DECREE
On specific regimes and policies applicable to the Executive Board of the International Financial Centre in Vietnam
Pursuant to Law No. 63/2025/QH15 on Organisation of the Government;
Pursuant to Law No. 80/2025/QH15 on Cadres and Civil Servants;
Pursuant to the National Assembly’s Resolution No. 222/2025/QH15 on the International Financial Centre in Vietnam;
At the proposal of the Minister of Home Affairs;
The Government promulgates the Decree on specific regimes and policies applicable to the Executive Board of the International Financial Centre in Vietnam.
Article 1. Scope of regulation
This Decree provides specific regimes and policies applicable to the Executive Board of the International Financial Centre in Vietnam (below referred to as the Executive Board), persons working in the Assisting Body of the Executive Board (below referred to as the Assisting Body), and the Advisory Council of the International Financial Centre (below referred to as the Advisory Council).
Article 2. Subjects of application
1. The Chairperson, Vice Chairpersons and members of the Executive Board.
2. Persons working in the Assisting Body and the Advisory Council.
3. Other related agencies, organisations and individuals.
Article 3. Principles of implementation
1. The implementation of regimes and policies for the Executive Board, the Assisting Body and the Advisory Council must fully comply with the Party’s guidelines and the State’s laws, and must not contravene treaties to which Vietnam is a contracting party.
2. Cadres, civil servants and public employees seconded to work at the Assisting Body shall cease holding their current job positions to perform duties at the Assisting Body, and continue to receive their current salary and leadership allowances (if any); their period of working at the Assisting Body shall be counted as continuous service for the application of regimes and policies in accordance with regulations.
3. Funding for implementation of the regimes and policies provided in this Decree shall be allocated from the state budget and other lawful sources. State budget funds shall be included in state budget expenditure estimates of the Government Office.
4. The recruitment, receipt, evaluation, and performance-based remuneration for persons working at the Assisting Body and the Advisory Council must comply with regulations issued by the Executive Board. Evaluation results shall be used as a basis for implementation of regimes and policies or termination of contracts.
Article 4. Regimes and policies applicable to the Executive Board
1. In case the Chairperson, Vice Chairpersons and members of the Executive Board work on a part-time basis, they may, in addition to their monthly salary, receive an allowance equal to 50% of their current salary (position-based salary or civil servant rank-based salary plus leadership allowance). This allowance shall not be used for collecting premiums to and enjoying benefits from compulsory social insurance and health insurance.
2. In case the Executive Board’s Chairperson works on a full-time basis, he/she is entitled to the following regimes and policies:
a/ The current salary and salary-based allowances (if any) and an additional monthly allowance equal to 80% of the current salary. This additional allowance shall not be used for collecting premiums to and enjoying benefits from compulsory social insurance and health insurance.
b/ The regimes and policies on bonus, housing, vehicles for travel, working conditions, honouring, commendation, healthcare, convalescence and annual leave as specified in Clauses 2, 5, 6 and 7, Article 24 of the Government’s Decree No. 231/2025/ND-CP of August 26, 2025, on the recruitment and employment of general engineers and chief architects in the fields of science, technology, innovation and national digital transformation.
3. In case members of the Executive Board work on a full-time basis, they are entitled to regimes and policies equivalent to those applicable to the head of the Assisting Body as specified in Clauses 1 and 3, Article 5 of this Decree.
Article 5. Regimes and policies applicable to persons working at the Assisting Body
1. The Chairperson of the Executive Board shall decide on recruitment, management and employment of cadres, civil servants and public employees for the Assisting Body. The head and deputy heads of the Assisting Body are entitled to regimes equivalent to those applicable to leaders of department-level units under ministries.
2. The Executive Board shall, based on the proposal of the head of the Assisting Body, decide on the number of and select personnel to work for the Assisting Body.
3. Persons recruited or seconded to work for the Assisting Body are entitled to the following regimes and policies:
a/ Salary based on civil servant rank or public employee title; leadership allowance (if any); beyond-salary-scale seniority allowance (if any); and other salary-based allowances applicable to administrative civil servants; and an additional monthly allowance equal to 80% of the current salary applicable to civil servant ranks or public employee titles. This additional allowance shall not be used for collecting premiums to and enjoying benefits from compulsory social insurance and health insurance.
For persons recruited for their talent or cadres, civil servants and public employees evaluated as having outstanding capacity and qualifications and recognised as talented persons by their managing agencies or units, they are entitled to an additional monthly allowance equal to 150% of their current salary under the Government’s Decree No. 179/2024/ND-CP dated December 31, 2024, on policies to attract and preferentially treat talented persons to work for agencies, organisations and units of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front and socio-political organisations.
b/ They may use equipment and working facilities necessary to perform assigned tasks. When necessary, resources and special equipment may be provided for implementing programs, schemes, themes and scientific researches evaluated by competent authorities as feasible and proposed for application in practice.
c/ They may be considered for sending to domestic and international seminars and training courses relevant to their occupations, working fields and assigned tasks and those to be developed, or short-term training courses of up to one year and domestic and international specialised training courses with international certificates in their occupations, working fields and assigned tasks and those to be developed.
d/ Upon finishing their working period, if evaluated with good performance or higher, they may be arranged jobs by their managing agencies to a position equal to or higher than the previous position.
dd/ If evaluated with outstanding performance, they may be considered for appointment to a leadership position higher than the previous leadership position; and be considered by competent authorities for application of special cases if they have yet to satisfy the criteria and conditions on planning, age, or duration of holding of the equivalent position.
e/ If not meeting task requirements, they will be assigned back to their former agencies, organisations or units, which shall arrange jobs suitable to the capacity of cadres, civil servants and public employees and practical conditions of the agencies, organisations or units.
g/ If evaluated with poor performance associated with their assigned tasks and jobs, they will be subject to staff downsizing in accordance with current regulations on staff downsizing.
4. The head of the Assisting Body shall, based on working demands, decide to enter into labour contracts with workers for performing support and service jobs at the Assisting Body; salaries and bonuses shall be agreed based on job requirements, and capacity, contributions and performance of workers.
Article 6. Regimes and policies applicable to experts of the Advisory Council
1. Based on employment needs, tasks and operation objectives of the Executive Board, the Chairperson of the Executive Board shall sign labour contracts with reputable domestic and international financial and legal experts to act as members of the Advisory Council.
2. Experts of the Advisory Council shall work under labour contracts and receive salaries as agreed. The Chairperson of the Executive Board shall decide on salary levels and agreements in labour contracts with experts of the Advisory Council, based on job requirements, and capacity, contributions, academic degrees, professional experience and performance of experts.
3. Vietnamese experts working for the Advisory Council who are in the working age as prescribed by the labour law and, after their term of office in the Advisory Council, wish to work for a long term in the agencies, organisations or units in the political system, they may be considered by competent authorities for recruitment as civil servants or public employees, and receive salary based on their job positions and an additional allowance equal to 150% of their salary according to civil servant ranks or public employee titles for 5 years. Their period of working at the Advisory Council shall be counted for salary ranking based on job positions after they are recruited.
Article 7. Organisation of implementation
1. The Ministry of Finance shall allocate annual state budgets for the operation of the Executive Board, the Assisting Body and the Advisory Council in accordance with the law on the state budget and specialised laws.
2. The Executive Board shall promulgate the Operation Regulations of the Executive Board, the Assisting Body and the Advisory Council.
3. The Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with the Ministry of Finance and related agencies in, guiding and inspecting the implementation of regimes and policies for the Executive Board, the Assisting Body and the Advisory Council in accordance with this Decree.
4. Ministries, ministerial-level agencies and provincial-level People’s Committees shall, within the ambit of their functions and tasks, coordinate with the Executive Board as requested by the Chairperson of the Executive Board during the operation of the Executive Board.
Article 8. Effect
1. This Decree takes effect on March 31, 2026.
2. In case the documents referred to in this Decree are amended, supplemented or replaced, the corresponding provisions of the amending, supplementing or replacing documents shall apply.
Article 9. Implementation responsibility
Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and related organisations and individuals shall implement this Decree.-
