AGREEMENT
BETWEEN THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM AND THE GOVERNMENT OF THE REPUBLIC OF UZBEKISTAN ON COOPERATION IN THE FIELD OF PLANT QUARANTINE
The Government of the Socialist Republic of Viet Nam and the Government of the Republic of Uzbekistan, (hereinafter referred to as "Parties");
In order to strengthen mutual cooperation in a field of plant quarantine and to improve protection of state territory of the Parties from quarantine organisms drift and reduce losses induced by them,
Willing to facilitate trade and exchange between two countries by seeds, planting stock and other products subject to phytosanitary control;
Have agreed on the following:
Article 1. DEFINTIONS
For the purpose of this Agreement the following terms are applied:
- "quarantine organisms" - pests, anticrop (biological) agents and weeds, in accordance with the Lists, Appendix No. 1 and 2;
- "entomophages" - insects-eating organisms;
- “pheromones" - matters secreted by insects for intraspecific appeal;
- “biologies" — preparations containing disease producing nosogenic microorganisms used in latent state to fight harmful insects;
- "quarantineable cargo" - any materials facilitating spreading of quarantine organisms (seeds, planting stock, plants and their parts, other products of phytogenic origin), imported/exported or being in-transit through the state territories of the Parties.
Article 2. STRENGTHENING COOPERATION
For the purpose of cooperation development and extension in a field of plant quarantine Parties are obliged to:
- take necessary measures to prevent quarantine organisms drift from the territory of one Party to the territory of another Party during import, export and transit of quarantineable materials;
- permanently exchange written information about appearance, spreading of quarantine objects on the territory of Parties’ state as well as exchange entomophages, pheromones, biologies and other matters to abate quarantine organisms;
- inform about amendments and additions to existing phytosanitary rules regulating import, export and transit of quarantineable materials;
- give mutual scientific, technical and consultative assistance in taking measures on revelation, localization and liquidation of quarantine organisms;
- analyze problems and study achievements in the field of plant quarantine, effectively solve issues concerning plant quarantine on frontier points;
- organize mutual cooperation of the Parties’ specialists in phytosanitary control of quarantineable materials supplied to tie territory of one Party in places of their production;
- in emergency situation in the field of plant quarantine, upon request of one Party, send expedition consisting of specialists to undertake joint urgent measures.
Article 3. PLANT QUARANTINE
Any regulated articles which are transported from one Party to the other Party shall be in conformity with the following regulations:
1. The regulated articles from one Party must be in line with the plant quarantine regulations of the other Party.
2. A strict quarantine inspection shall be conducted before the regulated articles are exported.
3. If the imported articles are found to be infested the quarantine pests of the importing countries, either Party, in accordance with its own laws and regulations in relation to plant quarantine, is entitled to take necessary measures to protect its plants and plant products.
4. Straw, leaves and other plant materials capable of harboring pests as packaging or bedding materials but not including paper and synthetic materials shall be prohibited.
5. The conveyance, packaging and bedding materials shall be cleaned or be subject to a disinfecting treatment.
The wood packaging materials shall be treated in compliance with the International Standards for Phytosanitary Measures No. 15 (ISPM 15).
6. When necessary, the Parties shall cooperate to carry out plant quarantine activities on the territory of the exporting country.
Article 4. PHYTOSANITARY CERTIFICATE
Each lot of quarantineable cargo transported from the territory of one Party's state to (or through) the territory of other Party's state should be accompanied with phytosanitary certificate issued by phytosanitary control services of exporting Party and certifying that this load meets phytosanitary requirements presented by the importing Party in quarantine permission for import. Phytosanitary certificate should be performed in official state language of exporting Party and in English. The Parties shall mutually exchange the phytosanitary certificate models and timely notice each other on any changes of certificate model.
Import or transit of quarantineable load to (or through) the territory of importing Party's state is realized on base and conditions defined in quarantine permission for import issued by phytosanitary control services of importing Party.
Article 5. CONTROL AND NOTIFICATION
Competent authorities of the Parties reserve a right during import or transit of certain quarantineable load exhibit additional conditions and requirements related to its phytosanitary state.
Competent authorities of the Parties in case of quarantine organisms' revelation during phytosanitary control in the state of importing Party have right to return quarantineable load to exporting Party's state or its disinfection and in case of disinfection impossibility - its extinction in accordance with legislation of the importing Parry's state. Competent authorities of the importing Party send written information about measures undertaken to competent authorities of exporting Party.
Payment for disinfection, return or extinction of quarantineable load is made at expense of consignee in the state of importing Party with successive refund by consignor of exporting Party.
The Parties shall inform to International Plant Protection as regulated and shall not provide information to the third party, unless agreed by the other Party in written form.
Article 6. COMPETENT AUTHORITIES
The competent Authorities for the implementation of this Agreement shall be:
For Vietnam side: Plant Protection Department under the Ministry of Agriculture and Rural Development of the Socialist Republic of Viet Nam;
For Uzbek side: Main State Inspection on Plant Quarantine under Ministry of Agriculture and Water Resources of the Republic of Uzbekistan.
Article 7. THE SETTLEMENT OF DISPUTES
Disputes related to interpretation and application of this Agreement provisions will be resolved by means of negotiations between the Parties.
Competent authorities of the Parties in case of necessity will carry out consultation in order to solve emerging and implementing arrangements on this Agreement fulfillment as well as present each other scientific information and other assistance in the field of plant quarantine.
Time, place and program of these meetings are determined by consent between competent authorities of the Parties states. Host side bears organizational expenses related to the meeting conduction. Each Party bears transport and other expenses independently.
Article 8. INTERNATIONAL AGREEMENTS
Provisions of this Agreement shall not affect rights and obligations of die Parties under international agreements of which they are party.
Article 9. AMENDMENT
By mutual consent of the Parties amendments and supplements can be made in this Agreement, which are executed by separate protocols of meeting being integral part of this Agreement. Protocols come into force according to Article 10 of this Agreement.
The list of pests, plants diseases and weeds reliable to quarantine in Parties states are specified in Appendix No 1 and 2 which arc an integral part of this Agreement. The lists of quarantine objects can be supplemented and amended by mutual consent of the competent authorities.
Article 10. ENTRY INTO FORCE OR TERMINATION
This Agreement shall come into force after thirty days from the date of receipt through diplomatic channels of the last written notification about completing by the Parties of internal procedures necessary for its entry into force.
This Agreement shall be effective for five years and will be automatically extended for successive five year periods unless one Party notifies another of its intention to terminate this Agreement six months prior to the end of suck five-year period.
This Agreement shall be terminated after six months from the date of receipt of written notification of any Party sent through diplomatic channels to other Party about its intention to terminate this Agreement.
Done at Tashkent on 3rd day of October 2011 in duplicate in Vietnamese, Uzbek and English languages, all texts being equally authentic. In case of divergence of interpretation or implementation, the English text shall prevail.
