NOTICE
Regarding conclusions of the Permanent Government members on addressing difficulties and inadequacies of Decree No. 46/2026/ND-CP and Resolution No. 66.13/2026/NQ-CP on food safety
On March 16, 2026, at the Government Headquarters, Prime Minister Pham Minh Chinh chaired a meeting of the Permanent Government members on addressing difficulties and inadequacies of Decree No. 46/2026/ND-CP dated January 26, 2026, detailing the implementation of a number of articles and measures for organizing, guiding the implementation of the Law on Food Safety (hereinafter referred to as Decree No. 46) and Resolution No. 66.13/2026/NQ-CP dated January 27, 2026, on announcement and registration of food products (hereinafter referred to as Resolution No. 66.13). Attendees of the meeting included Deputy Prime Ministers, Minister of Health Dao Hong Lan, leaders of the Ministries of Health, Agriculture and Environment, Industry and Trade, Science and Technology, Finance, Justice, Culture, Sports and Tourism, leaders of the Office of the Government , and representatives of the leadership of the Ministry of Public Security.
After hearing the report of the Ministry of Health and opinions of meeting participants, the Permanent Government members reached the following conclusions:
1. The Ministry of Health shall assume the prime responsibility for, and coordinate with the Ministries of Agriculture and Environment, Industry and Trade, Justice and other relevant ministries and agencies in urgently studying, incorporating opinions at the meeting, reviewing, reporting, and submitting to the Government before March 28, 2026, for consideration and promulgation of the Government’s Resolution in order to:
- Extend the period of suspension of effect of Decree No. 46 and Resolution No. 66.13 as prescribed in the Government’s Resolution No. 09/2026/NQ-CP dated February 04, 2026, on suspension of effect of Decree No. 46 and Resolution No. 66.13 until the Law on Food Safety (revised) and the Decree detailing the Law on Food Safety (revised) take effect.
- Strengthen the implementation of directing and governing measures to enhance the responsibility of regulatory authorities, improve capacity, effectiveness and efficiency of food safety management; in particular, strengthen inspection, post-inspection, and supervision to ensure food safety.
2. The Ministry of Health shall assume the prime responsibility for, and coordinate with relevant ministries and agencies in, urgently completing the Draft Law on Food Safety (revised), ensuring quality and timely submission to the National Assembly at the 2nd session of the 16th National Assembly; concurrently, develop and finalize the Draft Decree detailing the Law on Food Safety (revised) and adequately prepare conditions for implementation concurrently with the formulation and submission of the Draft Law.
3. The Ministry of Health shall establish a Working Group headed by the Minister of Health, with members comprising leaders of the Ministries of Agriculture and Environment, Industry and Trade, Public Security, Finance, Justice, Science and Technology and relevant agencies to perform the tasks specified in Clause 1 of this Notice.
The Office of the Government hereby notifies the Ministry of Health and relevant ministries and agencies for information and implementation./.
