Decree No. 54/2020/ND-CP amending the Decree No. 127/2015/ND-CP

On amending and supplementing a number of articles of the Decree No. 127/2015/ND-CP dated December 14, 2015 of the Government on organization and operation of specialized inspection in Industry and Trade sector

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Law on Inspection dated November 15, 2010;

Pursuant to the Law on Handling of Administrative Violations dated June 20, 2012;

Pursuant to the Law on petroleum dated July 06, 1993, Law amending and supplementing a number of articles of the Petroleum Law dated June 09, 2000, Law amending and supplementing a number of articles of the Petroleum Law dated June 03, 2008;

Pursuant to the Law on Electricity dated December 03, 2004, the Law on amending and supplementing a number of articles of the Law on Electricity dated November 20, 2012;

Pursuant to the Law on Commercial date June 14, 2005;

Pursuant to the Law on Chemicals dated November 21, 2007;

Pursuant to the Law on Food Safety dated June 17, 2010;

Pursuant to the Law on Protection of Consumer Rights dated November 17, 2010;

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Law on Competition date June 12, 2018;

Pursuant to the Ordinance on market management dated March 08, 2016;

At the proposal of the Minister of Industry and Trade;

The Government hereby promulgates the Decree on amending and supplementing a number of articles of the Decree No. 127/2015/ND-CP dated December 14, 2015 of the Government on organization and operation of specialized inspection in Industry and Trade sector.

Article 1. To amend and supplement a number of articles of the Decree No. 127/2015/ND-CP dated December 14, 2015 of the Government on organization and operation of specialized inspection in Industry and Trade sector

1. To amend and supplement Clause 2 Article 4 as follow:

“2. Agencies assigned to carry out the specialized inspection in Industry and Trade sector including:

a) Vietnam Directorate of Market Surveillance, Department of Market Surveillance at provincial level.

b) Vietnam Competition Agency.

c) Vietnam Chemicals Agency; Industrial Safety Techniques and Environment Agency; Electricity Regulatory Authority of Vietnam; Industry Agency; Vietnam Trade Promotion Agency; Vietnam E-commerce and Information Technology Agency; Trade Remedies Authority of Vietnam.”

2. To amend and supplement Article 9 as follow:

“Article 9. Tasks and power of the Department Inspector

The Department Inspector shall implement tasks and power as prescribed in Article 24 of the Law on Inspection, Article 13 of the Decree No. 86/2011/NP-CP and the following specific tasks and power:

1.  Monitor, examine and urge the implementation of conclusion, suggestion, decision on inspectorate handling; decision on handling of complaints and conclusion on denunciations of the Director of Department, Inspector of Department.

2. Sum up and report on result of inspectorial result; handle complaints and denunciations, conduct citizen receptionist work, prevention and fight against corruption within the management scope of the Department of Industry and Trade in accordance with law provisions.

3. To guide, examination and inspection agencies and units under the Department of Industry and Trade to implement legal provisions on inspection, handling complaints and denunciations, conduct citizen receptionist work, prevention and fight against corruption.
