Circular 06/2023/TT-BLDTBXH adjustment of pension, social insurance allowance and monthly allowance levels

CIRCULAR

Guiding the adjustment of pension, social insurance allowance and monthly allowances^[1]

Pursuant to the Government’s Decree No. 62/2022/ND-CP of September 12, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to the Government’s Decree No. 42/2023/ND-CP of June 29, 2023, on adjustment of pension, social insurance allowance and monthly allowances (below referred to as Decree No. 42/2023/ND-CP);

At the proposal of the Director of the Department of Social Insurance;

The Minister of Labor, War Invalids and Social Affairs promulgates the  Circular guiding the adjustment of pension, social insurance allowance and monthly allowances.

Article 1. Subjects of application

1. People specified at Points a, b, c, h and i, Clause 1, Article 1 of Decree No. 42/2023/ND-CP who enjoy pension, social insurance allowance and monthly allowances since before July 1, 2023.

2. People specified at Points a, b and c, Clause 1, Article 1 of Decree No. 42/2023/ND-CP who have retired and enjoy pension, social insurance allowance and monthly allowances since before January 1, 1995 (including those who have retired and enjoy working capacity loss allowance since before January 1, 1995, and then continue to enjoy allowances under the Prime Minister’s Decision No. 91/2000/QD-TTg of August 4, 2000, on allowances for people who have passed the retirement age at the time they are no longer entitled to the monthly working capacity loss allowance and the Prime Minister’s Decision No. 613/QD-TTg of May 6, 2010, on monthly allowances for people who have actually worked for between full 15 years and under 20 years but are no longer entitled to the working capacity loss allowance) and receive a pension, social insurance allowance or monthly allowance of under VND 3,000,000/month following the adjustment specified in Clause 1, Article 2 of this Circular.

Article 2. Adjustment of pension, social insurance allowance and monthly allowances

1. From July 1, 2023, pension, social insurance allowance and monthly allowances for people specified in Clause 1, Article 1 of this Circular shall be adjusted as follows:

a/ Pension, social insurance allowance and monthly allowances will increase by 12.5% compared to those of June 2013 for people specified in Clause 1, Article 1 of this Circular who have benefitted from the adjustment under the Government’s Decree No. 108/2021/ND-CP of December 7, 2021, on the adjustment of pension, social insurance allowance and monthly allowances. Specifically as follows:

b/ Pension, social insurance allowance and monthly allowances will increase by 20.8% compared to those of June 2013 for people specified in Clause 1, Article 1 of this Circular who have not yet benefitted from the adjustment under the Government’s Decree No. 108/2021/ND-CP of December 7, 2021, on the adjustment of pension, social insurance allowance and monthly allowances. Specifically as follows:

2. From July 1, 2023, the adjusted pension, social insurance allowance and monthly allowances mentioned in Clause 1 of this Article for people specified in Clause 2, Article 1 of this Circular shall be adjusted as follows:

a/ For people entitled to a pension, social insurance allowance or monthly allowance of under VND 2,700,000/month:

b/ For people entitled to a pension, social insurance allowance or monthly allowance of between VND 2,700,000 and under VND 3,000,000/month:

Article 3. Organization of implementation

1. Provincial-level People’s Committees shall direct provincial-level Departments of Labor, Invalids and Social Affairs and related functional agencies in disseminating, inspecting and urging the implementation of this Circular’s provisions on adjustment of pension, social insurance allowance and monthly allowances.

2. The Vietnam Social Security shall adjust pension, social insurance allowance and monthly allowances specified in Decree No. 42/2023/ND-CP and guidance of this Circular; send a report, made according to the form provided together with this Circular, to the Ministry of Labor, Invalids and Social Affairs and Ministry of Finance before December 31, 2023.

Article 4. Effect

1. This Circular takes effect on August 14, 2023. This Circular’s provisions will be applied from July 1, 2023.

2. Clauses 1 and 2 of Article 1; Articles 2 and 4, and Clause 2, Article 5 of the Minister of Labor, Invalids and Social Affairs’ Circular No. 37/2021/TT-BLDTBXH of December 31, 2021 guiding the adjustment of pension, social insurance allowance and monthly allowances and time of pension enjoyment for people whose original dossiers no longer exist will cease to be effective on the effective date of this Circular.

Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Labor, Invalids and Social Affairs for study and settlement.
