Regulating standards, conditions for promotion of professional titles of lecturers in public higher education institutions and teachers’ training colleges

Pursuant to the Law on Public Employees dated November 15, 2010; Law amending and supplementing a number of articles of the Law on Cadres, Civil Servants and the Law on Public Employees dated November 25, 2019;

Pursuant to the Law on Education dated June 14, 2019;

Pursuant to the Government’s Decree No. 86/2022/ND-CP dated October 24, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;

Pursuant to the Government’s Decree No. 115/2020/ND-CP dated September 25, 2020, regulating recruitment, employment and management of public employees; Government’s Decree No. 85/2023/ND-CP dated December 7, 2023, amending and supplementing a number of articles of Decree No. 115/2020/ND-CP dated September 25, 2020, regulating on recruitment, employment and management of public employees;

At the request of the Director of the Teachers and Educational Managers Department;

The Minister of Education and Training hereby promulgates the Circular regulating standards, conditions for promoting of professional titles of lecturers in public higher education institutions and teachers’ training colleges.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation 

This Circular regulates the standards and conditions for promotion of professional titles in public higher education institutions and teachers’ training colleges, and public colleges that have Preschool Education major at a college level (herein after referred to as teachers’ training colleges).

Article 2. Subjects of application

1. This Circular applies to teaching officers in public higher education institutions and teachers’ training colleges registering for consideration of professional title promotion and related organizations, individuals.

2. This Circular does not apply to people working in teaching positions at education institutions under the Ministry of National Defense and the Ministry of Public Security.

Chapter II

STANDARDS, CONDITIONS FOR PROMOTING OF LECTURERS IN PUBLIC HIGHER EDUCATION INSTITUTIONS 
 

Article 3. Standards and conditions for consideration of promoting to the professional title of principal lecturer (grade II), code V.07.01.02

Teaching officers in public higher education institutions can register for consideration for promotion to the professional title of principal lecturer (grade II), code V.07.01.02 when meeting all the following standards and conditions:

1. The public higher education institution has a need, has a vacant job position corresponding to the professional title class that the officer is considered for promotion and is appointed by a competent authority to participate in the promotion review period.

2. Holding the professional title of lecturer (class III), code V.07.01.03.

3. Having quality classified at the level of completing tasks well or better in the working year immediately preceding the year of consideration for promotion to the professional title of principal lecturer (class II), code V.07.01.02; having good political quality and professional ethics; neither in the disciplinary period nor during the implementation of regulations related to disciplinary according to the Party's regulations and the law.

4. Meeting the requirements for minimum working time holding the professional title of lecturer (class III), code V.07.01.03; meeting the standards of training, retraining and professional capacity of the professional title of principal lecturer (class II), code V.07.01.02 specified in Clause 2, Clause 3, Article 6 of Circular No. 40/2020/TT-BGDDT dated October 26, 2020 of the Minister of Education and Training on regulating codes, standards for professional titles, appointment and salary ranking for lecturers in public higher education institutions and amended and supplemented in Circular No. 04/2022/TT-BGDDT dated March 4, 2022 of the Minister of Education and Training amending and supplementing some articles of Circular No. 35/2020/TT-BGDDT dated October 1, 2020 regulating codes, standards for professional titles, appointment and salary ranking for lecturers in public teachers’ training colleges and Circular No. 40/2020/TT-BGDDT dated October 26, 2020 regulating codes, standards for professional titles, appointment and salary ranking for lecturers in public higher education institutions.

Article 4. Standards and conditions for consideration of promoting to the professional title of senior lecturer (grade I), code V.07.01.01

Lecturers in public higher education institution can register for promotion to the professional title of senior lecturer (grade I), code V.07.01.01 when meeting all the following standards and conditions:

1. The public higher education institution has a need, has a vacant job position corresponding to the professional title class that the officer is considered for promotion and is appointed by a competent authority to participate in the promotion review period.

2. Holding the professional title of principal lecturer (class II), code V.07.01.02.

3. Having quality classified at the level of completing tasks well or better in the working year immediately preceding the year of consideration for promotion to the professional title of senior lecturer (rank I), code V.07.01.01; having good political quality and professional ethics; neither in the disciplinary period nor during the implementation of regulations related to disciplinary according to the Party's regulations and the law.

4. Meeting the minimum working time requirements to hold the professional title of principal lecturer (class II), code V.07.01.02; meeting the standards of training, retraining and professional capacity of the professional title of senior lecturer (class I), code V.07.01.01 specified in Clause 2, Clause 3 Article 7 Circular No. 40/2020/TT-BGDDT, amended, supplemented under Circular No. 04/2022/TT-BGDDT.

Chapter III

STANDARDS, CONDITIONS FOR PROMOTING OF LECTURERS IN TEACHERS’ TRAINING COLLEGE

Article 5. Standards and conditions for consideration of promoting to the professional title of principal lecturer of a teachers’ training college (grade II), code V.07.08.21

Lecturers in a teachers’ training college may register for promoting to the professional title of principal lecturer of a teachers’ training college (grade II), code V.07.08.21 when meeting all the following standards and conditions:

1. The teachers’ training college has a need, has a vacant job position corresponding to the professional title class that the officer is considered for promotion and is appointed by a competent authority to attend the promotion review period.

2. Holding the professional title of lecturer of a teachers’ training college (grade III), code V.07.08.22.

3. Having quality classified at the level of completing tasks well or better in the working year immediately preceding the year of consideration for promotion to the professional title of principal lecturer of a teachers’ training college (class II), code V.07.08. 21; having good political quality and professional ethics; neither in the disciplinary period nor during the implementation of regulations related to disciplinary according to the Party's regulations and the law.

4. Meeting the requirements for minimum working time holding the professional title of lecturer of a teachers’ training college (class III), code V.07.08.22; meeting the standards for training, retraining and professional capacity of the professional title of principal lecturer of a teachers’ training college (class II), code V.07.08.21 specified in Clause 2, Clause 3, Article 5, Circular No. 35/2020/TT-BGDDT dated October 1, 2020 of the Minister of Education and Training stipulating codes, professional title standards, appointment and salary ranking for lecturers in public teachers’ training college, as amended, supplemented under Circular No. 04/2022/TT-BGDDT.

Article 6. Standards and conditions for consideration of promoting to the professional title of senior lecturer of a teachers’ training college (grade I), code V.07.08.20

Lecturers in teachers’ training colleges of education may register for promotion to the professional title of senior lecturer of a teachers’ training college (grade I), code V.07.08.20 when meeting all the standards and conditions as follow:

1. The teachers’ training college has a need, has a vacant job position corresponding to the professional title class that the officer is considered for promotion and is appointed by a competent authority to attend the promotion review period.

2. Holding the professional title of principal lecturer of a teachers’ training college (grade II), code V.07.08.21.

3. Having quality classified at the level of completing the task well or better in the working year immediately preceding the year of consideration for promotion to the professional title of senior lecturer of a teachers’ training college (grade I), code V.07.08.20; having good political quality and professional ethics; neither in the disciplinary period nor during the implementation of regulations related to disciplinary according to the Party's regulations and the law

4. Meeting the minimum working time requirement holding the professional title of principal lecturer of a teachers’ training college (grade II), code V .07.08.21; meeting the standards of training, retraining and professional capacity of senior lecturer of a teachers’ training college (grade I), code V.07.08.20 specified in Clause 2, Clause 3, Article 6 of Circular No. 35/2020/TT-BGDDT, amended and supplemented under Circular No. 04/2022/TT-BGDDT.

Chapter IV

ORGANIZATION IMPLEMENTATION

Article 7. Implementation provisions

1. This Circular takes effect from June 1, 2024.

2. Circular No. 31/2021/TT-BGDDT dated November 10, 2021 of the Minister of Education and Training regulating standards and conditions for examination or promotion consideration; content, form and determination of successful candidates in the examination for promotion of professional titles of lecturers in teachers’ training colleges and of public higher education institutions, ceases to be effective from the effective date of this Circular.

Article 8. Organization implementation

1. Ministers, heads of ministerial-level agencies, heads of Government-attached agencies, Chairpersons of People’s Committees of provinces and centrally-run cities, Heads of public higher education institutions, Principals of teachers’ training colleges and relevant agencies, organizations and individuals are responsible for implementing this Circular.

2. In case the documents referred to in this Circular are amended, supplemented or replaced, the new documents shall apply.

3. Any problems arising during the implementation should be reported to the Ministry of Education and Training for guidance or consideration, resolution./.
