Decree No. 73/2018/ND-CP dated May 15, 2018 of the Government on the Lists of Narcotic Substances and Precursors
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Law on Drug Prevention and Fight dated December 09, 200 and the Law on amendments to the Law on Drug prevention and control dated June 03, 2008;
Pursuant to the Law on amendments to the Criminal Code dated June 20, 2017;
Pursuant to the Law on Chemicals dated November 21, 2007;
Pursuant to the Law on Pharmacy dated April 06, 2016;
At the request of the Minister of Public Security;
The Government promulgates a Decree on the List of Narcotic Substances and Precursors
Article 1. The Lists of Narcotic Substances and Precursors
The Lists of Narcotic Substances and Precursors promulgated together with this Decree include:
List I: Narcotic substances banned from healthcare and life, the use of which for analysis, testing, scientific research and criminal investigation is subject to permission by competent authorities.
List II: Narcotic substances restricted from analysis, testing, scientific research, criminal investigation or healthcare as regulated by competent authorities.
List III: Narcotic substances permitted in analysis, testing, scientific research, criminal investigation, healthcare and veterinary medicine as regulated by competent authorities.
List IV: Precursors.
The Ministry of Public Security is responsible for management, licensing of export and import of precursors serving national defense and security. The Ministry of Agriculture and Rural Development is responsible for management, licensing of export and import of precursors serving veterinary medicine.
Article 2. Effect
1. This Decree takes effect on the signing date.
2. The Government's Decree No. 82/2013/ND-CP dated July 19, 2013 on Lists of narcotic substances and precursors, the Government's Decree No. 126/2015/ND-CP dated December 09, 2015 on revisions to the Lists promulgated together with Decree No. 82/2013/ND-CP are expired from the effective date of this Decree.
3. The trade of N-Phenethyl-4-piperidine (NPP) and 4-ANPP shall be regulated by regulations of this Decree and relevant documents from July 01, 2018.
Article 3. Implementation
1. Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People’s Committees of provinces are responsible for the implementation of this Decree.
2. The Ministry of Agriculture and Rural Development is responsible for management of veterinary medicines that contain narcotic substances and precursors as prescribed in the Government's Decree No. 58/2003/ND-CP dated May 29, 2003 on control of import, export and transit through Vietnam of narcotic substances, precursors, narcotic drugs and psychotropic drugs; the Government's Decree No. 80/2001/ND-CP dated November 05, 2001 providing guidelines for control of legal drug-related activities in Vietnam.
3. In case of discovery of a new substance relevant to production or use of narcotic substances or 03 International Drug Control Conventions of UNODC and such substance that cannot be found in any of the Lists enclosed herewith, the Ministry of Public Security shall take charge and cooperate with the Ministry of Health, the Ministry of Industry and Trade, the Ministry of Science and Technology, the Ministry of Agriculture and Rural Development and relevant authorities in proposing revisions to the Lists to the Government./.
