DECREE

STIPULATING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE COMMITTEE FOR POPULATION, FAMILY AND CHILDREN

THE GOVERNMENT

Pursuant to the Law on Organization of the Government of December 25, 2002;

Pursuant to Resolution No. 02/2002/QH11 of August 5, 2002 of the XIth National Assembly of the Socialist Republic of Vietnam, first session, on the list of the ministries and ministerial-level agencies of the Government;

Pursuant to October 4, 2002 Resolution No. 11/2002/NQ-CP of the Government’s September 2002 regular meeting;

Pursuant to the Government’s Decree No. 86/2002/ND-CP of November 5, 2002 stipulating the functions, tasks, powers and organizational structure of the ministries and ministerial-level agencies;

At the proposals of the minister-chairman of the Committee for Population, Family and Children and the Minister of the Interior,

DECREES:

Article 1.-Position and functions

The Committee for Population, Family and Children is a ministerial-level agency of the Government, performing the function of State management over population, family and children as well as State management over public services in the domain of population, family and children.

Article 2.-Tasks and powers

The Committee for Population, Family and Children shall have to perform its tasks and exercise its powers prescribed in the Government’s Decree No. 86/2002/ND-CP of November 5, 2002 on functions, tasks, powers and organizational structure of the ministries and ministerial-level agencies, as well as the following specific tasks and powers:

1. To submit to the Government bills, draft ordinances and other legal documents on population, family and children;

2. To submit to the Government development strategies, plannings, long-term, five-year and annual plans, national target programs, action programs and important works on population, family and children;

3. To promulgate legal documents and standards on population, family and children according to its competence;

4. To organize and direct the implementation of legal documents, development strategies, plannings, long-term, five-year and annual plans after they are approved, as well as the national target programs and action programs; to propagate, popularize and educate laws and information on population, family and children at home and abroad;

5. To work out plans for action coordination among the ministries, ministerial-level agencies, agencies attached to the Government, provincial-level People’s Committees, socio-political organizations and social organizations at the central level in performing the tasks on population, family and children;

6. To assume the prime responsibility for and guide the population registration, summarization and analysis of population situation; to gather and archive information on population, family and children; to coordinate with the ministries, ministerial-level agencies, agencies attached to the Government and provincial-level People’s Committees in population distribution among localities throughout the country;

7. To assume the prime responsibility and coordinate with the ministries, ministerial-level agencies, agencies attached to the Government and guide the provincial-level People’s Committees in formulating and organizing the implementation of family planning programs; to organize and direct the building of prosperous, equal, progressive, happy and sustainably developed families;

8. To coordinate with the Ministry of Labor, War Invalids and Social Affairs in protecting and caring for disabled children, orphans, and with the Ministry of Health in caring for malnourished children.

9. To direct the drawing of practical experience and the multiplication of models in the domain of population, family and children;

10. To appraise and inspect the execution of investment projects in the domain of population, family and children according to the provisions of law;

11. To undertake the international cooperation in the domain of population, family and children according to the provisions of law;

12. To organize and direct the implementation of plans for scientific research into and application of scientific and technological advances to the domain of population, family and children;

13. To decide on specific policies and measures and direct the implementation of the operation mechanism of public-service organizations in the domain of population, family and children according to the provisions of law; to manage and direct operations of non-business organizations attached to the Committee;

14. To mobilize financial aid sources, and manage and use the Child Protection Fund at the central level; to direct and inspect the management and use of the child protection funds at all levels and in all branches;

15. To perform the State management over activities of societies and non-governmental organizations operating in the domain of population, family and children according to the provisions of law;

16. To inspect, scrutinize and settle complaints and denunciations against corruption and negative acts, and handle violations of the legislation on population, family and children falling under its competence;

17. To decide on and direct the implementation of its own administrative reform program in line with the objectives and content of the State administrative reform program already approved by the Prime Minister;

18. To manage its organizational apparatus and payroll; to direct the implementation of wage regime as well as regimes and policies on preferential treatment, commendation, reward and discipline of officials, public servants and State employees under its management; and to provide professional training and fostering to officials, public servants, State employees and workers in the domain of population, family and children;

19. To manage the finance and property assigned to it, and organize the realization of the budget allocated to it according to the provisions of law.

Article 3.-Organizational structure of the Committee

a/ Organizations assisting the minister-chairman of the Committee in performing the State management function:

1. The Population Department;

2. The Family Department;

3. The Children Department;

4. The Communications - Education Department;

5. The Planning - Finance Department;

6. The International Cooperation Department;

7. The Organization and Personnel Department;

8. The Legal Department;

9. The Inspectorate;

10. The Office.

b/ The non-business organizations attached to the Committee:

1. The Institute for Population, Family and Children Sciences;

2. The Center for Training and Fostering Officials and Public Employees;

3. The Information Center;

4. The Family and Children magazine;

5. The Family and Society newspaper.

Article 4.-Part-time members of the Committee

Part-time members of the Committee shall be proposed by the minister-chairman of the Committee for Population, Family and Children to the Prime Minister for decision.

Article 5.-Implementation effect

This Decree takes effect after its signing.

To annul the Government’s Decree No. 42/CP of June 21, 1993 on the functions, tasks, powers, organizational structure and working style of the Committee for Population, Family and Children and Decree No. 118/CP of September 7, 1994 on the functions, tasks, powers and organizational structure of Vietnam Committee for Child Protection and Care.

Article 6.-Implementation responsibilities

The minister-chairman of the Committee for Population, Family and Children, the other ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and centrally-run cities shall have to implement this Decree.
