CIRCULAR

Guiding the adjustment of pension, social insurance allowance and monthly allowance levels

Pursuant to the Government’s Decree No. 62/2022/ND-CP of September 12, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to the Government’s Decree No. 42/2023/ND-CP of June 29, 2023 on adjustment of pension, social insurance allowance and monthly allowance levels (below referred to as Decree No. 42/2023/ND-CP);

At the proposal of the Director of the Department of Social Insurance;

The Minister of Labor, Invalids and Social Affairs promulgates the Circular guiding the adjustment of pension, social insurance allowance and monthly allowance levels.

Article 1. Subjects of application

1. People specified at Points a, b, c, h and i, Clause 1, Article 1 of Decree No. 42/2023/ND-CP who are on pension, social insurance allowances and monthly allowances before July 1, 2023.

2. People specified at Points a, b and c, Clause 1, Article 1 of Decree No. 42/2023/ND-CP who have taken leave on pension, social insurance allowances and monthly allowances before January 1, 1995 (including those who have taken leave for working capacity loss allowance before January 1, 1995, and then continued to enjoy allowance under the Prime Minister’s Decision No. 91/2000/QD-TTg of August 4, 2000 on allowances for people who reach retirement age and are ineligible for monthly working capacity loss allowance and the Prime Minister’s Decision No. 613/QD-TTg of May 6, 2010 on monthly allowances for people who have actually worked for between 15 and 20 years but are no longer eligible for the working capacity loss allowance) that are adjusted under Clause 1, Article 2 of this Circular receive a pension, social insurance allowance or monthly allowance amount of under VND 3,000,000/month.

Article 2. Adjustment of pension, social insurance allowance and monthly allowance levels

1. From July 1, 2023, the pension, social insurance allowance and monthly allowance levels for people specified in Clause 1, Article 1 of this Circular shall be adjusted as follows:

a/ The pension, social insurance allowance and monthly allowance levels will increase by 12.5% compared to those of June 2013 for people specified in Clause 1, Article 1 of this Circular that have already been adjusted under the Government’s Decree No. 108/2021/ND-CP of December 7, 2021 on the adjustment of pension, social insurance allowance and monthly allowance levels. Specifically as follows:

b/ The pension, social insurance allowance and monthly allowance levels will increase by 20.8% compared to those of June 2013 for people specified in Clause 1, Article 1 of this Circular that have not been adjusted under the Government’s Decree No. 108/2021/ND-CP of December 7, 2021 on the adjustment of pension, social insurance allowance and monthly allowance levels. Specifically as follows:

2. From July 1, 2023, the pension, social insurance allowance and monthly allowance levels for people specified in Clause 2, Article 1 of this Circular that are adjusted under Clause 1 of this Article shall be adjusted as follows:

a/ For people who receive a pension, social insurance allowance or monthly allowance amount of under VND 2,700,000 /month:

b/ For people who receive a pension, social insurance allowance and monthly allowance amount of between VND 2,700,000 /month and under VND 3,000,000/month:

Article 3. Organization of implementation

1. Provincial-level People's Committees shall direct Departments of Labor, Invalids and Social Affairs and related functional agencies to disseminate, inspect and urge the compliance with regulations on the adjustment of pension, social insurance allowance and monthly allowance levels in this Circular.

2. Vietnam Social Security shall adjust pension, social insurance allowance and monthly allowance levels specified in Decree No. 42/2023/ND-CP and guidance of this Circular; send a report, made according to the form provided in this Circular, to the Ministry of Labor, Invalids and Social Affairs and Ministry of Finance before December 31, 2023.

Article 4. Effect

1. This Circular takes effect on August 14, 2023. Regulations of this Circular shall be applied from July 1, 2023.

2. Clauses 1 and 2 of Article 1, Articles 2 and 4 and Clause 2 of Article 5 of the Minister of Labor, Invalids and Social Affairs’ Circular No. 37/2021/TT-BLDTBXH of December 31, 2021 guiding the adjustment of pension, social insurance allowance and monthly allowance levels and the time for people who no longer has original dossiers entitled to pensions will cease their effective from the effective date of this Circular.

Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Labor, Invalids and Social Affairs for study and settlement.
