Law Amending Law on the Vietnam Fatherland Front, Law on Trade Unions, Youth Law, and Law on the Implementation of Grassroots Democracy, No. 97/2025/QH15

Amending and Supplementing a Number of Articles of the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Youth Law, and the Law on the Implementation of Grassroots Democracy^[1]

Pursuant to the Constitution of the Socialist Republic of Vietnam, which has a number of articles amended and supplemented under Resolution No. 203/2025/QH15;

The National Assembly promulgates the Law Amending and Supplementing a Number of Articles of Law No. 75/2015/QH13 on the Vietnam Fatherland Front, Law No. 50/2024/QH15 on Trade Unions, Youth Law No. 57/2020/QH14, and Law No. 10/2022/QH15 on the Implementation of Grassroots Democracy, which has a number of articles amended and supplemented under Law No. 47/2024/QH15.

Article 1. To amend and supplement a number of articles of the Law on the Vietnam Fatherland Front

1. To amend and supplement Article 1 as follows:

“Article 1. Vietnam Fatherland Front

Inheriting the historical role of the National United Front of Vietnam founded and led by the Communist Party of Vietnam and President Ho Chi Minh, the Vietnam Fatherland Front is a political alliance and voluntary union of the political organization, socio-political organizations, social organizations and prominent individuals representing their class, social stratum, ethnicity or religion and overseas Vietnamese.

The Vietnam Fatherland Front constitutes part of the political system of the Socialist Republic of Vietnam; is the political base of the people’s administration; rallies and upholds the strength of the great national unity; expresses the People’s will, aspiration and mastery; represents and protects the lawful and legitimate rights and interests of the People; exercises democracy and promotes social consensus; conducts social supervision and criticism; reflects the People’s opinions and recommendations to state agencies; and participates in the building of the Party and the State, and in people-to-people diplomacy, thus contributing to the building and defense of the Fatherland.”.

2. To amend and supplement Clause 3, Article 4 as follows:

“3. Socio-political organizations shall, together with other member organizations of the Front, make negotiations in a democratic manner, coordinate and unify actions as chaired by the Vietnam Fatherland Front, while promoting the proactivity and creativity of each member organization.

When coordinating and unifying actions, member organizations of the Vietnam Fatherland Front shall comply with the Constitution, law, the Charter of the Vietnam Fatherland Front and the charter of each organization.”.

3. To amend and supplement Article 5 as follows:

“Article 5. Members of the Vietnam Fatherland Front

1. Members of the Vietnam Fatherland Front are organizations and individuals defined in Article 1 of this Law and the Charter of the Vietnam Fatherland Front.

2. Socio-political organizations (including the Vietnam Trade Union, the Vietnam Farmers’ Union, the Ho Chi Minh Communist Youth Union, the Vietnam Women’s Union, and the Vietnam Veterans’ Association) and mass organizations assigned by the Party and the State and directly under the Vietnam Fatherland Front shall be organized and operate uniformly within the Vietnam Fatherland Front.

3. The rights and responsibilities of member organizations of the Vietnam Fatherland Front are specified in this Law, relevant laws, the Charter of the Vietnam Fatherland Front and the charter of each organization.

4. The admission to, permission for withdrawal from, and rights and responsibilities of members of, the Vietnam Fatherland Front shall be specified in the Charter of the Vietnam Fatherland Front.”.

4. To amend and supplement Point b, Clause 2, Article 6 as follows:

“b/ At local levels: Vietnam Fatherland Front Committees of provinces and cities (below collectively referred to as provincial level); and Vietnam Fatherland Front Committees of communes, wards and special zones under the provincial level (below collectively referred to as commune level). The Vietnam Fatherland Front Committee at each level has its Standing Board.

The organization, tasks and powers of agencies of the Vietnam Fatherland Front shall be specified in the Charter of the Vietnam Fatherland Front.”.

5. To replaces the word “request” in Clause 1, Article 25 and Clause 1, Article 32 with the phrase “reach consensus with”; to replace the phrase “At the request of” in Clause 3, Article 26 and Clause 3, Article 33 with the phrase “After reaching consensus with”.

6. To add the phrase “ of the provincial level” after the phrase “People’s Councils” in Clause 2, Article 20; to add the phrase “in accordance with” before the word “law” in Clause 3, Article 26 and Clause 3, Article 33

7. To remove the phrase “of the district level”, in Clause 2, Article 16; to remove the phrase “of district and higher levels” in Clause 2, Article 18; to remove the phrase “, district-level” in Clause 2, Article 20.

Article 2. To amend and supplement a number of articles of the Law on Trade Unions

1. To amend and supplement Article 1 as follows:

“Article 1. Vietnam Trade Union

The Vietnam Trade Union is a broad socio-political organization of the working class and employees, which is established on the basis of voluntariness, and is a member of the political system led by the Communist Party of Vietnam and attached to the Vietnam Fatherland Front; it represents, takes care of, and protects the lawful and legitimate rights and interests of its members and employees; acts as the sole representative of employees at the national level in industrial relations and in international trade union relations; participates in state management and socio-economic management; participates in the examination, inspection and supervision of activities of state agencies, organizations, units and enterprises regarding matters related to the rights and obligations of employees; and carries out public communication for, and mobilizes, employees to study to improve their professional qualifications and skills, observe law, and build and defend the Fatherland.”.

2. To amend and supplement Clauses 2 and 3, Article 4 as follows:

“2. Grassroots trade union means a grassroots organization of the Vietnam Trade Union, rallying trade union members in one or more than one organization, unit or enterprise, which is recognized by the superior trade union in accordance with law and the Statute of the Vietnam Trade Union.

3. Grassroots labor union means a grassroots organization of the Vietnam Trade Union, rallying persons working without industrial relations in the same sector or occupation or other particular employees, which is recognized by the superior trade union in accordance with law and the Statute of the Vietnam Trade Union.”.

3. To amend and supplement Clause 1, Article 8 as follows:

“Article 8. Organizational system of the Vietnam Trade Union

1. The Vietnam Trade Union is a unified organization consisting of the following levels:

a/ The Vietnam General Confederation of Labor at the central level;

b/ Superior trade unions, including Labor Federations of provinces and cities (below referred to as provincial-level Labor Federations); trade unions of central sectors; trade unions of economic groups and trade unions of corporations which are attached to the Vietnam General Confederation of Labor, and specialized superior trade unions established under permission of competent authorities in conformity with trade union organizations;

c/ Grassroots-level trade unions, including grassroots trade unions and grassroots labor unions.”.

4. To amend and supplement Clauses 2 and 3, Article 14 as follows:

“2. Chairpersons of provincial-level Labor Federations shall be invited to attend sessions, meetings and conferences of People’s Councils, the Standing Bodies of People’s Councils, and People’s Committees of the same level and of related agencies or organizations that discuss matters related to the rights and obligations of trade union members, employees, trade union organizations, and socio-economic development in localities.

3. Chairpersons of trade unions of central sectors; trade unions of economic groups, trade unions of corporations, and other superior trade unions shall be invited to attend meetings and conferences of specialized agencies and related agencies or organizations that discuss matters related to the rights and obligations of trade union members, employees and trade union organizations.”.

5. To amend and supplement Clause 2, Article 19 as follows:

“2. Superior trade unions have the right and responsibility to assign trade union officials to enterprises, cooperatives, unions of cooperatives, organizations and units to carry out public communication for, mobilize and guide employees to join or establish grassroots trade unions.”.

6. To add Clause 7 below Clause 6, Article 31 as follows:

“7. Annually, the Vietnam General Confederation of Labor shall report to the Standing Board of the Central Committee of the Vietnam Fatherland Front the estimates and account-finalization of trade union activities of the Vietnam Trade Union as specified at Points a, b and d, Clause 1, Article 29, and Clause 2, Article 31, of this Law.”.

7. To amend and supplement Point a, Clause 2, Article 32 as follows:

“a/ The management, use and exploitation of assets of the trade union at the Vietnam General Confederation of Labor, superior trade unions, and non-business units of trade unions must comply with the law on management and use of public assets and other relevant laws;”.

8. To replace the phrase “agencies, organizations, units, enterprises, cooperatives, unions of cooperatives” at Point b, Clause 1, Article 29 with the phrase “enterprises and non-business units not receiving 100% of salary from the state budget, cooperatives, unions of cooperatives and other agencies, organizations and units that employ laborers in accordance law”; to add the phrase “in accordance with the law on the state budget” after the phrase “State budget allocations as support” at Point c, Clause 1, Article 29; to add the phrase “; non-business units not receiving 100% of salary from the state budget specified at Point b, Clause 1 of this Article” after the phrase “cases of non-payment or delayed payment of trade union dues” in Clause 2, Article 29.

9. To annul Clause 4, Article 4, and Clause 3, Article 19.

Article 3. To amend and supplement a number of articles of the Youth Law

1. To amend and supplement Clause 3, Article 17 as follows:

“3. To create conditions for youth to borrow concessional loans for job creation and production and business development.”.

2. To amend and supplement Clause 1, Article 28 as follows:

“1. The Ho Chi Minh Communist Youth Union is a socio-political organization of Vietnamese youth, which is attached to the Vietnam Fatherland Front, plays the core role in youth movements and youth organizations; and shall organize and guide activities of teenagers and children, and take charge of the Ho Chi Minh Young Pioneer Organization.”.

Article 4. To amend and supplement a number of articles of the Law on Implementation of Grassroots Democracy

1. To amend and supplement Article 62 as follows:

“Article 62. Operation of People’s Inspection Boards

1. Based on the resolution of the meeting of cadres, civil servants, public employees and workers of an agency or unit, the People’s Inspection Board shall formulate quarterly, biannual and annual working programs and organize the implementation thereof.

2. The People’s Inspection Board shall report on its operation at the meeting of cadres, civil servants, public employees and workers of the agency or unit.”.

2. To amend and supplement Point a, Clause 2, Article 83 as follows:

“a/ To assist the Government in performing the state management of the implementation of democracy in communes, wards, special zones, state agencies, public non-business units and labor-employing organizations;”.

3. To replace the word “townships” in Clause 1, Article 2; Clause 1, Article 4; the title of Chapter II; the titles of Section 1, and Sub-section 2, Section 4, Chapter II; Clauses 3, 4 and 14, Article 11; Point k, Clause 1, Article 12; Clauses 7 and 9, Article 25; Clause 2, Article 26; the title of Article 29; Clause 2, Article 31; Clause 3, Article 34; Point c, Clause 2, Article 35; the title of Article 36; Clauses 1 and 3, Article 36; the title of Article 37; the title of Article 38; the title and Clause 1 of Article 39; the title and Clause 3 of Article 40; Clause 1, Article 41; and Point c, Clause 2, Article 86 with the phrase “special zones”.

4. To replace the phrase “coordinate with the Trade Union Executive Committee of the agency or unit, based on” at Point a, Clause 1, Article 59 with the phrase “Based on”; to replace the phrase “the Trade Union and other mass organizations” in Clause 5, Article 54 and at Point c, Clause 1, Article 59 with the phrase “mass organizations”.

5. To remove the phrase “at the commune level,” in Clause 3, Article 8; Clauses 4 and 10, Article 11; Clause 3, Article 24; Clause 2, Article 30; Points b and c, Clause 1, Article 31; Clause 2, Article 37; and Clause 1, Article 38.

6. To remove the phrase “district-level” in Clause 2, Article 25; to remove the phrase “district-level People’s Committees” in the title of Article 85.

7. To remove the phrase “, the Trade Union Executive Committee of the agency or unit” at Point e, Clause 1, Article 47; to remove the phrase “the Trade Union Executive Committee of the agency or unit” in Clause 1, Article 50; to remove the phrase “after reaching consensus with the Trade Union Executive Committee of the agency or unit” in Clause 2, Article 50; to remove the phrase “in coordination with the Trade Union of the agency or unit” and the phrase “after consulting the Trade Union Executive Committee of the agency or unit” in Clause 1, Article 51; to remove the phrase “reach agreement with its Trade Union” at Point b, Clause 2, Article 51; to remove the phrase “and a representative of its Trade Union Executive Committee” at Point d, Clause 2, Article 51; to remove the phrase “, the President of the Trade Union of the agency or unit” at Point d, Clause 4, Article 51; to remove the phrase “coordinate with the Trade Union Executive Committee of the agency or unit in unanimously” in Clause 1, Article 52; to remove the phrase “coordinate with the Trade Union Executive Committee of the agency or unit” in Clause 2, Article 52; to remove the phrase “coordinate with the Trade Union Executive Committee of the agency or unit” in Clause 3, Article 52; the phrase “the superior Trade Union Executive Committee,” in Clause 4, Article 52; to remove the phrase “at the request of the Trade Union Executive Committee of the agency or unit” in Clause 1, Article 60; to remove the phrase “the Trade Union Executive Committee of the agency or unit shall request” in Clause 3, Article 60.

8. To annul Points b and h, Clause 4, Article 51; Clause 2, Article 55; Clause 2, Article 63; Clause 3, Article 83; and Clauses 3 and 4, Article 86.

Article 5. Implementation provisions

1. This Law takes effect on July 1, 2025.

2. Trade unions and the executive boards of the trade unions of public non-business units not receiving 100% of salary from the state budget shall continue to comply with Chapter III of Law No. 10/2022/QH15 on Implementation of Grassroots Democracy.

This Law was passed on June 27, 2025, by the 15^th National Assembly of the Socialist Republic of Vietnam at its 9^th session.-
