Decree 68/2021/ND-CP guiding pilot appointment of the title of full-time deputies of Hanoi People’s Council

DECREE

Detailing and guiding the implementation of the National Assembly’s Resolution No. 160/2021/QH14 of April 8, 2021, on pilot appointment of the title of full-time deputies of the Hanoi People’s Council ^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the June 19, 2015 Law on Organization of Local Administration;

Pursuant to the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the National Assembly’s Resolution No. 97/2019/QH14 of November 17, 2019, on pilot organization of the urban administration model in Hanoi;

Pursuant to the National Assembly’s Resolution No. 160/2021/QH14 of April 8, 2021, on pilot appointment of the title of full-time deputies of the Hanoi People’s Council;

At the proposal of the Minister of Home Affairs;

The Government promulgates the Decree detailing and guiding the implementation of the National Assembly’s Resolution No. 160/2021/QH14 of April 8, 2021, on pilot appointment of the title of full-time deputies of the Hanoi People’s Council.

Article 1. The title of full-time members of the Boards of the Hanoi People’s Council specified in Clause 2, Article 1 of the National Assembly’s Resolution No. 160/2021/QH14 of April 8, 2021, on pilot appointment of the title of full-time deputies of the Hanoi People’s Council

1. Each Board of the Hanoi People’s Council shall have 1 full-time member. Full-time members shall be considered and approved by the Standing Committee of the Hanoi People’s Council at the request of the heads of the Boards of the People’s Council.

2. The title of full-time members at the Boards of the Hanoi People’s Council shall be determined as follows:

a/ Full-time members of the Legal Board;

b/ Full-time members of the Economics and Budget Board;

c/ Full-time members of the Culture-Social Affairs Board;

d/ Full-time members of the Urban Board.

3. Criteria for the title of a full-time member:

a/ Being an incumbent deputy of the Hanoi People’s Council;

b/ Holding a university or higher degree; having professional qualifications suitable to the title of a full-time member of each Board of the municipal People’s Council as specified in Clause 2 of this Article; having practical experience and capacity to participate in performing duties of the Board of the municipal People’s Council.

4. Full-time members shall be entitled to wages according to current regulations applicable to cadres and civil servants; and be entitled to position-based allowance equivalent to that of the title of the head of department-level divisions and other regimes and policies as specified by law.

Article 2. Effect

This Decree takes effect on the date of its signing.

Article 3. Implementation responsibility

1. The Ministry of Home Affairs shall inspect the implementation of this Decree.

2. The Hanoi People’s Council and Hanoi People’s Committee shall, within the ambit of their tasks and powers, implement this Decree.

3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of the Hanoi People’s Council and Hanoi People’s Committee, and related agencies, organizations and individuals shall implement this Decree.-
