Annulling a number of legal documents promulgated and jointly promulgated by the Minister of Labor, Invalids and Social Affairs

THE MINISTER OF LABOR, INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015, and the Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;

Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, detailing a number of articles of, and providing measures for implementing, the 2015 Law on Promulgation of Legal Documents; the Government's Decree No. 154/2020/ND-CP dated December 31, 2020, amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, detailing a number of articles of, and providing measures for implementing, the 2015 Law on Promulgation of Legal Documents, and the Government’s Decree No. 59/2024/ND-CP dated May 25, 2024, amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents, which had a number of articles amended and supplemented under the Government’s Decree No. 154/2020/ND-CP dated December 31, 2020;

Pursuant to the Government’s Decree No. 62/2022/ND-CP dated September 12, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

At the proposal of the Director of the Department of Legal Affairs;

The Minister of Labor, Invalids and Social Affairs hereby promulgates the Circular annulling a number of legal documents promulgated and jointly promulgated by the Minister of Labor, Invalids and Social Affairs.

Article 1. Wholly annulment of legal documents

To wholly annul14 legal documents promulgated and jointly promulgated by the Minister of Labor, Invalids and Social Affairs:

1. Circular No. 08/2013/TT-BLDTBXH dated June 10, 2013, of the Minister of Labor, Invalids and Social Affairs, guiding the Government’s Decree No. 46/2013/ND-CP of May 10, 2013, detailing a number of articles of the Labor Code regarding labor disputes.

2. Circular No. 30/2013/TT-BLDTBXH dated October 25, 2013, of the Minister of Labor, Invalids and Social Affairs, guiding the implementation of a number of articles of the Government’s Decree No. 44/2013/ND-CP of May 10, 2013, detailing a number of articles of the Labor Code regarding labor contracts.

3. Circular No. 19/2014/TT‑BLDTBXH dated August 15, 2024, of the Ministry of Labor, Invalids and Social Affairs, guiding the implementation of a number of articles of the Government's Decree No. 27/2014/ND‑CP of April 7, 2014, detailing a number of articles of the Labor Code regarding domestic employees.

4. Circular No. 27/2014/TT-BLDTBXH dated October 6, 2014, of the Ministry of Labor, Invalids and Social Affairs, guiding the consultation by labor state management agencies with local organizations representing employees and employers in the formulation of labor policies and laws and on industrial relation issues.

5. Circular No. 23/2015/TT-BLDTBXH dated June 23, 2015, of the Ministry of Labor, Invalids and Social Affairs, guiding the implementation of a number of articles regarding wage provided in the Government’s Decree No. 05/2015/ND-CP of January 12, 2015, detailing and guiding the implementation of a number of articles of the Labor Code.

6. Circular No. 29/2015/TT-BLDTBXH dated July 31, 2015, of the Ministry of Labor, Invalids and Social Affairs, guiding the collective bargaining, collective bargaining agreements and settlement of labor disputes prescribed in the Government's Decree No. 05/2015/ND-CP of January 12, 2015, detailing and guiding the implementation of a number of articles of the Labor Code.

7. Circular No. 35/2016/TT-BLDTBXH dated October 25, 2016, of the Ministry of Labor, Invalids and Social Affairs, providing guidance on implementation of employee policies in the context of transformation of public service establishments into Joint-Stock Companies under the Prime Minister’s Decision No. 22/2015/QD-TTg of June 22, 2015.

8. Circular No. 17/2018/TT-BLDTBXH dated October 17, 2018, specifying self-examination of the implementation of labor law by enterprises.

9. Circular No. 20/2018/TT-BLDTBXH dated November 26, 2018, of the Ministry of Labor, Invalids and Social Affairs, providing guidance on the coordination mechanism for conducting specialized inspections on labor, occupational safety and health during nighttime and outside of official working hours.

10. Decision No. 01/2006/QD-BLDTBXH dated February 16, 2006, of the Minister of Labor, Invalids and Social Affairs, promulgating the Regulation on state labor inspection activities under the regional inspector-in-charge mechanism.

11. Joint Circular No. 28/2010/TTLT-BLDTBXH-BNV dated September 16, 2010 of the Minister of Labor, Invalids and Social Affairs and the Minister of Home Affairs, providing guidance on the functions, tasks, powers, organizational structure, and staffing of post-rehabilitation management centers for drug addicts.

12. Joint Circular No. 43/2011/TTLT-BLDTBXH-BYT dated December 31, 2011, of the Minister of Labor, Invalids and Social Affairs and the Minister of Health, guiding the licensing and management of voluntary drug rehabilitation facilities.

13. Joint Resolution No. 01/2005/NQLT-BLDTBXH-BCA-BVHTT-UBTWMTTQVN dated November 17, 2005, of the Ministry of Labor, Invalids and Social Affairs, the Ministry of Public Security, the Ministry of Culture and Information, and the Central Committee of the Vietnam Fatherland Front, on regulating and guiding the content of activities, classification, and assessment of the building of drug- and prostitution-free communes, wards, and townships.

14. Joint Resolution No. 01/2008/NQLT-BLDTBXH-BCA-BVHTTDL-UBTUMTTQVN dated August 28, 2008, of the Ministry of Labor, Invalids and Social Affairs, the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, and the Central Committee of the Vietnam Fatherland Front, promulgating “Criteria for classification, scoring, assessment, and statistical reporting forms on the building of drug- and prostitution-free communes, wards, and townships”.

Article 2. Effect

This Circular takes effect from February 15, 2025.

Article 3. Implementation organization

The Director General of the Department of Legal Affairs, the Chief of the Ministry Office, state management units under the Ministry of Labor, Invalids and Social Affairs, and relevant agencies, organizations, and individuals shall implement this Circular./.
