministry of Public Security, the Ministry of National Defense, the Ministry of Finance, the Ministry of Industry and Trade to enhance control at border checkpoints; uncover and foil illegal smuggling and transportation of specimens of endangered and rare wild animals, especially sturgeon specimens; locate and eradicate the sites where species of wild animals are illegally traded.
3. Vietnam Airlines Corporation transport only specimens of wild animals, especially sturgeon, that have adequate documents proving their legal origins according to current regulations of the State.
The Ministry of Agriculture and Rural Development requests the Ministry of Public Security, the Ministry of National Defense, the Ministry of Finance, the Ministry of Industry and Trade, provincial People’s Committees, and Vietnam Airlines Corporation to cooperate in implementing this Dispatch./.
