SUMMARY

Adjustments to the 2024 law- and ordinance-making program

On December 18, 2023, the National Assembly Standing Committee issues Resolution No. 41/2023/UBTVQH15 on adjustments to the 2024 law- and ordinance-making program. Bellows are a number of remarkable contents of this Resolution:

1. To add the following draft laws to the 2024 law- and ordinance-making program with policies as basically proposed by the Government:

- To submit the following draft laws to the National Assembly for discussion at its 7th session (May 2024) and passage at its 8th session (October 2024):

  • Law on Management and Use of Weapons, Explosives and Supporting Tools (amended).

In case the draft law is prepared with good quality and obtains high consensus among lawmakers during the National Assembly’s debate, the National Assembly Standing Committee will consider and coordinate with the Government in submitting it to the National Assembly for passage at the 7th session (May 2024) according to the process for consideration and passage of laws at a single session;

  • Law on Human Trafficking Prevention and Combat (amended);
  • Law on Value-Added Tax (amended);

- To submit the draft Law on Chemicals to the National Assembly (amended) for discussion at the 8th session (October 2024).

2. The National Assembly Standing Committee shall request the Government to direct ministries and drafting agencies to study and assimilate opinions of the National Assembly Standing Committee and verification opinions of National Assembly agencies so as to promptly prepare dossiers of draft laws, ensuring their quality and schedule; in the course of drafting, if adjustments or supplementation are/is needed to the proposed policies, to conduct impact assessment in accordance with the Law on Promulgation of Legal Documents.

- To submit to the National Assembly Standing Committee for consideration and commenting on the 3 drafts, namely the Law on Management and Use of Weapons, Explosives and Supporting Tools (amended), Law on Human Trafficking Prevention and Combat (amended), Law on Value-Added Tax (amended) at the March 2024 session, no later than the April 2024 session; and the Chemical Law (amended) at the August 2024 session;

- To continue directing the review and acceleration of the preparation of and promptly make requests for, formulation of draft laws on taxes and improvement of the business investment environment and other necessary laws;

This Resolution takes effect on the date of its adoption.

RESOLUTION

On adjustments to the 2024 law- and ordinance-making program[1]

 

THE NATIONAL ASSEMBLY STANDING COMMITTEE

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Law No. 57/2014/QH13 on Organization of the National Assembly, which had a number of articles amended and supplemented under Law No. 65/2020/QH14;

Pursuant to Law No. 80/2015/QH13 on Promulgation of Legal Documents, which had a number of articles amended and supplemented under Law No. 63/2020/QH14;

Considering the Government’s Reports No. 435/TTr-CP of September 5, 2023; No. 556/TTr-CP of October 16, 2023; and No. 668/TTr-CP of November 27, 2023, and the Committee on Legal Affairs’ Appraisal Report No. 2418/BC-UBPL15 of December 15, 2023;

RESOLVES:

Article 1. Adjustments to the 2024 law- and ordinance-making program

To add the following draft laws to the 2024 law- and ordinance-making program with policies as basically proposed by the Government:

1. To submit the following draft laws to the National Assembly for discussion at its 7th session (May 2024) and passage at its 8th session (October 2024):

a/ Law on Management and Use of Weapons, Explosives and Supporting Tools (amended).

In case the draft law is prepared with good quality and obtains high consensus among lawmakers during the National Assembly’s debate, the National Assembly Standing Committee will consider and coordinate with the Government in submitting it to the National Assembly for passage at the 7th session (May 2024) according to the process for consideration and passage of laws at a single session;

b/ Law on Human Trafficking Prevention and Combat (amended);

c/ Law on Value-Added Tax (amended);

2. To submit the draft Law on Chemicals (amended) to the National Assembly for discussion at the 8th session (October 2024).

Article 2. Organization of implementation

1. To assign agencies to submit, agencies in charge of, and agencies participating in, verifying draft laws to be added to the 2024 law- and ordinance-making program as follows:

2. To request the Government:

a/ To direct ministries and drafting agencies to study and accept opinions of the National Assembly Standing Committee and verification opinions of National Assembly agencies so as to promptly prepare dossiers of draft laws, ensuring their quality and schedule; in the course of drafting, if adjustments or supplementation are/is needed to the proposed policies, to conduct impact assessment in accordance with the Law on Promulgation of laws;

b/ To submit to the National Assembly Standing Committee for consideration and debate on the 3 draft laws, namely the Law on Management and Use of Weapons, Explosives and Supporting Tools (amended), Law on Human Trafficking Prevention and Combat (amended), and Law on Value-Added Tax (amended) at the March 2024 session or no later than the April 2024 session; and the Law on Chemicals (amended) at the August 2024 session;

c/ To continue directing the review and acceleration of the preparation of and promptly make proposals for, formulation of draft laws on taxes and improvement of the business investment environment and other necessary laws already set out in the National Assembly’s resolutions and the National Assembly Standing Committee’s Plan No. 81/KH-UBTVQH15 to submit them to the National Assembly for consideration and decision on addition to the law- and ordinance-making program. In emergency cases, such draft laws shall be submitted to the National Assembly Standing Committee for consideration of and decision on addition to the law- and ordinance-making program, meeting urgent practical requirements and ensuring synchronicity and consistency of the legal system.

Article 3. Effect

This Resolution takes effect on the date of its adoption.

This Resolution was adopted on December 18, 2023, by the Standing Committee of the 15th National Assembly of the Socialist Republic of Vietnam at its 28th session.-
